How Smith Lost a Case.
Tlie court and Jury, as well as the
spectators, generally enjoy the scene
when n lawyer, lu an attempt to ladger
or browbeat a witness, comes off second
best In the encounter. A correspondent
recalls an amusing Incident of this sort,
which happened a few years ago In nn
Albaify court room.
The iilulntUr, who was a lady, was
called to testify. Bhe got on very well,
and made a favorable Impression on the
Jury under the guidance of her counsel,
lion. Lyman Tremaln, until the oppos
Ing counsel, Hon. Henry Bmlth, sub
Jected her to a sharp cross-examination.
This so confused her that she became
faint, and fell to the floor In a swoon.
Of course, this excited general sympa
thy In the audience, and Mr. Smith saw
that his cnne looked badly.
An expedient suggested Itself by which
to make the swooning appear like a
piece of singe trickery, and thus destroy
sympathy for her. The lady's face lu
swooning had turned purple-red, and
this fact suggested the new Hue of attack.
The next witness was a middle-aged
lady. The counsel asked !

"Yes sir."
" l'eople turn pale when they faint,
don't they y"
A great sensation In the court, and au
evident confusion of witness. 13ut In a
moment she answered, "No, not al
ways." "Did you ever hear of a case of
falutlng where the party did not turn

"Yes, sir."
"When?"
" About a year ago."
"Where was ltV"
"In this city."
"Who was It V"
I'y this time the excitement was so In
tense that everybody listened anxiously
for the reply. It came promptly, with
a twinkle in the witness's eye, and a
quiver on her lip, as If from suppressed
humor:
"'Twos a negro, sir."
Teal after peal cf laughter shook the
room, In which the revered Judge Joined.
Mr. Hid 1th lost his case, not to say his
temper.
A Joke on The Old Man.
There were two men got in a fight In
front of the store to-day, said a north
end man at the supper table, "and I tell
you It looked pretty hard for one of them.
The biggest one grabbed a cart-stake and
drew It bock. I thought sure he was
going to knock the other's brains out,
and I Jumped In between them."
The family bad listened with wrapt
attention, aud as the head paused In Lis
narrative, the young heir, whose respect
for his father's bravery, was immeasur
able proudly remarked :
" He couldn't knock any brains out of
you, could he father?"
The head of the family gazed long and
earnestly at the heir, but as the youth
continued with great innocence to
munch his fourth tart he gasped and
resumed his supper.
KJT " Good afternoon, my dear friend ;
I am delighted to see you. And to what
am I Indebted for the pleasure of this
visit ?"
"I'll tell you that presently; but first
permit me to embrace your charming
child. Can't I, my little man?"
" Yes, sir, if you'll promise not to cut
Into papa."
" Cut into your papa?"
"Yes; 'cause papa said when he saw
you coming, "Here comes that fellow to
bore me again I ' "
2" A minister once had a colored
servant in whom he placed much confi
dence, and often gave him his manu
script for perusal and criticism. On one
occasion he hod arranged a sermon from
that passage where the devils are per
mitted to enter the swine. The minister
asked his opinion. The man declined ;
said he didn't like to tell; but upon
being urged, said ;
" Well, manga, if I must tell, I should
think you made was work 'mong de
hogs den de debll diil."

day of Judgment.
