servation specialist with the
conservation district office, said
he responded to the site after
receiving calls from residents.
In addition to not having
filed an Erosion and Sediment
Plan, the report detailed three
other specific violations of the
law which hinged on the first.
Cited were: failure to have an
erosion plan on site, failure to
implement best management
practices and failure to prevent
sediment or other pollutant dis-
charge into waters of the com-
monwealth.
According to the report,
Dombroski also violated the
Clean Streams Law by clearing
trees to the banks of the nearby
stream. The law requires a min-
imum of a 50-foot “filter strip”
or buffer zone.
According to Moss, failure to
implement “Best Management
Practices” at the site, puts the
stream in danger of being pol-
luted by erosion and sedimenta-
tion.
Moss said sediment flows
into the stream could have been
prevented by any number of
measures which should have
been predefined and approved
by his office.
“Even though its a small un-
named tributary, it’s still a wa-
ter of the commonwealth,” said
Moss.
Moss said fines are not appli-
cable at this point. “The goal is
to gain voluntary compliance.
Next time out we want to see
some changes,” he said.
Moss said Dombroski is re-
quired to stop any work at the
site that may cause “earth dis-
turbance” until an Erosion and
Sediment Control Plan is devel-
oped and approved.
In addition, the property is to
be stabilized immediately by
seeding and mulching.
Moss said when asked about
the violations, the developer
said he thought he was well
within his rights, that he had
contacted the township prior to
cutting and that no mention of
such plans were referenced by
that office.
“I wouldn't say it was willful-
ly negligent (on the part of
Dombroski); however, it does-
n’t change the outcome.”

Joseph R. Mazzoni, CPA, was elected president of the North-
eastern Chapter of the Pennsylvania Institute of Certified Public
