That all persons excepting Justices of the Feace ho shall hold any office or appoint ment of profit or trust under the government of the United States, or of this State, or of any city or incoiporated district, whether, a commissioned officer ot otheiwise, a subordi nate or agent, who is or shall be employ ed un der the legislative, judiciary or executive de partment of this itate or the Uniied States, or any city or incorporate district ; also, that every member of Congiess and the State Leg islature, and of the select and common councils of any incorporated d istrict, i9 by law incapable of holding or exercising, at the same time, the office or appointment of Judge, Inspector or Cl.rk of any election of this Commonwealth, and that no Inspector or Judge ,.or other officer of any such election, tdiall be eligible to any office then to be voted for. Also, the4ih Sec tion of the Act of Assembly, entitled "An Act relating to Elections and for other pur poses, approved the 10th day of April. 1856, it is enacted that the foregoing 13th Section shall pot be go construed as to prevent any mil itary officer or borough officer lrom serving as Judge or Inspector at any general or special elections in the Commonwealth. The general, special, city, incorporated dis trict and township elections, and all elections for electors of Piesident and Vice President of the United Stites, shall be held and conducted by the Inspectors and Judges elected ns aforo said, and by Clerks appointed as hereinafter provided. No person shall be permitted to vote at any election, as aforesaid, but a white freeman, of the aje of twenty one years or more, who shall have resided in thi iUate at leaft one year, and in the election district where he offer to vote at least ten days immediately preceding such election. and within two years paid a State or County lax which shall have been assessed at least ten days before the election. But a citizen af the United States, who had previous ly been a citizen of this State and removed therefrom and returned, aud who shall liave re sided in the election district and paid taxes as aforesaid, shall be entitled to vote after residing i;i this State six months. Iu all cases where the name of a rerson claiming to vote is not found on thelist fur nsh ed by the Commfssfouers and Assessors, or his ripht to vote, whether found thereon or not. is objected to by any qualified cit:zen, it shall be the duty of the Inspector to examine such per son on oath as to his qualifications ; and if Le claims to have resided ia the Stale one year or more, his oath shall be sufficient proof thereof, but he shall make proof by at least one com petent wituess, who shall be a qualified elector, that he has resided in the district for more than ten days next preceding said election, at d shall also himself swear t!at his bona fide re-hh-nce. in pursuance of his lawful calling, is within the district, and that he did not remove into said district lor the purpose of voting therein. Every person qualified as aforesaid, and who shall make due proof, as reqnired, cf his resi dence and payment of taxes as aforesaid, shail be admitted to vote in the township, ward or district iu which he shall reside. If any person shall prevent, or attempt to prevent, any oiScer of any election under this Act from holding such election, or use or threaten any violence lo any such ofScer, or hall block up the wiudow, or avenue to any window, where the same may be holding, or shall riotou-dy disturb trie peace of such elec tion, or shall use or practice any intimidating threats, foice or violence, with design to influ ence undaly or overawe any elector, or to pre vent him from voting, or to test rain the free dom ot choice, such persons, on conviction, shall be Sued io any sum not exceeding J-.'.OO and be imprisoned for any time not less than one month nor more than twelve months; and if it shall he shown to the Court where the trial of such ofTence ehall be had, that the person so offending was not a resident of the city, ward, district or township where the said offence wis committed, and not entitled to vote therein, then, on conviction, he shall be sentenced to piy a fine of not less than one hundred nor more than one thousand dollars, and be impris oued not less than six months nor more than two years. "That the qualified voters of the several counties ol this Commonwealth, at all geueral, township, borough and special elections, ate hereby, hereafter, authorised and required to vote by tickets, printed or written, or partly printed and partly written, severally classified as follows : One ticket shall embrace the names of all judges of courts voted for, and be la belled, outside, 'Judiciary'; one ticket shall embrace the names of all State officers voted for, aud be labelled, 'State'; one ticket shall embrace all county officers voted for, including ollice of Senator, member or members of As sembly, if voted for, and members of Congress, if voted for, and be labelled 'County'; one tic ket shall embrace the names of all towrship officers voted for, and be labelled 'Township'; one ticket shall embrace the names of all bor ough officers voted for, and be labelled "Bor ough'; and each class shall be deposited in separa'e ballot boxes." Pursuant to the provisions contained in the Act first aforesaid, the Judges of the aforesaid districts shill respectively take charge of the certificate or return of their respective districts, aud produce them at a meeting of one Judpc from each district, at the Court House in the borough of Ebensburg, on the third day after the day of the election, being FRIDAY, thb 15th day of October, A. D. 18fJ9, aed then and there do auu perform the duties required of them by law. Aud further, if anv Judge, by sickness or unavoidable accident, is unable to attend said meeting of Judges, then the certificate or re turn aforesaid shall be taken charge of by one of the Inspectors or Clerks of the election of the same district, who shall do and perform the duties of 6aid Judge unable to attend.
