'Squhe Grier had before him Ben jamin Stipe, charged with the theft of $180 by Charles Eckert. The alleged robbery was committed last February while both were inmates of a bearding heuee kept by Mr. Jehn Bartch, at the cernar of Cherry .street and Lancaster avenue. A warrant for Stipe's arrest had been' issued as seen as the lebbery had been discovered, but he becoming frightened had left the town. Yesterday he was captured in this place and brought te trial. The plaintiff did net show by any witness that he really had such a sum of money in his own pos session, much less prove the defendant the thief. Mes.t of these who heard the case believe young Stipe innocent, and de net think Eckert possessed the sum of money he alleges te have been stolen. The justice took tbe same view of the matter and dis charged the accused from custody, unvlus Accident. As tbe prospect of getting a new government building here is by no means brilliant, Mr. Marshall has done ths naxt best thing hu has urged en tbe department the necessity of mere room and the propriety of closing a contract with Mr. Eepler te furnish it. Last evening a telegram was received from the department by Postmaster Mar shall announcing that the first?, fleer of Mr. Kepler's building would be 'leased as a posteffice as seen as it can be fitted up. The new office will be mere thau twice as large as the old one and superior in every way. It will be 3G feet in width and 115 feet deep. The front will be almost wholly of Ficnch plate glass, vith two front doers and four front windows, and abeve the doers and windows .will be transoms of stained glass. The mail bags will be received and delivered from the rear of the building, via Market street. The interior will be fitted up with all the conveniences of firft class postefficcs. A largely in ci cased number of boxes with the Yale lock will be put in, and the office will be se arrang ed that box renters can call at the ollice at any hour of day or night and get their mails. Puiladelphia, April 2C Delegates te the Irish national convention gathered slowly this morning, and showed marks of fatigue from yesterday's long session. As the delegates from all raputable Irish organizations in accord with the Dnblin platform were entitled te seats, both the portion reserved for delegates and the galleries were crowded, te-day being evidently considered the great day of tbe convention. Shortly befere twelve o'clock Mrs. Par nell entered, escorted by Mr. Alexander Sullivan, of Chicago, who introduced her amid tremendous applause. Id Session. At 12 o'clock Mr. Sullivan, who is a brilliant young lawyer of Chicago, at the request of a cemmittee of seven and in persuance of an official call, called the body te order. He made a feeling address in which he invoked the " Almighty Ged that the proceedings of the convention might be characterized by wisdom, tolera tion and prudence, that they may resnlt in that actual unity which alone will in sure substantial progress in securing jus jus tice for Ireland." Kulca Adopted. Rev. Merris J. Deruey, of Chicago, was chosen temporary chairman without a dissenting vote, though a delegate, amid hisses, declared that " the thing was set up." On taking the chair Father Dor Der ney made some appropriate remarks, at the conclusion of which Dr. O'Reilly, of Detroit, presented a set of mles providing that no delegate shall speak twice en the same subject, and that no debate shall be in order en any subject net included in the call for tbe convention. Dr. O'Reilly immediately moved the pre vious question en adoption of rules and several angry pretests arose, delegates declaring they would net he gagged. Con siderable opposition was manifested te the rules, but after seme confusion, a vete was taken and they were declared adept -ed. Adjourned Until 4:30. After naming four secretaries and ap pointing a cemmittee en credentials the convention took a 1 ecess of ten minutes. Upen rc-asscnibling at 1:30 the privileges of the lloer were accorded te Rev. There was a long discussion in the Senate te day en a motion te reconsider the vote by which the bill removing the limit as te the amount of capital stock and bends flxed at $00,000, by the general railroad act of 1808, was pahsed en third reading. Grady denounced the bill as a " legislative snake," and claimed that it would result in the watering of stock, and Laird .thought the bill ought te be amended s-e as te make the issuing of bends subject te existing law. Wallace Emery, Humes, Cexc and King favored its passage without the proposed amend ment, neatly all these senators contending that under the present law no first class railroad could he censtiucted. The motion te reconsider was defeated and the bill passed finally, yeas 33, nays G Adams. Grady, Goidea and Reyburn, of PhiTadeJJ ph'a; Mylin and Stehman of Lancaster,and Laird of Westmoreland. The Senate bill te provide for the republication of the supreme court reports was passed finally. Philadelphia, April 26 The Arch stiect opera house was burned this morn inn for a third time since it was huilt.The flames originated by the explosion of a gas steve under the steps leading te the gallery, and spread rapidly te the reef. The tire seen made its way te the stage and the greatest damage was dene there including the destruction of the waidrebe valued at three thousand dollars which belonged te the house. The reef fell in and crushed many seats in the auditeruni, but the body of the heuse is net seriously damaged. The theatre has net been occupied for several weeks. It is owned by Belten Winpenny, and leased hv Jeseph E. Winner. The less- will net, it is thought, reach $15,000, as the walls are standing and the front of the building is uninjured. The building was insured for $19,000. Fire In a Foundling Asylum. New Yerk, April 26. Fire breka out at three o'clock this morning at the New Yerk foundling asylum. William Jacobus, aged 16, a son of a farmer living en the Bergen county side of Dundee Lake, near Patersoe, Btarted te eress the lake about G e clock en Wednesday morning, his errand being te engage a washerwoman for the day. The river is high and the wind was blowing a gale from the northwest. The beat was a square bowed, flat bottomed coew, and in spite of his efforts it was swept down toward the Dundee dam. This dam is 450 feet long, and it is said te be one of the longest of. the kind in the U. States. It is only 20 feet high. It is built of solid masonry, 45 feet thick at the bot tom, and 6 feet wide at the top. It widens the river into a lake, which supplies all the mills in Passiae eity with water. The beat went ever the dam. As it tip. ped en the brink Jacobus was thrown out and he fell out but apparently se far away from the curtain of water that he was net carried down te the roeky bottom of the abyss below. The beat ledged en a rock a short distance below the dam, where it lay bottom up. The boy made brave ef forts te swim te te the beat, which were witnessed by occupants af several farm houses along the shore, and by rueu going te their work. After an hour's struggle in the eddies, he succeeded. After climbing en the bottom of the beat he stretched himself across it, apparently com pletely exhausted. The cold water was running ever all but a small portion of the beat. After a short time he recov ered his strength and called out te theso who had gathesed en the shorn te ceme and save him. He said he was dying with the cold. His parents and brothers and sisters were seen en the .shore, together with 600 or 700 ether spectators, all lVan tically encouraging the efforts at rescue. The river at this point is very rough, being full of rocks, forming daugereus rapids, but soveral brave, although futile, efforts were made te save the" boy. Wm. Uunnigan, the gatekeeper and watchman at the dam, succeeded in going out in a beat te within 20 feet of him, when his beat capsized, and Dunnigan himself was nearly drowned befere he was rescued. Next a repe vsas stretched across the river from shore te shore, and about 10 o'clock a man endeavored te walk across from rock te rock, steadying himself by the rope. The current washed him from the reeks and he was swept down thu stream, but he managed te pull himself hand ever baud along the rope until he reached the shore exhausted. Jacobus had kept up piteous appeals te his friends te keep trying te rescue him, but a little after 11 o'elock he fell ever en the bottom of the beat, his cries ceased, and for a short time he was seen te shiver. After this he was net seen te stir. He had been ever four hours in the icy water and cutting wind. His feet lay in the water, which ran ever the beat.
