A Curious Suit for Damages.

tery, bus been reversed by the Supreme
Court of Wisconsin, because the plaintiff's
counsel, In bis argument to the jury, as
sumed facts to bave been proved concerning
wblch no evidence bad been taken, and
also appealed to prejudices foreign to
anything In proof. Thore was no testimo
ny whatever concerning the ability of tho
defendant to pay what are called punitive
or exemplary dnmages, yet the counsel for
the plaintiff endeavored to supply this want
by arguing that as the defendant was in
the employ of A great corporation, and that
corporation was wealthy and powerful, he
was therefore able to pay any judgmout
that might be obtained against him. Pro
per exceptions were takeu,and the Supreme
Court says that enough nppears ou tho
record to show not only that the loarned
coutiRol commented on faots not in evidouco,
but that in effect, though not a witness,
be testified to faots himself. In reaching
the conclusion that the judgment ought on
this ground to be reversed, Chief Justice
Ryan truly remarks : "Doubtless the Cir
cuit Court can as it did in this case, charge
the jury to disregard all statements of fact
not in evidouco. But it is not so certain
that a jury will do bo. Without notes of
the evidouco, it may bo often diflicult for
juries to discriminate botween the state
ments of fact by counsel following tho
evidence and outside of it. It Is sufliciont
that the extra-professional statements of
counsel may gravely prejudice the jury
and affect the verdict." This reversal is
particularly noteworthy, and derives addi
tional interest from the fact that the plain
tiff's counsel is one of the most distin
guished member of the Wisconsiu bar.
Dealer in Dead Men.
Chicago, November 3. Tho Tribune's
dispatch from Keokuk says it has bcon
discovered that A. Mackey, of this city,
has been receiving bodies of recently buried
peoplo, graves have been robbed at Beacon,
la., and the bodies barrelled and shipped.
Two barrels were consigned to Mackey on
Thursday, but the railroad agent being
suspicious opened one and found the body
of John Ilyues, who had been recently
buried near Beacon. Mackey was arrested,
but declares that be is innocent. His
-assertion is discredited, asunder his direc
tions the first barrel was taken to tho
Medical College at Keokuk, where it still
letuaius. The college authorities disclaim
any knowledge of tho source from which
the barrel came.
A Strange Pair.
The wonderfully joined twin babies from
St. Benoir, Canada, who were exhibited iu
N. Y. city a few months ngo, bave been
critically examined in Philadelphia by Prof.
Pancoast. They are separato to the bips,
but bave only two legs in the aggregate.
The Siamese twins were a distinct pair, so
are the negro twius called Millie and Chris
tine, but the Professor says of the Cana
dian babies : "They have separate lungs
and hearts, the union beginiug at tho edge
of the ribs, and forming oommon digestive
and generative organs."
A Man Falls In a Vat of Boiling Sugar.
New York, November 4. This morning
Frederick Stelling, a workman in the sugar
refinery at tho foot of South Second street,
Williamsburg, was engaged in stirring up
boiling sugar in an immense vat, when,
losing bis balance, he fell into the seething
liquid, which bubbled up about bis nock.
The agonizing screams of the wretched
man for help brought men to his assistance
and be was taken out. He was removed
to the hospital, but be can scarcely survive
his fearful injuries.
tSTAsbury Park, N. Y., November 4.
At noon to-day two men in a wagon stop
ped at the half way house, Monmouth
county, and inquired for the road to Shark
River station. Soon after they had loft
their horse came buck dragging the over
turned wagon. A search was made for the
men and oneof them named Cook, of Long
Branch, was found half a mile from the
house, in the edge of the woods. He bad
been stabbed in the throat and was insen
sible. Ilia companion had lied aud a guu
which bad been sceu in the wagon was
missing. As there was no physician at the
Half Way house it was necessary to send
Cook, who was still unconscious, to Long
Branch for treatment, and search is being
made for his assailant.
