BE GETS DKDXK IMMEDIATELY, In Order to Properly Celebrate the Btrange Event, is Arrested, VBOT IS FEEED IX A SHOBT TIME One of the most remarkable cases, either in the police or medical records of Alle gheny county, came up yesterday afternoon in Central station. Inspector McAleese was told that Mark Kinney had been ar rested for being drnnk and asked to see him. "Bosh," replied the Inspector, "that man has not spoken since he was struck by par alysis six years ago. I have known him for 20 years and seen him every day since. It must be an impostor." But it was true, alter all, and Kinney was identified by other officers and spoke fluently lor the first time in six years, hav ing always in that time used a slate to com municate with others, although he retained his power ot hearing. He was so delighted at his sudden good lortune that he got drunk to celebrate the event and was arrested. Kinney is 45 years of age, an old soldier, having served in Company D, One Hundred and Second Regiment, Pennsylvania Volun teers. His story is certainlv a most remark able one. One evening in July, 1S83, Kin ney, who had been for ten years employed as a salesman in George Biggs' jew elry "store, went borne to his sapper feeling as well as usu al. He threw himself into a chair to wait until the meal was ready. In a lew minutes his wife came into the room to call him to supper, but was horrified to rind him lying back uncon scious in his chair. She roused bim so that he opened his eyes, but he conld not move his right side, and his speech was cone. A physi cian was hastily summoned, who, after an ex amination, pronounced it a case of paralysis. AN UNFORTUNATE CONDITION. From that time the unfortunate man has been a cripple, unible to earn his living, unable to speak, his little home has been wrecked, he has been a charitable charge to his friends, and his five children have been placed in the Jumon ville Soldiers1 Home at Uniontown. His friends have exhausted the 'kill of the best sur geons and physicians in the State from time to time, in the hone of restoring him to health and strength of bis former manhood. He was sent to Philadelphia once for six weeks, but re turned if anything norsetban when he started. The physicians, however, insisted that the man could be cured, and the treatment was kept up until about a vcar ago, when he became dis gusted and refused to bother any further with medicines or doctors. About three months ago Kinney, who bad been ialking about with the aid ot a crutch and a cane for a couple of years, began to feel something like life m his para! zed limbs, and in a short time threw away, first his crutch and then, about three weeks ago, his cane, and walked, though somewhat feebly, without aid. He became more hopeful then, of being able once more to earn his living and get his family circle around him again, but still despaired of ever recoenng his voice. But even tuis pleas ure was in store tor him. One evening last week he attended one of the theaters, and while watching the play be became interested to such an extent in ne of the characters that he at tempted to pronounce her name. To his sur prise he his successful, and when he ex claimed "Maggie! Maggie!" he was so pleased that he got up and left the theater, so that he could practice speaking w ithout attracting the attention his first utterance had done. But when he got outsiae the power was gone and he could not articulate a sj liable. CAME FBOai A COLD. Last Sunday he caught a severe cold which settled in his throat, and on Monday his throat swelled up so that he tied flannel around it. On Thursday morning lie felt so much better that be substituted a silk handkerchief for the flannel, and during the day he made an effort to speak. The attempt was again a success, and he began to talk to his wife in a blue streak, fearful every moment that his precious voice would leave him again. But it did nor, and yesterday he went aronnd among his friends, surprising them by calling them by name and conversing as if be had always been able to do so. Being satisfied that the recov ery of his voice was permanent, he jesterday afternoon threw away the little slate which has been his constant companion for six years, and In order to properly celebrate the occasion, be started down town and got drunk, with the re sult noted above. Inspector McAleese was so much pleased that his old friend had regained his speech that he ordered him set at liberty at once, say ing if there was any such thing as an excuse for a man getting drunk, Mark Kinney cer tainly had one j esteraay. Barr and other stockholders of the Pittsburg Plate Glass Company vs the company and Cap tain J. B. Ford was on again yesterday be fore Master H. D. Gamble, of the United States District Court. Sol Schoyer, Esq., for plaintiffs, and D. T. Watson, Esq.. for defendants, consumed an hour in argument as to whether plaintiffs should put in evidence a private agreement between Captain Ford and John Pitcairn, stipulating that the latter shonld not enter into business in opposition to thcTarentum firm. The Master reserved his decision. J. B. Scott's examination was resumed. He said the check-book of the company would show whether IH.000 in dispute had been paid. He said there was a written agreementbetween Pitcairn and Ford, and witness' father had said there would be no more selling out, as be had an agreement with Ford to that effect; JLO0O.OU0 would rot have been paid it such paper had not been in existence. At the meet ing on September 20. 1SS7, the directors' resolu tion was presented. McLain offered a resolu tion to build new works, with 300,000 feet capacity, and. after amendment was passed. Vice President Pitcairn refused to surrender the agreement to the stockholders, holding that it was a private matter. Pitcairn said the works contemplated could be built lor 1,500, 000. The rest of the forenoon session Mr. Watson spent in cross-examining Scott. He said he was elected treasurer at the organization of the company. The majority of the capital stock was held by the Fords. Accounts were kept at the Masonic Bank. Preferred stock was to get 12 per cent dividend before common came in. In IES6 32 per cent was paid. Wit ness had been indirectly interested in a sale ot 1,000 shares of stock sold by Ford and was of fered a one ! ,lf interest bv McLain. Shares bought for 8150, sold for 1175 to $182. Ford wanted to sell 4,000 shares, but was dissuaded by Scott He conld not sav whither he had about S100.000 of Plate Glass Company's money at that time in the Masonic Bank, of which McLain was cashier; didn't know whether Ford was paid by check on the Masonic Bank or by drafts on Now York. No opposition was shown to his or his fathei's election to the Board of Directors up to the time of the death of Scott, Sr. The latter at the time of his death held 800 shares of stock and witness L100 of original stock, on which there was a stock dividend of 33 per cent. All of his father's stock was sold at S147 for common and $200 for preferred. Pitcairn and Scott bought their stock at the same time. Ford wanted new capital and said he sold stock below its value because he must have money. At the afternoon hearing Mr. Watson con tinued to press Mr. Scott for dates of meet ings, conversations etc., to which he had Dre viously testified. Mr. Scott could not fix many dates. He admitted that his father was the person who offered the directors' resolution at their meeting September 20. 1SS7, providing for the building of the new works. The witness did not know what directors attended the meeting. He stated that before this meeting of the directors Ford had acknowledged to him that he was not satisfied with the way the works were being run, and wished to sell a number of shares to bring in money, as it was badly needed. A statement of the earned in come up to January 1, ISS7, showed $I79.000on hand. When asked by Mr. Watson why a dividend of $200,000 had been declared then and was to take effect shortly afterward, the wit cess stated that the condition of the bnsmess warranted this statement, as the increased in come would cover the necessary 520,000. A DISASTROUS DELAY. Suit of a Conl Firm to Recover 811,267 From n Bridge Company. W. H. Brown fc Sons, the coal shippers, yes terday entered suit against the Keystone Bridge Company to recover $11,267 50 damage. Tbey state that the bridge company built a new superstructure for the Lake Erie Railroad bridge over the Ohio river at Beaver, which was completed October 10. They obstructed the main and north channel spans by false piers supporting a false superstructure, leaving only 50 feet space abo e a 13 feet stage of water. October 29 Brown S. Sons sent out 159 barges loaded with coal, which were unnecessarily de layed by the bridge company's neglect, and one steamer was unable topass at all under the false superstructure. The delay to their ship ments caused them considerable loss, and they hold the bridge company liable. An Electric Railway Sned. John Brady and wife yesterday entered suit against the Second Avenue Passenger Railway Company for $10,000 damages. They state that on February 17 Mrs. Brady was getting off a caron the Second avenue line ata place known as "the station house." She stepped on a box and (ell, breaking her leg. It is claimed that the company shonld maintain a platform and keep it safe at that point. A Damage Suit for 55,000. A statement was filed yesterday in the suit of Charles and Jano Tomlinson against Alfred B, Reed for $5,000 damages for the death of their son. The latter was an apprentice to Heed, wLo is a tinner. He was at work on the roof of a three story house in Braddock, and in going down on a rope used for the purpose it broke and he was killed by the fall. Notes From the Courts. A verdict for the defendant was given yesterday in the suit of Barnett Stepp against William Hardt, aD action to recover $3 wages alleged to be due. In the suit of McFall, Hetzell & Co. against W. Jarak and C Muscber, an action on a con tract, a verdict was given yesterday in favor of the plaintiffs for S21S 96. In the case of John Jenkins against Louis Hilkc and P. M. Connelly to recover damages for an alleged illegal sale, a verdict was given yesterday for the defendints. A verdict of J334S7for the plaintiff was given yesterday in the suit of Edward Latham against the Westinghouse Electric Company; an action on a contract to furnish dies. The jury is out in the case of Karl Kline against Joseph Hufnagle and Sheriff McCand Icss tor damages for the seizure and sale of four horses alleged to belong to Kline, and taken as the property of another man. Amx suit was entered against the plaintiff yesterday in the suit ot Mary Ann Thomas against Altraeyer d. Molsberger for damages for the death of her husband, who was killed by an explosion of firedamp in the defendants' mine. A statement was filed yesterday in the suit of James Demston against Peter Sible. Detu ston claims $3,000 damages for false arrest. He states that bible charged him with stealing a stepladder He was committed to jail by Alder man Rodgcrs, where he remained for six months. The bill was ignored by the grand jury. Mes. Margaret Klemm yesterday filed an answer to the petition of her stepson, who asked that she be compelled to produce a later will made by his father, Joseph Klemm, than the one filed by Mrs. Klemm for probate. Mrs. Klemin states that the only will left by Joseph Klemm is thatprobated on March 27. She says she has no knowledge ot and never heard of any subsequent will, and asks that the petition be dismissed. Take it in Time.
