AN ORDINANCE To Create and Organizes a Paid Flro De partment for the City of Philadelphia, and to Make nn Appropriation Therefor. Section 1. The feleet and Common Councils of tbe city of Philadelphia do ordain. That tho Fire Department shall consist of seven Fire Commissioners, one Chief Engineer, fivo Assist ant Engineers, and as many foremen, engine men, hosemen, hook and-ladder men, and other persons, to be divided into companies, as the number of engines and other fire apparatus belonging to the city shall from time to time require. Section 2. The said Fire Commissioners shall be citizens of Philadelphia, of good character, not under thirty years of :ige, wLo shall serve without compensation, and be elected as fol lows: Three by Select Council and four br Coin- mon Council on the last stated meeting in f December, 1870. The said Commissioners, wheu oflice, three for the term of two years and four for the term of four years, aud every second year thereafter, at their liri-t stated meeting In the month of February, there shall be elected in the same manner three or four persons, as tbe caso may be, by the Select or Common Council, in which tbe vacancy may occur, to serve lor the term of four years. The minority in each Chamber shall at all times bo repre sented by one member in said Board of Fire Commissioners. Tbe said Commissioners to hold their olllccs until their successors are duly elected and qualified. Section 3. That in case of death, resignation, disqualification or removal of, or the neglect or refueal to perform the duties incumbent upon their cilices by any or all of said Commis sioners, the Councils shall proceed at once to fill such place or places by a new election, os above provided, and for the unex pired term. Section 4. That the said Fire Commissioners shall proceed at once to organize a department, to consist of not exceeding twenty-two steam, fire engines and five book and ladder compa nies, and thereafter such number of companies as they may from time to time be authorized and directed by. Councils. They shall have the appointment of and entire control over all ofll cers and employes, and of the property of the Fire Department, and shall be held strictly accountable therefor to Councils, by whom, upon conviction of dereliction of duty, malfea sance in oflice, or violation of any of the provi sions of this ordinance, after a hearing before the Joint Committee on Fire Department, they ehall be removed from oflice. N Section 5. The said Fire Commissioners shall hold at leant two stated meetings monthly, and keep a correct record of all their proccediugs, subject at all times to the inspection of the Mayor and Councils, or their committees, and shall annually in the mouth of January pre pare an accurate report to Councils of the state of the Department They shall have au thority, in conjunction with the Committee on K Fire Department, to fit up and appropriate to tneir use ana tnut oi tne engineers suitable rooms as olllccs, the necessary expense of which shall be defrayed out of the funds ap propriated for the use of the Department, and the President of the Commissioners shall have authority to draw warrants upon the City Treasurer for such sum or suras of money as they may from time to time require, not ex ceeding the appropriations by Councils. Pro vided that all bills for expenditures shall first be submitted to and approved by the Commit tee on Fire Department. They shall have power to suspend or expel any member of any fire company and to reorganize any company, and they shall also adopt a suitable uniform to be worn by the officers and men. Tho said Fire Commissioners shall also have authority to make such rules and regulations for the government, discipline, and good order of the Department and for the extinguishment of fires, as they may think necessary and expedient: provided such rules and regulations bo not inconsistent with any ordinance of Councils. All meetings of tbe Fire Commissioners shall be opes to the public. Section 0. That on the third day of January, 1871, tbe Fire Commissioners, as herein pro vided for, shall meet and organize, and elect from their number a President. They shall also elect a Secretary and Messeneer, who, by virtue of their offices, shall be members of the Fire Department. The Secretary shall also perform tbe duties of clerk to tbe Chief En gineer, and the Messenger shall also bo mes senger to tbe Chief Engineer. The said Fire Commissioners shall also give public notice by advertisement, in at least three newspapers, for one week, that tbev are prepared to receive applications for membership in the Fire Depart- r ent anu proposals ior tne sale or lease to tne city of such fire apparatus, houses, horses, and other property needed by them for tho purposes of tbe Department. Section 7. All officers and members of tbe Fire Department shall be persons of good moral character, and shall retain their respective positions for and during good behavior, and for such times as they perform their duties harmo niously with their associates and satisfactorily to the Fire Commissioners. They shall not be subject to removal on accouut of any political, religious, or other sentiment entertained by them, so long as such opinion or sentiment does not interfere with tbe faithful and efficient dis charge of their duties as members of the Fire Department. Section 8. That the salaries of the officers and employes of the Fire Department shall be as follows: Chief Engineer, two thousand fivo hundred dollars per annum (12500.) Secretary of tbe Fire Commissioners and Clerk of the Chief Engineer, twelve hundred dollars per annum (f 1200.) Messenger of the Fire Commissioners, eigkt hundred dollars per annum (.tsuu.) Assistant Engineers, each one thousand two hundred dollars per annum ($1200.) JCnginemen, each one thousand dollars per anunm iviuuu.j firemen, each eight hundred dollars per annum (ibOO.) In the absence of the Chief En gineer an Assistant Engineer, to be designated by him, shall execute the duties of his office with full powers. Section 13. Every engine company shall have one etigine man, one fireman, and one driver, who shall be permanently cmpl )yed, and who shall nt all times be in nnd about the engine home, except when unavoidably absent; and shall also have one foreman and eight hose men. Section 14. Every hook-and-ladder company shall have one driver and one tillcrmnn, who shall be permanently employed, and who shall ot all times I e In and about the truck-house, except when unavoidably absent, and shall also have ore foreman and ten merrbers. Section 15. The property of each engine com pany shall consist of not less than one steam fire engine, one hose carriage, one thousand feet of hose, together with such other apparatus for effectual service as tho Fire Commissioners shall deem necessary, and four horses. The use of (aid horses shall be controlled by the foreman of each of the several companies, sub ject to the approval of tho Chief Engineer, la such manner as his judgment may dictate. Section 16. The property of each hook and ladder company shall consist of not less than one ladder truck and all necessary ladders aud Implements, and two horses. Section 17. The Fire Commissioners, Chief and Assistant Engineers, and the Foremen of companies be, and they are hereby authorized to exercise the powers of police officers in going to, While at, and returning from any fire that mny occur or niarm oe given. . Section 18. Each engine company may have extra men, not exceeding four in number, and each hook-nnd-laddcr company not exceeding six. They shall not be entitled to nay except when ordered on duty in the place of absentees, when they shall receive the same pay, to bo de ducted from the monthly salary of such absentees. Said extra men shall be furnished by the Commissioners with hat and badirc with out charge therefor; in case of a vacancy in the company to wnicn tney are attached tney snail, if worthy and competent, be eligible to promo tion to fill the same. Section 19. Tho Firo Commissioners mav grunt to any officer or member of the de partment, if they deem it compatible with the intctests of tbe department, a vacation, not exceeding two weeks in any one year, upon such terms as they may think expe cicnt. Section 20. The Fire Commissioners shall have power to remove such of the fire-alarm signal-boxes as may not oe needed, and locate the same and such others as they shall deem i.ecefary, and they shall also make such modifications in said boxes and tbe manner of giving alarms of fire as they shall con sider requisite and necessary for the efficient working of the Firo Department. Provided tie same be done under tbe supervision of tbe Department of the t Ire-Alarm aud Police Tele- section 3i. i ne present fire department is hereby placed under the direction and control of the said File Commissioners, subject to their lulcs and regulations; and they shall have full power and authority to suspend any enmpauv t r companies from active service for violatiou of the sumc, or dismiss them from the F ire De- pariment. Hie present Chief and Assistant Engineers arc hereby directed to report to aud obey the rules and regulations of said Fire Com missioners; and whenever they shall dem the cervices of the said Chief and Assistant Engi neers no longer necessary, their term ot office shall cease. Section 23. That the Fire Commissioners are Lenny authorized, if they deem it advisable, to lease upon such terms aud for such length of lime out exceeding three years as they shall think necessary and expedient, or purchase, such ot tbe apparatus, bouses, and other pro perty of tbe present fire companies as wilt in sure the Immediate and efficient service of the department. No house rented or leased by the said Fire Commissioners for the use of the department shall be occupied by other tenant or astociaiion. Section 23. That it shall not be lawful for any person or persons to injure, deface, or ia any manner destroy any of tbe fire apparatus, or property of the same, or any police or llre oluim telegraph box or wire, or hinder or ob struct any engine or hook and ladder company, or any members thereof, or officers of the De partment, from freely passing along the streets ot ihe city, to or from a fire, or in any manner hinder or prevent any of the said fire compa nies, or any member or officer of tho Depart ment, from operating at any fire. Section 24. That it shall not be lawful for any person or persons knowingly to give or cause to be given any false alarm of fire by means of the telegraph signal boxes. Section 25. That it shall not be lawful for any person or persons, without the couseut and authority of tbe Fire Commissioners, to have in his or their possession, use or make, or cause to be made or used, any key or keys to any fire engine, hook-and-ladder house, or telegraph signal box; nor shall any person or persons not a member or ontcer oi tne fire department use or wear any part of the uniform determined upon by the Fire Commissioners, without their pel mission first had and obtained. Section 20. Any person or persons violating . si y of the provisions of sections 23, 24, and 25 ot this ordinance snail suiter and pay a line not less than five dollars nor more than one hundred dollars, for the use ef tbe city. Such line to be recoverable as like penalties are now bv law recoverable. ' Section 27.
