Before Judge Patterson there is new en trial the case of A. J. Duulap vs. David H. Potts, action te recover $402.50. Ac cording te the evidence offered te sustain the allegations of the plaintiff, en Feb. 21, 1881 Duulap, at the request of Potts, bought 50 shares of Philadelphia and Reading stock, threuglTJ.B. Leng, broker, arid which was charged by Leng against Dunlap's account with Glendennine & Ce. of Philadelphia, for whom Leng operated ; defendant was uetified of it and Dunlap several times notified him of fluctuations in the stock and advised him te sell, which defendant refused te de as he thought the stock would go higher ; eventually the stock went down se low that Duulap was afraid te keep it any longer and he gave Lene directions te sell it The result was effected at a less of 102.50 te plaintiff, which amount he new claims with inter est, as due him from defendant. The plaintiff aud several witnesses were called te substautiate this slate of lacts. Tlie MeleiKiant'a Hide.. According te the testimony of Mr. Potts, en the date aforementioned, he ac cepted an offer previously made him by Dunlap, of assistance in the purchase of Heading stock, in which Potts understood that he was only te have au interest in any profits that might aiise from the trans action, as he believed he had received such information as would euable him te relieve te some extent his previous losses. Plaintiff .subsequently told defendant that he had ordered 50 shares of Heading stock at 332. ever which defendant never had the absolute control nor ever asssumed any such ownership. The next day Dun lap desired him te acquiesce in the sale of this stock, but he advised Mr. Dunlap te held en. telliuff him. however, that he had 110 control ever the stock. Subse quently plaintiff informed the defendant that he had sold the stock at a less, (an the pi ice had gene down considerably), saying that he was compelled te de se as he was carrying tee much stock at that time. Duulap desired him te secure him from the less that had been suffered iu the result, hut Potts refused te de it, as he contended that the stock was net his. The defense further bought te prove that none of the strck had ever been purchased ab selutely, hut it had been only a marginal and wagering speculation, entered into by Dunlap, and therefore there was nothing recoverable from the defendant under of the circumstances presented. Dr. Witmcr being called in admiuistcd the proper remedies, and he is new out of danger. Tin e mere Arabs, from Jerusalem, younger and better looking than the one who came here a week age, reached Lan caster yesterday and attracted a geed deal of attention by reason of their swarthy complexion and shabby Oriental attire. They carried a petition for help, purpos ing te be issued by the Y. M. C. A. of Philadelphia. Gee. Penlz, painter and glazier, has filled the front windows of Jehn P. Schaum's building, corner of Seuth Queen and Minim streets, with the largest plates of glass ever put up iu this city. The two large plates arc each 12S inches long aud 82 inches iu width, aud contain, each 10,49G square inches nearly 73 square feet. The glass, which is very heavy and perfectly tiauspareut, was furnished by Marshall & Rengicr. Tayler's full orchestra furnished the music and the grand premenade ( a new and novel one), led by the last of the abeve named gentlemen, was participated in ey some tuirty-iive couples. All pres ent voted the affair au entire success, the brilliancy of the occasion being much heightened by the elegant dress of the ladies. RAILROAD ACCIDENTS. A Man Killed at Oakland Train Delayed. About 5 o'clock yesterday afternoon, Wm. Loomis was struck by eugine 419 en the P. R. R. at Oakland station and iu Btantly killed. Mr. Loomis was a resident of Oakland, C5 years of age, with a wife and several grown up children. Last evening about five o'clock the day express cast gave out near Landisville, owing te some derangement of the injec ter, and the train was delaved mere than an hour. Finally another cuinuu w.m sent. up from Dillcrvillle and the train was brought in. This morning between 8 and 9 o'clock as freight engine 884 west was pulling into the depot, a brakeman who was running east en top of the train miscalculated the difference between his own speed and the speed of the train and received a sharp rap ou the head from the heavy girder that sustains the eastern end of the depot. He dropped te the top of the car like a lump of lead, but did net appear te be seriously hurt, as he almost immediately resumed a sitting posture. This morning about 8 o'clock as a ilmvn of steers were being driven towards this city, near Potts' tavern, en the Philadel phia pike, they crowded closely around Mr. Henry F. Ilaitmau's limc-wa-'en. in which two mules were attached, and which was being driven in the same direction. One of the stecis, iu attempting te get te the opposite side of the read, jumped be tween the lime wagon and the mules, but landed astride the wagon tongue. While in this position he horned the males, oue of them being gored quite severely ; and when extricated, the steer made a limdr dart for Jehn Gill's one horse wagon, which was going in an opposite direction. Getting his horns locked among the spokes of one of the wheels, the steer pitched the light wagon upside down, throwing Mr. Gill te the ground and bruising him te some extent. The wagon was wrecked. having the springs, shafts, dasher and ene of the wheels broken. He was calm and composed. He submitted te pinioning without seeming te appreci ate what was going en and stared wildly oreuna mm wnen placed under the noose. The drop was nine feet and death instan taneous. The body remained hanging ene hour. The Scene at The Execution. The execution took place at 9. o'clock tins morning in the jail at Wandsworth. The precession entered the yard of the ptisen at 8:55 o'clock the orison bell tell ing the death knell. The chaplain headed the precession, followed by two prison officials with their wands. The prisoner who up te the time of starting had been calm ana composed looked pale and dejected and was very nervous. Just before neon te day Henry Sutcr, aged 14 years, an employer iu the Pulton cetten mill, corner of North Duke and Lemen etrcets, had his right arm terribly lacerated by what is known iu the mill as the band machine. It had been stepped for a short time, and the boy had placed his hand in between the sharp hooks with which it is furnished. It was put in motion, without warning te the bej and his arm was caught between the hooks and terribly lacerated from the hand te the'olbew. In West Chester yesterday the case of the commonwealth against Jehn D. An drews, of Lewer Oxford township, was taken up in quarter scss'ens. Several witnesses were examined aud all testilied as te his unsoundness of mind. The court charged the jury that they could net find him guilty of murder in the first degree. The jury returned after an absence of a few minutes with a verdict of net guilty en account of insanity. In the afternoon he was taken te tne ierristiwn insane asylum. Complaint is made by residents of North Duke street of the depredations of petty thieves, who about twilight or later enter fie front yards and strip the gardens of their flowers and plants, ihe JJcaner garden, always a place of beauty in the spring aud summer, has suffered severely from this sort of thievery, and there have been ether instances of the same in the neighborhood of Duke and Lcmea streets. One Mere Unfortunate. A yeuug woman calling herself Maggie Sheaffer, appeared at 'the mayor's office yesterday and wanted te be sent te the almshouse, she being subject te epileptic fits. She said she was from Indiana, had recently been working in Harrisburg, hut had te give up work by reason of her in firmity. She was cared for at the station house last night, and her condition having been made known te the county commis sioners, she was sent by them te Phila delphia, where she has friends and where she can be better cared for than here.
