The at trocity of the circum- stances cunnectvd with this case, and the brutality of the uta attracted much 'attention at the time, and caused great excitement in Ma piAte. from the LAM:aster Inquirer the following report of the trial : The Court apprised the prisoner of his right of challenge to all jurors that Might be called, against whom he might entertain rears that a biased judgment or prejudice might prevent a fair ver dict. In the empanelling of a jury, the whole list was exhausted, and a special venire was issued for 20 additional ju rors, before a petit jury for the trial of the case was obtained. The prisoner challenged sixteen peremptorily and ten were challenged for cause. The District Attorney, in summing up the case, stated that the murdered man kept a lager beer saloon in Marietta, and that McCulley was seen near the house at 12 o'clock in the night when the murder was committed. The body 'of the deceased was horribly mutilated with a hatchet. On the counter were two glasses, one of, which contained the dregs of lager beer and the other, ,the drew) of a peculiar kind of bitters Brady always drank. The mark of a gum shoe was seen on the door. On,the morning after the murder, the prisoner went to Efousears tavern, and washed his hands and shirt sleeves, but instead of going to the towel to dry himself, he went to a dark colored house cloth. Be after wards went to Lebanon, where he changed his clothing, which was. recov ered. He there had on a gum shoe, iikiCh he concealed.
