Marlin D. S'nerar, (erected many
years ago) which stands on a lot
at the southwest corner of East
Nonega! Street and South Barbara
| Street. The north side of the Sine-
gar house is about 69 feet from the
middle of Frst Doneaal Street, and
| about 46 feet from the front street
line of East Donegal Street. The
| side of the Sinegar house is
| cloce to South Barbara street,
| The anpellant argues that the
1 Sinegar house “fronts” on East
| Donegal Street, If thot is so, then
it is apoarent that Fstock's house
| violates the requiremenis stated in
| (a) above. Fstock contends that the
Sinegar house fronts on Barbara
Street, and there being no other
house within 100 feet of the Estock
| he use, the reauirements stated in
[ (b) above apply. It this is so, the
| Fstock house conforms.
| The Zoning Officer decided that
the Sinegar house fronts on Barba=
ira Street, and accordingly he is-
{ cued the permit,
We cannot accept that decision.
From the testimony produged at
the hearing, and frem our personal
| inspection of the Sinegar house,
we are agreed that it fronts on
Fast Donegal Street and not on
Barbara Street.
| The Sinegar house is a two-story
| and attic dwelling. Its gable ends
are to the east (on Barbara Street)
{and west (toward the Estock
erty). The main doorway into the
house is on the north side facing
Fast Donegal Street. This doorway
rvens on to a large covered porch.

In this case we fail to find any
special ronditions which were not
caused bv Estock’s own wilful
cenducet. He save he thought and
was told, that the lot was in a
Cemmercia] district, where no set-
back is required. But he was cor-
rectly advised on this point in July
hy the Zoning officer. Nevertheless,
in Ausust, he began ad proceed-
ed with construction ef the build-
ing without a zening rermit, and
in defiance of the ordinance. At
that time ie did not have side or
rear yard space to meet the re-
auirements of the ordinance. After
he was served with notice to cease
construction without a permit, he
bought a”ditional side and rear
| space and proceded with con-
struction before the present per-
mit granted, and with full
Jnowledge that his set-back loca-
| tion wae being challenged. If Es-
tock finds himself with a partially
completed building which violates
the ordinance it is solely because
of his own wilfu] conduct. Such a
circumstance, so created, is not a
special condition which we are in-
tended to alleviate by granting a
variances from the requirements of
the ordinance.
