Miss Viola Horner of Reading, spent a
week with her aunt, Mrs. Aaron Groff and

OPERATE MOTOR CARS THEREON.
Section 1— Be it enacted by the Burgess
and Town Coancil of the Borough of Mount
Joy, Lancaster County, Pennsylvania, and
it is hereby enacted by the authority of the
same, that the Rohrerstown, Landisville
and Mount Joy Street Railway Company
is hereby granted permission to build an
electric railway with single track, with the
necessary curves, switches and turnouts in
said Borough of Mount Joy, beginning at a
point in the eastern line of said borough,
thence on and along property and rights of
way of said company purchased from Simon
Snyder, Nathan Stark and Maria Hoffman
in said borough, thence north on
and along said Barbara Street
to the southern terminus of Barbara street
to East Dcnegal street; thence on East Don-
egal street to Columbia avenue; thence on
Columbia avenue to Delta street, thence
North on Delta street to Marietta street;
thence west on Marietta street to the iuter-
section of West Donegal street; thence west
on West Donegal street to the western lim-
its of said borough, with the privilege of
erecting such poles and stringing wires
thereon as may be necessary to operate said
railway and to run cars thereon propelled
by electricity. All switches and turnouts
shall be placed at such points as the Town
Council of the Borough of Mt, Joy may ap-
prove.
Section 2, The uniform guage of said
track shall be five feet, two and one-half
inches (5 ft., 21¢ inches) and the rails shall
be of the kind known as flat rails, on the
streets of the borough and shall be so laid
as to conform with the established grade of
the borough. The space between said rails
and for a distance of thirty (30) inches out-
side of each rail shall be macadamized or
paved with stone or such other material as
Council may from time to time use on the
other adjoining portions of the street, and
shall be kept filled even with the top of the
rails. If the said Railway Company shall
neglect or refuse to keep said portion of
said street so paved or macadamized after
thirty days’ notice in writing, then the Bor-
ough of Mt. Joy may do it, and collect the
cost thereof from the said Railway Com-
pany.
Section 3. For the purpose of introduc-
ing electricity as a motive power, the Rohr-
erstown, Laudisville and Mt. Joy Street
Railway Company shall have the right to
erect and maintain poles on both sides of
the streets, property and rights of way along
the route of said railway at such points as
the engineer in charge of the construction
of sail street railway and the Town Coun-
cil of the Borough of Mt. Joy may direct,
and to connect the poles on opposite sides
of the said streets, property and rights of
way so as to carry the wires which conduct
the electric current to the cars: Provided,
that the said wires shall be maintained at
a height of not less than eighteen (18) feet
above the established grade of the street;
and that the poles of the said Railway
Company shall be wood, octagonal, uniform
in size and heighth, and shall be painted a
color approved by the said Council, when-
ever deemed necessary by said borough.
And, provided further, that the Borough of
Mt. Joy shall have the right to use said
poles to support and convey such wires as
may be owned and operated by the Bor-
ough of Mt. Joy, said borough wires to be
erected so as not to interfere with the oper-
ation of said railway.
Section 4. That the said Railway Com-
pany shall be required to run their cars at
intervals of not over sixty minutes during
the business hours between Mt, Joy and
Lancaster and that the rate of speed shall
not exceed eight miles per hour within the
limits of said borough. And, provided
further, that the said Railway Company
shall not collect more than five cents (5¢)
fare from its passengers for a continuous
ride within the limits of the said borough,
and that the cars shall stop at all street cor-
ners to take on and let off passengers. .
Section 5. Said Railway Company shall
not place any turnouts at the intersection
of any streets or highways; and, provided
further, that whenever in the construction
and repair of its lines, the said Railway
Company shall dig up the surface of the
street, said street shall be properly repaired
and restored by the said Railway Company
in the same condition as it was prior to
such digging; and where poles are placed
on sidewalks, said sidewalks to be properly
repaired with the same material as origin-
ally constructed. In default thereof, the
said borough, after due notice, shall make
such repairs at the cost of said Railway
Company. And, provided fursher, that the
rights and privileges granted to the Rail-
way Company by this ordinance shall not
interfere with*the rights of the borough to
have access to the water supply mains of the
borough laid on said streets. And, provided
further, the said Railway Company shall re-
move the snow placed on said streets by the
Company, taken from between the tracks of
the railway by the use of the sweeper or
shoyel twenty-four (24) hoursafter the snow
has ceased to fall.
Section 6. No cars within the borough
limits shallbe allowed to stand on the track
longer than one hourat any one time.
Section 7. The Borough of Mt. Joy re-
serves the right to grant franchises to rail-
waysorother companies or corporations to
cross the tracks of said Railway Company
either at grade or otherwise,
Section8, The Rohrerstown, Landisville
and Mt. Joy Street Railway Company shall
build and operate said railway between
Lancaster and Mount Joy to the western
limits” of the borough within six months
from the passage of this ordinance and shall
pay all expenses incurred by said borough
in printirg all ordinances granting fran-
chises tosaid Company. A failure to com-
ply with any of the provisions of this sec-
tion within the time specified, shall be a
forfeiture of all rightsand privileges herein
conferred.
Section 9. The said Railway Company,
in consideration of the franchise hereby
granted, shall pay tothe Burgessof the Bor-
ough of Mt, Joy, annually, the sum of fifry
(60¢) on eachand every pole which may be
erected and maintained by them within the
borough limits, and five ($5.00) dollars for
cach and every car which they may regular-
ly use in the daily operation of their road.
Section 10. The said Railway Company
shall indemnify and keep harmless the Bor-
ough of Mt. Joy from any damage that may
be done to persons and property by reason of
the construction and operation of their said
railway
Section1l, That for each and every yio-
lation of any of the conditions of this ordi-
nance and for any refusal tocomply withany
of said provisions, after due notice to that ef-
fect by said Borough Council, said Railway
Company shall be liable to a penalty of ten
($10.00) dollars, and for any continued vio-
lation of any of the provisions thercof, after
due notice of the said Borough Jouneil, the
penalty shall be five ($5 00) dollars for each
and every day the violation continues.
Section 12, After the passage and ap-
proval® of this ordinance, all former ordi-
nances granted the Rohrerstown, Landis-
ville and Mt, Joy Street Railway Company
are hereby repealed.
Seetion 18, Thesaid Rohrestown, Landis-
ville and Mt, Joy Street Railway Company
shall not be considered as having accepted
this ordinance and shall not acquire any
rights under it, until itshall by resolution of
its Board of Directors enter an acceptance
of the same on its minutes, and shall file a
duly certified copy of such minutes over its
corporate seal with the Mt. Joy Borough
Jouncil within fifteen days after it has
been duly enacted,

seventh day of June A, D, 1006,
