FISHERY MELTING : The meeting spok en of in our last, was held in the public school house in Bainbridge, when Mr. Emanuel Nagle was again called to the -chair. The •chair then, by request, read the following written opinion of two leading members of the Lancaster Bar: OPINION Having been requested to give an •opinion in writing, as to whether the Susquehanna Canal Company have the legal right to maintain their dam as at _present constructed at Columbia, Lan caster County, especially with reference to said dam obstructing tire passage of fish, and as to the remedy if any against the Company, by citizens of the Com monwealth aggrieved. We give briefly the following opinion: First. We are of the opinion that the right to fish in the great navigable •river of Pennsylvania, is a right, com mon to all citizens of the Commonwealth, •and with it the right to have the fish to pass freely through the waten of such rivers, and such passage cannot be ob structed and stopped except by express enactment of the Legislature, Second : if at Common Law a right 'to obstruct the passage of fish were doubtful, early legislative enactments in Pennsylvania hare prohibfted all such .obstructions. third: The suppliment to the charter of the Susquehanna Canal Company, authorizing the construction of a dam At Columbia, expressly provides that the same shall not impede the ascent of lish, and requires such darn to be of.a given height and sloped "so as to pro mote the,passage of lish;" a subsequent enactment of the Legislature, further provides for the construction of said dam so as to promote the passage of ilsh. Any dam constructed in a manner essentially different from that authorized by law, and placed in the Susquehanna river, would, in our opinion, constitute nuisance, and as this dam is noto riously constructed, as you state to us. in violation of the terms and provisions of the charter of the Coniptiny, and the several acts of Assembly relating there- to, such dam is a common nuisance.— 't'he Company cannot plead a Legislu tire license, for the license does nut authorize such a darn us they have con structed, but a structure of a different character, preserving the valuable com mon rights of navigation and fishing.— Nor can the Company avail themselves .of any advantage from the lapse of time, for the nuisance continues, and no one can acquire the right to maintain a pub lic rinisanee, and the length of time the same exists doily aggravates the oGiene. TERRIBLE OCCURRENCE.--From th e New South, dated Port Royal, S. C„ March 25, 1862, a "Yankee" newspaper just started in South Carolina, we copy the following item : "An unfortunate circumstance oc curred yesterday morning at Otter Island. Two small parties of the Forty fifth Pennsylvania Regiment, went out to surround a number of Rebels sup posed to be lurking in the vicinity. They were led along different routes by negro guides. but the guides were stupid, and in the grey of morning the two de tachments came upon each other,"when one party fired. Two were killed on the spot—Capt.E.Y.Rambo, formerly of Coatesville, Chester county, Pa., and a corporal whose name we have not yet been able to learn. Two were severely wounded in the lungs, and are unlikely to recover, and several others are not likely to recover." Capt. Rambo resided at Colombia, this county, when the war broke out, and was Captain of a company in the three months' service, in the Regiment of which Cal. Welsh, of that place, was Lieut. Col. At the expiration- of his term of service, he recruited a company and joined the Regiment of Col. Welsh, which is now in Gen. Sherman's com mand in the South. His death is deeply lamented by a large circle of friends.— Several members of the company were wounded on the occasion referred to, among others Sergt. Wearm, and pri vates Wagner and Vacbe, of Columbia. Hopes are entertained that they will recover.—Lancuster Ecpress. TILE APPOINTMENT OF CADETS:—IIon. Thaddeus Stevens, representative in Congress from this district, has appoint ed Hon.A.L. Hayes, of Lancaster, Prof. J. P. Wickershaul, Principal of the State Normal School at Millersville, and David Evens, Esq., Superintendent of Common Schools in Lancaster county, a committee to examine candidates for admission into the United States Naval and Military Academies, in accordance with the regulations detailed in the following letter from Mr. Stevens : WASIIINOTON, March 24, .1.862. To my Constituent:: : There am vacan cies in the, Military Academy of the United States ut West Point, and the Naval Academy. The Member of Con gress from the District has the nomina tion. 1 have received a large number of applications from highly respectable peistins for each of the places. Many of them come from very ititiu ate and valued friends ; others from persons equally respectable, but less known to me. It seeing to me that, as all are equally my constituents, the choice ought to be guided by merit rather than personal friendship. if I should make an arbitrary selection, I might be charg ed, perhaps justly, with an improper partiality. 1 have therefore determined to invite all the candidates to undergo an examination by three learned and respectable gentlemen ; the two certi fied by them as the best qualified for the places will receive the appointments. That all may be sure of a fait' trial, I have addressed a letter to those gentle men of which the following is an extract: "I desire you carefully and impartially to examine all the candidates who may present themselves (if resident in the 9th Congressional District) for either the ilitary or Naval School, and certify to me the one best qualified for each place. While their pecuniary condition should not influence your action, yet if two should happen to be of equal merit and the one has rich and the other poor parents. I desire that the preference should be given to the poor man's son." Judge Dayes will give public notice of the time and place of examination, which I request all the newspapers in the county to publish. THADDEUS STEVENS The gentlemen selected are throughly qualified for the discharge of the duty assigned them, and we have no doubt that the examination will not only be thorough but the final judgment impar tial and satisfactory. The request of Mr. Stevens that, where two candidates may happen to have equal qualifications,' the preference shall be given to the poor man's son, is eminently proper and will sat at rest certain idle rumors to the effect that a particular candidate was to be favored in the proposed examinatioo. From a circular issued by the Secre tary of the Navy, we learn that candi dates for admission to the Naval Amide= my, "must he over fourteen and under eighteen years of age at the time of the examination for admission Onus% be free from deformity and disease and imper fections of the senses. They must be of good moral character, able to read and write well—writing from dictation „and spelling with correctness, and. to .per form with accuracy the various epera tions of the primary rules of arithin`ptic, viz: numeration, and the addition, sub stractiOn, multiplibation, and division of whole numbers," When a candidate has been regularly nominated by a menhber of Congress, he.Will;'receive a permit to present himself at the Acad emy for examination as to his mental and physical qualifications. In pursuance of the above, the Exam iners have arranged to meet the candi dates for examination on Friday, the 4th of April, in the Orphans Court Room, Lancaster, as will be seen by the following NOTICE.—The examiners of the candidates for nomination by the lion. As this may be the only opportunity of hearing . the talented young lecturer, none should fail to be present. A PRAISEWORTH Y A CT.-Th e County Commissioners have appropriated an additional ten thousand dollars to meet the necessities of the families of our brave volunteers, who have given them selves to their country for the purpose of upholding the Constitution and Laws. So well have the finances of the county been managed that the large sums con tributed for this most noble object, amounting to forty thousand dollars, has been done without requiring any addition to the county taxation. The following is the resolution passed by the Board of Relief on Monday week : Resolved,' That tor the next three weeks, in consideration of the distress of the families of volunteers entitled to relief, by reason of the delay in payment of the volunteers by the United States and the severity of the weather, the Board of Relief will award allowances, as for merly, each and every week to the re cipients. NW Many persons indulge in the hab it of mutilating and tearing down hand. bills at stores, hotels and other public places, greatly to the deteriment of those who pay for the printing and posting these bills; perhaps they are not aware they are violating the law by so doing and renderini themselves liable to a fine and costs. They should be cautious or they may find it an expensive indulgence. On Wednesday morning we printed a lot of bills for the Presbyterian Sabbath School Festival and by evening we ob served quite a number defaced and torn down.
