ING A TAX FOR GENERAL
REVENUE PURPOSES ON
OCCUPATIONS ENGAGED
IN BY INDIVIDUALS FOR
THE PURPOSE OF ENGAG-
ING IN SAID OCCUPATION
WITHIN THE CORPORATE
LIMITS OF THE BOROUGH
OF MOUNT JOY AT THE
FLAT RATE OF TEN DOL-
LARS ($10.00) PER YEAR;
PROVIDING FOR ITS COL-
LECTION: IMPOSING ON
EMPLOYERS THE DUTY
OF COLLECTING SAID
TAX FROM EVERY INDI.
VIDUAL IN THEIR EM-
PLOY SUBJECT TO SAID
TAX AND REMITTING
AND PAYING OVER THE
SAME TO THE BOROUGH;
CONFERRING AND IMPOS-
ING POWERS AND DUTIES
OF ADMINISTRATION ON
A COLLECTOR; AND IM-
POSING PENALTIES FOR
SE VIOLATION THERE-
BE IT ORDAINED BY
THE COUNCIL. OF THE
BOROUGH OF MOUNT JOY
under the authority of the
Act of December 31, 1965, P.
L. 1257, known as “The 'Lo-
cal Tax Enabling Act”, as
amended, as follows:
SECTION 1, The follow-
ing words and phrases, when
used in this Ordinance, shall
have the meanings ascribed
to them in this section, ex-
cept where the context or
language clearly indicates or
requires a different meaning.
(a) “Borough” shall mean
the area within the corpor-
ate limits of the Borough of
Mount Joy.
(b) “Individual” shall mean
any person, male or female,
engaged in any occupation,
trade or profession within
the corporate limits of the
Borough of Mount Joy.
(¢) “Occupation” shall
mean any trade, profession,
business, or undertaking of
any type, kind or character,
including services, domestic
or other, carried on or per-
formed within the corporate
limjts of the Borough of
Mount Joy for which com-
pensation is charged or re-
ceived whether by means of
salary, wages, cemmissions
or fees for services rendered.
(dy “Employer” shall mean
an individual, partnership,
association, corporation, gov-
ernmental body, agency or
other entity employing one
or more persons on a salary,
wage, commission or other
compensation basis, includ-
ing a self-employed person.
(e) “Tax” shall mean the
Occupation Privilege Tax in
the amount of Ten Dollars
($10.00) levied by this Ordin-
ance,
(fy “He”. “His”, or “Him”
shall mean and jndicate the
singular -and piural number
as male, female and neuter
gender.
(g) “Collector” shall mean
the person or agency ap-
pointed from time to time
by the Borough Council to
assess and collect the tax im-
posed under, and to adminis-
ter the provisions of, this
ordinance,
SECTION 2. Beginning on
Janvary 1, 1970. the Borough
of Mount Jov hereby levies
and imposes on each occupa-

Tax in the amount of Ten
Dollars ($10.00) per annum,
said tex to be paid by the
individuz’s so engaged; pro-
vided, however, that all per-
sons deriving less than One
Thousand ($1,000.00) Dollars
per year from such occupa-
tion are hereby exempt from
such Occupation Privilege
Tax, and may secure a re-
fund at the end of the year
by filing claim therefor on
forms to be supplied by the
Borough. This tax is in addi-
tion to all other taxes of
any kind or nature hereto-
fore levied by the Borough
of Mount Joy and this Tax
shall continue in force on a
calendar year basis, without
annual re-enactment, unless
the rate of the tax is subse-
quently changed or this Or-._
dinance is repealed.
SECTION 3. Each employ-
er who engages in business
within the Borough of Mount
Joy is hereby charged with
the duty of collecting from
each of his employees en-
gaged by him and perform-
ing for him within the Bor-
ough of Mount Joy, the said
tax of Ten Dollars ($10.00)
per annum and making a re-
turn and payment thereof to
the Borough.
SECTION 4. Each employ-
er is hereby authorized to
deduct this tax from each
employee in his employ,
whether said employee is
paid by salary, wages, or
commission and whether or
not part or all such services
are performed within the
Borough.
SECTION 5. Each employ-
er shall prepare and file a
return showing a computa-
tion of the tax on forms
be supplied by the Borough.
Each employer in filing
this return and making pay-
ment of the tax withheld
from his employees shall be
entitled to retain a commis-
sion calculated at the rate
of two per centum (2%) of
the gross tax due and pay-
able, provided that such tax
is collected and pajd over
by the employer on or be-
fore the dates hereinafter
set forth. It is further pro-
vided that if the employer
fails to file said return and
pay said tax, whether or
not he makes collection
thereof from. the salary, wag-
es or commissions paid by
him to said employee, the
employer shall be responsible
for the payment of the tax
in full without deducting a
commission and as though
the tax had originally been
levied against him.
SECTION 6. Each employ-
er shall use his employment
records from the first day of
January to the 15th day of
May for determing the num-
ber of employees from whom
said tax shall be deducted
and paid over to the Treas-
urer on or before June 15.
Supplemental reports shall
be made by each employer
on August 15 and December
15 on new employees as re-
flected on his e™uvloyment
records from May 15 to A:
gust 15 and from Z2nvgust 15
Payments
on these supplemental re-
ports shall be made on Sep-
tember 15 and December 31,
respectively.
SECTION 7. Each individ-
val who shall have more
than one occupation within
the Borough shall be subject
to the payment of this tax
on his principal occupation
and his principal em-
ployer shall deduct
this tax and deliver to
Borough but who perform ser-

on a form to be furnished
to the employer by the Bor-
ough which form shall be
evidence of deductions hav-
ing been made and when
presented to any other em-
plover shall be authority for
such emplover to not deduct
this tax from the employees
wages, but to include such
emplovee on his return by

dress of the employer who
dednrted this tax.
SECTION 8. All self-em-
ployed individuals who per-
form services of any type or
kind, engage in anv occuna-
tion or profession within the
Borough shall be required to
comply with this Ordinance
and pay the tax to the Bor-
ongh on June 15 or as soon
thereafter as he engages in
an neeunation.
SECTION 9. All emn'avers
and self emploved individu-
alg residing or having their
nlace of business outside the
kind, engage in any occup:-
vices of any type or kind, or
engage in any occupation or
profession within the Bor-
ough do by virtue thereoof
agree to be bound by and
subject themselves to the
provisions, penalties and
regulations promulgated un-
der this Ordinance with the
same force and effect as
though they were r-sidents
of the Borough. Any individ-
ual engaged in an occupation
with the Borough and an em-
ployee of a non-resident em-
ployer, may, for the purpose
of this Ordinance, be consid-
ered a self-employed person
and in the event this tax is
not paid, the Borough shall
have the option of proceed-
Ing against either the em-
ployer or employee for the
collection of this tax as here-
inafter provided.
SECTION 10.
(a) It shall be the duty of
the collector of the Borough
of Mount Joy to accept and
receive payments of this tax
and to keep a record thereof
showing the amount received
by him from each employer
or self-employed person ‘to-
gether with the date the tax
was received.
(b) The collector is hereby
charged with the administra-
tion and enforcement of this
Ordinance and is hereby
charged and empowered to
prescribe, adopt, promulgate
rules and regulations relat-
Ing to any matter pertain-
ing to the administration
and enforcement of this Or-
dinance including provisions
for the examination of the
payroll records of any em-
ployer subject to this Ordin-
ance, the examination and
correction of any return
made in compliance with
this Ordinance and any pay-
ment alleged or found to be
Incorrect, or as to which
overpayment is claimed or
found to have occurred. Any
person aggrieved by any de-
cision of the collector shall
have the right to appeal to
the Court of Common Pleas
of Lancaster County as in
other cases provided.
(¢c) The collector or his
duly authorized representa-
tive or agent is hereby auth-
orized to examine the books
and payroll records of any
employer in order to verify
the accuracy of any return
made by an employer, or, if
no return was made to as-
certain the tax due. Each
employed is hereby directed
and required to give the col-
lector or his duly authorized
representative or agent the
means, facilities and oppor-
tunity for such examina-
tions.
SECTION 11.
(a) In the event that any
tax under this Ordinance re-
mains due or unpaid thirty
(30) days after the due dates
above set forth, the Borough
may sue for the recovery of
any such tax due or unpaid
under this Ordinance togeth-
er with interest and penalty.
(b) If for any reason the
tax is not paid when due,
interest at the rate of six
per cent (6%) on the amount
cf raid tax shall be calculat-
ed beginning with the due
d=te of said tax and a penal-
iy of five per cent (5%)

7° ni thereof. Where suit is
brought for the recovery of
this tax, the individual liable
therefor shall in addition, be
responsible and liable for
the costs of collection.
SECTION 12. Whoever
make any false or untrue
statement on any of his
books, records or accounts
in his custody and control
setting forth the number of
employees subject to this
tax who are in his employ-
ment, or, whoever fails or
refuses to file any return re-
dguired by this Ordinance,
shall upon conviction before
any Alderman, Magistrate,
or Justice of the Peace, be
sentenced to pay a fine of
not more than Three Hund-
red Dollars ($300.00) for each
offense and in default of pay-
ment of said fine and costs
be imprisoned in Lancaster
County Prison for a period
not exceeding ninety (90)
days for each offense. It is
further provided that the ac-
tion to enforce the fine and
penalty herein provided may
be instituted against any per-
son in charge of the business
of any employer who has
failed or refuses to file a re-
turn required by this Ordin-
ance.
SECTION 13. The provis-
ions of this Ordinance are
severable and if any of iis
provisions shall be held in-
valid or unconstitutional,
such decisions not affert or
