Cel James Boen, an old and well known citizen, died this morning at 2 o'clock at his bearding place, (Hattle Kepperllng's) Ne. 11 fcast Chestnut street, after an illness of sev eral months, aged S3 years. Cel. Boen was a native of Ireland, but came te America in his youth, and settled in Pennsylvania, He was a contractor and helped te build for the state the Philadelphia A Columbia railroad, new a part of the Penn sylvanla rallreau. He was afterwards as slstant superintendent or the read under Gen. A. L. Roumfert and Cel. James Cam Cam eeon. He had charge of the state locomotive works at Parkesburg, and at the same time ran a private foundry of his own at. Chris liana, this county. He was In partnership with David Cockley, about 1810, lu carrying en the old frame foundry, oerner Duke and Chestnut streets, and later at the West Chestnut street foundry with Michael Hanaway. The case was re turned te court by the constable of the town ship en Information furnished te him that liquor was sold en Sunday. A num ber of witnesses called by the com monwealth testided they bought whisky from Fellenbaumat dlQerent times en bun day and paid him for the same. The defense was a denial en the part of Fellenbaum that he had ever violated the liquor law by selling en Sunday. He admit ted that en one occasion en a Sunday a party of four men were at his hotel and leek din ner with him. Before dinner be treated the party te whisky in the private part of his Heuse, but received no pay for It. UIs coun sel argued that the giving of whisky In the private part of the house was net a violation of the court, but the court held that the land lord could net gie liquor away en his premi ses en Sunday.
