Said Section is hereby repealed. SECTION II: The Act of August 10, 1971, known as the Marietta Borough Zon- ing Ordinance of 1971, is hereby amended by adding the following section: SECTION 2202(1) - PROCEDURE Appeals to the Zoning Hearing Board may be taken by any person or Borough official aggrieved or affected by any provision of the Zoning Ordinance or by any decision, including any order to stop, cease and desist issued by the Zoning Officer. Such appeals shall be taken within a reasonable time as provided by the Municipalities Planning Code by filing with the Zoning Officer and with the Board a Notice of Appeal specifying the grounds thereof. Upon payment of the fees set out below, the Zoning Officer shall forth- with transmit to the Board all the papers constituting the record upon which the action appealed from was taken. The fee for all matters except an amend- ment to the Zoning Ordin- ance (including, but not limited to, requests for variances, special excep- tions, and appeals from | decisions of the Zoning Officer) shall be Twenty-five ($25.00) Dollars. However, the appealing party may be assessed with "all costs arising out of the presence of a person authorized to make a stenographic record of the proceedings before the Board. Any such costs for said person taking a stenographic record shall be approximated in advance by the Borough Secretary and said costs shall be paid in advance by the person making the appeal. SECTION III: The Act of August 10, 1971, known as the Marietta Zoning Ordin- ance of 1971, is hereby amended by repealing the last paragraph of Section 2101 of said Ordinance and adding a new paragraph to Section 2101 as follows: A fee of Forty (540.00) Dollars shall be paid upon the filing of such Petition for the purpose of defraying the costs of the proceedings thereon. In addition to said fee, the Petitioner.may be assessed with all costs arising out of the presence of a person authorized to make a stenographic record of the proceedings before the Board.
