NOTICE
ORDINANCE NO. 365
An ordinance amending ordinance No. 332 enacted June 8,
1970 regulating transient retail business within the borough
of Mount Joy; amending section 2 of said ordinance regar-
ding license requirements.
BE IT ORDAINED AND ENACTED by the Borough
Council of the Borough of Mount Joy, Lancaster County,
Pennsylvania, and it is hereby ordained and enacted as
follows:
Section 1. Section 2 of Ordinance No. 332, enacted June 8,
1970 is hereby amended to read as follows:
“Section 2.
(a) No person shall engage in any transient retail business
within the Borough of Mount Joy without first having ob-
tained a license from the Mayor in accordance with this
Ordinance.
(b) The fee for the license where required by this Or-
dinance shall be as follows:
1) Two ($2.00) dollars for one (1) day;
2) Five ($5.00) dollars for one (1) week or fraction thereof:
3) Ten ($10.00) dollars for one menth or fraction thereof;
or
4) Twenty-five ($25.00) dollars for one (1) year or fraction
thereof. A yearly license shall be valid only during the
calendar year in which it was issued.
(c) Where an association, partnership, firm, or corporation
desires to engage in transient retail business within the
Borough, it shall only have to obtain one license for em-
ployees of said association, partnership, firm, or cor-
poration, provided that:
1) A maximum of two (2) employees of said association,
partnership, firm, or corporation may engage in transient
retail business within the Borough per day;
2) All employees shall, prior to engaging in transient retail
business within the Borough, register with the Chief of Police
and shall give his name and address, the name of the
association, partnership, firm or corporation by whom he is
employed, and the type and license number of the vehicle to
be used, if any; and
3) Each employee shall carry a copy of said license upon
his person as provided in Section 4 of this Ordinance.
(d) The license fee provided for in this Ordinance shall not
apply to the following:
1) To farmers selling their own produce;
2) For the sale of goods, wares and merchandise, donated
by the owners thereof, where the proceeds are to be applied
to any charitable or philanthropic purpose;
3) To any manufacturer or producer in the sale of bread
and bakery products, meat and meat products, or milk and
milk products; or
4) Where, upon application the Mayor determines that a
person shall be working without compensation and selling
goods, wares or merchandise for the sole benefit of any non-
profit corporation.
All persons exempted from the payment of a license fee
shall be required to register with the Mayor and to obtain a
license without payment of a fee as provided in this Or-
dinance. Any person dealing in one or more of the
hereinabove-mentioned exempted categories who is selling
other goods, wares, or merchandise not so exempted shall be
subject to the payment of the license fee fixed by this Section
for his activity in connection with the sale of goods, wares or
merchandise not specifically exempted by this Section.”
Section 2. In other respects, Ordinance No. 332, enacted
June 8, 1970, shall remain the same.
Section 3. This Ordinance shall become effective im-
mediately.

County, Pennsylvania, vacating that portion of Ice Street
between Old Market Street and Alley “A”.
BE IT ORDAINED AND ENACTED by the Borough
Council of the Borough of Mount Joy, Lancaster County,
Pennsylvania, and it is hereby ordained and enacted by
authority of the same, as follows:
WHEREAS, Lancaster Leaf Tobacco Company, Inc., has
filed a Petition for the vacating of Ice Street between Old
Market Street and Alley “A” and is
WHEREAS, after due public hearing held on said Petition,
it has been determined by the Borough Council of the
_Borough of Mount . Joy that it would be in the best interest of
said Borough to vacate the aforesaid portion of Ice Street
between Old Market Street and Alley “A”:
NOW, THEREFORE, BE IT ORDAINED AND ENACTED
