All sidewalks, curbs and gutters hereafter con- [structed or reconstructed on any |street or alley of the Borough | (whether constructed voluntar- |ily or upon direction of Coun- |eil under this ordinance) shall conform to the grades and spec- |ifications provided in this ordi- nance, and any construction or [reconsty uction that fails to com- {ply therewith shall be a viola- tion of this ordinance and shall {be removed and reconstructed upon direction of Council. SECTION 5. Sidewalks shall be constructed of concrete or hard brick on properly drained and compacted base. Concrete shall be not less than six inches |thick. Sidewalks shall be not less than seven feet in width, | measured from the inside of the curb; but, unless directed other- | wise by resolution of Council, [there may be a grass plot not |over three feet wide immediate- ly inside the curb, leaving a | minimum of four feet to be pav- | ed. SECTION 6. Curbs and gut- [ters shall be constructed of con- [erete. Curbs shall be not less [than six inches thick and shall [extend not less than 24 inches |below the surface of the cart- (way when in soft soil and not (less thas 18 inches in rock or (hard soil. The Street committee lof Council, or its representa- (tive, shall determine the soil [condition and prescribe the re- |quired depth. Gutters shall be two feet in width. SECTION 7. | permit or direct variation of [any of the dimensions herein | prescribed for sidewalks, curbs or gutters in particular cases where Council shall deem it de- |sirable and justified to do so. SECTION 8. All sidewalks, |eurbs and gutters shall be con- structed at grades to be given [and staked out by the Borough surveyor or engineer, or other | representative authorized by { Council, upon application of the Council may [owner to the Street committee. SECTION 9. If any owner {shall fail to construct, recon- or repair a sidewalk, gutter in accordonce notice given hereunder, the Street committee, after ten lays’ notice to the owner of in- tention so to do, may cause the work to be done at the expense nf the owner, and the Borough imay collect the cost thereof plus ten percent and all charges, costs and expenses from the {owner by such remedy or reme- dies as may be available, inclu- ding filing of municipal lien. SECTION 10. Where a nuis- ance results from the condition of a sidewalk, curb or gutter to 'such extent that, in the judg- ment of the Street committee, it constitute an imminent danger of injury to persons or property, [struct curb or with the Street committee may take immediate measures to prevent such injury and abate the nuis- ance without notice, or on shorter notice than herein oth- erwise required, and may col- lect the cost thereof in the same manner and to the same extent as in other cases of the abate- ment of nuisances SECTION 11. Any person and officer of a corporation who shall violate any ordinance, upon provision of this conviction thereof before any justice of the peace or alderman, shall be sen- tenced ‘to pay a fine of not less than -25.00 nor more than $50- 00; and in default of payment chall be sentenced to undergo impiisonment for not more than y days If, after a person has been convicted of a violation of thie ordinance he shall not, within five days perform the duty which he was convicted of failing to perform, or shall not remedy and cure a conditionor nuisance which he was convict ed of causing or permitting to exist, then every day thereafter on which said duty remains un- performed, or on which such condition continues to exist, shall be : parate violation of this ordinance and may be pros ccuted as such SECTION 12. The rights and remedies of the Borough as pre- scribed by thi ordinance or otherwise by law with respect to sidewalks, curbs and gutters and the eriminal sanctions here- in provided shall be cumulative, and the pursuit of any one shall in in no way preclude simultan cous or subsequent pursuit of another SECTION 13 If any provis ion of this ordinance, or the ap plication thereof to any person or circumstances, is held inval- id, the remainder of the ordin ance and the application of such provision to other persons or circumstances shall not be af- fected thereby, and to this end the provisions of this ordinance re declared to be severable SECTION 14 The following are hereby repealed: (1) An ordinance approved February 3, 1879, entitled “An ordinance for the better govern ment respecting pavements in the Borough of Mount Joy”, and all amendments thereof. (2) An ordinance approved January 2, 1923 An ordinance regulating the width and curbs and gutters on the streets in the Borough of Mount Joy,” ete., and (3) ‘All other ordinances and parts of ordinances inconsistent here- with ORDAINED by Council, Ap- ril 12, 1954 L.
