Disorderly conduct and resisting
arrest charges sent to county
Multiple charges of disorderly
conduct, resisting arrest, crimi-
nal mischief and harrassment
against Robert Smith, 33, of RR 2
Harveys Lake were bound over to
Luzerne County Criminal Court
after a preliminary hearing Feb.
15 before District Justice James
Tupper.
The charges stemmed from an
incident Aug. 3, in which Smith
scuffled with police while they
were serving a protection from
abuse order issued by Tupper and
attempting to arraign him. Smith
was incarcerated in the Wyoming
County Prison at the time.
While being transported from
the prison in Tunkhannock to
Tupper's office for arraignment,
Smith thrashed about in the back
seat of the cruiser and kicked
under the driver's seat.
DRUG, ALCOHOL
CHARGES MOVE AHEAD
Harveys Lake resident Michael
Musial, 19, waived his right to a
preliminary hearing on charges of
‘D.U.I. and possession of a con-
trolled substance Feb. 15 before
District Justice James Tupper.
. He was also cited for driving
without rear lights.

age drinking party observed
Musial driving erratically on Route
415 at Keefer Plot.
* During a routine body search
olice found a marijuana leaf and
plant seeds, $308.30 in cash and
acigarette lighter in Musial's pants
pocket. A search of Musial's car
turned up eight unopened cans of
beer, six opened cans, the re-
‘mains of a partially-smoked ob-
jectresembling a hand-rolled ciga-
rette and a pack of cigarette roll-
ing papers.
CRIMINAL TRESPASS
CHARGE REFILED
AGAINST BORO MAN
Dallas resident Jason Bealla,
23, waived his right to a prelimi-
‘nary hearing on a charge of crimi-
nal trespass Feb. 15 before Dis-
trict Justice James Tupper.
. Related charges of trespass and
burglary were dismissed, accord-
ing to court records. The charges
' had originally been filed, but dis-
‘missed Feb. 1 because the victim
- had left the magistrate's office
‘before the hearing.

who put him in a leg restraint.
After being arraigned, he refused
to stand up when police told him
to, forcing them to carry him,
thrashing and screaming, from

When police attempted to put
him in the cruiser, Smith sud-
denly stood up and fell against
the rear side panel, taking two
officers with him. The panel was
damaged from the impact. Two
officers picked him up and placed
him in the cruiser.
Smith waived his right to coun-
sel and is incarcerated in the
Luzerne County Prison in default
of $5,000 bail.

Nichol after a short foot chase and
found Bealla hiding in a garage on
Columbia Ave. five minutes later.
The owner of the home told
police she found clothing spread
through her home but was unable
to tell them whether or not any-
thing was missing. She also found
that $568.04 in overseas tele-
phone calls to British Guyana had
been made [rom her telephone
between 8:13 a.m and 1:41 p.m.

lice apprehended Bealla and
Nichol.
Charges of burglary and crimi-
nal trespass against Nichol were
dismissed.
Represented by attorney
Demetrius Fannick, Bealla is
lodged in the Luzerne County
Prison in default of $5,000 bail.
D.U.I. CHARGE SENT TO
COUNTY COURT
Wilkes-Barre resident Charles
McElwee, 32, waived his right toa
preliminary hearing on charges of
D.U.L. and a citation for careless
driving Feb. 15 before District
Justice James Tupper.
The charges resulted from an
incident Oct. 29, in which Dallas
Borough patrolman William Norris
arrested him after observing him
driving at a high rate of speed on
Huntsville Road, nearly crashing
into the guide rails at the curve at
Reservoir Road.
After failing field sobriety tests,
he took a blood test which indi-
cated his blood alcohol level to be
.161. The legal limit is .10.
He is [ree on $300 bail.

of police James Balavage. Maransky, 25, is a graduate of the
Northeast State Police Training Center and has also studied at
Luzerne County Community College. Before coming to Kingston
Township, Maransky served at Ross and Lehman townships and
Dallas Borough.

Township moves ahead
to explore new building

KINGSTON TOWNSHIP - The
supervisors moved one step closer
to making a final decision on con-
struction ofanew municipal build-
ing by appointing a special attor-
ney and engineering firm at their
regular February 14 meeting.
Attorney Steven Killian and
Michael J. Pasonick Engineering
were appointed to represent the
township when it applies for a
conditional use permit for the site
on East. Center Streetl in
Shavertown.
Located next to the Kingston
Township ambulance building
and opposite the township park,
the property is owned by the town-
ship and is zoned residential, ac-
cording to manager Jeff Box.
“Under our ordinance, public
buildings are allowed in any zone
with a conditional use permit,”
Box said after the meeting. “We
need an independent attorney and
engineering firm to represent us
to avoid a conflict of interest. We
must obey our own ordinances
and can't have our solicitor and
engineer reviewing their own
work.”
Attorney Ben R. Jones, III, is
the township solicitor, while
Borton and Lawson is the
township's regular engineering
firm.
The supervisors haven't made
a final decision on whether or not
to build a new township building,
although Box said the plan is “still
under serious consideration.” Ar-
chitects are continuing to revise
design plans and make sure the
site is acceptable for construc-
tion, he added.
In other business, the supervi-
sors unanimously voted to spend
approximately $7,000 to remove
debris accumulated in the creek
bed along Harris Hill Road at the
former Schooley Farm and below
Echo Valley Trailer Park. The de-
bris was deposited in the creek
during the January flood and is
interfering with drainage.
The supervisors accepted four
bids for a 1996 one-ton four-wheel
drive dump truck, to replace its
1990 GMC dump truck, and tabled
them for consideration. The ap-
parent low bidder was Sherwood
Chevrolet, at $34,188 without -a
trade-in or $22,288 with a tradle-
in. :
Other bidders were Fairway
Chevrolet, at $36,203.92 without
trade or $25,703.92 with trade;
Bradco Supply, at $36,860 with-
out trade and $24,500 with trade,
and Motors Fleet Management
from Red Bank, NJ, at $43,316
without trade and $34,316 with
trade-in.
The supervisors also authorized
Box to advertise for bids and pre-
pare for the annual spring
cleanup, tentatively planned for
May 6-11, and to advertise. for
bids to sell the 1992 Caprice po-
lice cruiser for a minimum .of
$2,000. :
