An unincorporated non profit organization, whose pur pose is civic betterment in the community, is planning to spon sor a teenage baseball team. The game would be played on private land which the owner is willing to allow the group to use. If one of the players was injured would the members of the sponsoring organization be liable? —E F.R. A. A player who voluntarily participates in a game, such as baseball, assumes all of the or dinary risks incident to the game. He would therefore be barred from bringing any action, for damages which may have been caused by being hit by a pitched ball, sliding into a base, etc. It is also the law that a player does not assume the extraordinary risks of the game. Such a risk may be stumbling on a large rock on the base path which the runner had no reason to believe was there. It is quite possible that the sponsoring organization’s members might be held liable for permitting such a condition to exist, but they could not be held liable for injuries arising from the ordinary risks of the game of baseball. Q A friend attending West Chester State Teachers College /tells me that a professor there says that if a man standing in Pennsylvania wilfully shoots a man standing across the State line in New Jersey he cannot be prosecuted for murder in eith er State. Is there such a law’ A. Shoud a man standing m Pennsylvania fire a rifle across the Pennsylvania - New Jersey line and thereby kill a person m New Jersey, the jurisdiction of the crime is in the courts of the New Jersey county in which the victim received the wound.
