The confes sion on Saturday was first made generally, then repeated and reduced to writing, The DistrtMAttorney proposed to interrogate wltuees as to a statement made by Marsebell distinct from his confession, sod prior thereto. The Court did not see the necessity, as witness bad testified that the confession had been re duced to writing. Did not ask him then, to Bay what he knew about the murder, and did not at that time (Friday evening,) say I had proof against him. Did not charge him with the murder on Saturday evening. Did not then Bay that I had proof to convict him. About eight in the even lag I cent an officer to the tombs to scoff Freeke and Mucha and Me wife had their suppero. The officer who returned the keys to me sa d that Mardian wished to see me. I immediate ly went out, opened tte lock-up and- shut me ta( In with Harebell and his tette, who occu pied separate cells. I did not ,go into the cells, but remained outside, Harebell seemed to be quite communicative, and In a much more sof tened mood than he wan on t4a day previous. He asked to have his wife removed, and said that be wished to talk with me. After his wife wee removed, I said, "Marshall what •do you wish to say to me?" I told him that we had ar rested the man Frecke—that we bad:been hunt ing for him In New York, but had, foun hl d m at McKeesport—that ho (Frecke) had made a statement to me that he had been to New York since be (Harebell) had been there; that he had come In company with a etranger, answering the description of the murdered man, and that Marshall had mur dered him. I told Harebell what Freeke had said to me. I asked Harebell what time they got In on from New York. He said about ten o'clock. Did not tell him that I wee going to send him to Jell. I laid that a young man had been murdered, that we did not know who ho was, and that we had found his clothing and property in his (Harebell's) and Frecke's pasemslon. I stated farther that Frecke denied knowli g the name of the man who rode with him trom New York, and that I would be glad to know his came, that I might write to his friends in Germany, and let them know what had become of him. Before be an swered a word, and was about to talk, I geld to DM that although his statement might be Im portant to Nowell as well as friends of deceased that betted make no statement unless he would voluntarily do so. He asked in refereacs to Frecke, cud I told him what he had said. He then remarkedthat Freeke was a vile, bad man, and that ho had got him into all his difficulties, and that he had done all the cutting. I told him that Frocke had told me that lob (Martha ) had ccmo from New York with the murdered mss, and that he (Harebell) had kept him drunk. Don't :reoollect of telling Harebell that the statement of Frecke and Miller were sufficient to convict him. Think I did tell him that I believed him to be Kathy, I thought so from the secoad day of his arrest. I put Harebell's wife In the cell Intentionally. I believed her to to be an honest woman. This morning, as Mrs. Eliza Edgar, of Alle• gbeny, was attending market, she had her pocket book taken from her pocket, oat woo so fortunate as to detect the thief and recover the money.
