AS FOLLOWS: : Whereas Orchard Road is now a public street of the Borough of Mount Joy of a width of 33 feet, and extends from the northern side of the Harrisburg Pike (Legisla- tive Route 129, Penna. Stale Route 230) northwardly to the northern boundry line of the Borough. By various acts of dedication, the owners of all of the property abutting on the said Orchard Road, 33 feet wide, have from time to t'me dedicated for use of the street, additional lands aggre- gating, with said existing 33 feet wide right-of-way 66 feet in width, but neither the Borough nor the Township of which the street was former- ly a part, has accepted or op- ened the additional width, or any part thereof. And whereas all of the owners of all of the proper- ties abutting on said Orchard Road have petitioned the Borough Council /to accept and open said Orchard Road to a width of 50 feet, in ac- cordance with the survey thereof prepared by H. F. Huth Engineers, Inc., Lancas- ter, Pa. and designated by said engineers as ‘Plain and Profile of Orchard Road — Borough of Mount Joy,” dat- ed April 14, 1967, Drawing No. MJ 37. By said petition, the said abutting owners have releas.- ed the Borough from ali claims for damages of any kind, arising out of the ac- ceptance and opening of the said street to a width of 50 feet, and from the grading, draining, or other improve- ment of the said street in ac- cordance with the lines and grades of the said survey.
