PENALTIES 12.1 Any person who shall violate any provision of this Ordinance, or any provision of any rule or regulation ad- opted by the Housing Con- mittee pursuant to authority granted by this Ordinance, shall upon conviction be punished by a fine of not less thon Ten ($10.00) Dol- lars nor more than Fifty ($50.00) Dollads,, or by im- prisonment for not less than five (5) days nor more than thirty (30) days; and each day’s failure to comply with any such . provision shall constitute a separate violo- tion. SECTION 13. CONFLICT OF ORDINANCES; EFFECT OF PARTIAL INVALIDITY 13.1 In any case where a provision of this Ordinance is found to be in conilict with a provision of any zon- ing building, fire, safety or health ordinance or code of this Borough of Marietta ex- isting on tne effective date of this Ordinance, tiie pro- vision which establishes the higher standard for the pro- motion and protection of the health and safety of the peo- ple shall prevail. In any case Where a provision of this Ordinance is found to be in conflict with a provis- ion of any other ordinance or code of this Borough of Marietta existing on the ef- fective dey2 of this Ordin ance whic-hh establishes a lower standard for the pro- motion and protection of the health and safety of the peo- ple, the provisions of this Ordinance shall be. deemed to prevail, and such other ordinances or codes are hereby declared to be re- pealed to the extent that PAGE SEVEN they may be found in flict with this Ordinance, 13.2 If any section sub- section, paragraph, sentence, clause or phrase of this Or- dinance should be declared invalid for any reason what- soever, such decision shall not affect the remaining por- tions of this Ordinance, which shall remain in full force and effect: and to this end the provisions of this Ordinance are hereby declar- ed to be severable. 13.3 Ordinance No. 245 en- acted October 1, 1957, is hereby repealed. : SECTION 14.
