enactment of an Resolution
adopting the earned income and
profit tax reguiatiu1s
promulgated by Berkheimce
Associates, a division of H.H.
Berkheimer, Inc. as the earned
income and profit tax regulations
for the Borough of Nuangofa. The
regulations shall provide a
definition of taxable income as
including inter alia all salaries,
wages, commissions, bonuses,
tips, stipends, fees, incentive
payments, drawing accounts,
benefits, royalties, and sick-pay;
and a definition of non-taxable
income as including Social
Security benefits, unemployment:
compensation, pensions, public
assistance, death benefits, gifts,
interest, dividends, board and
lodging for a convenience of
employer, lottery winnings,
supplementary employment
benefits, capital gains, sick or
disability benefits, and active
military service and summer
encampment pay. The regulations
further provide the criteria for.
deductions or exemptions for thg
following: home office expense;
expenses of oufside salesmen;
expenses for construction workers
and truck drivers; and self-
employment loss. The regulations
also provide that the following are
personal expenses and are
disallowed for deduction pur-
poses: dues to unions - or
professional societies; uniform
and work clothing; tuition fees,
educational expenses to achieve
certification or improve earning
ability; employment fees and
moving expenses. The regulations
also shall provide that no
deductions will be taken for
contributions to Keogh, |I.R.A., or
tax shelter annuity accounts. The
regulations also require that joint
returns may not be filed and every
person when requested fo do so
must file a final return even if he
had no earnings, if all tax was
withheld, or if all tax is due and
payable on a final return.
