NOTICE IS HEREBY GIVEN
THAT the Board of School
Directors of the Dallas School
District, at a special meeting held
on March 25th, 1975, declared the
improvement and premises,
containing 2.138 acres of land,
more or less, situate at Route 309
and West Center Street,
Shavertown, Kingston Township,
Luzerne County, Pennsylvania
owned by the Dallas School
District and formerly used as the
Shavertown Elementary School as
unused and unnecessary for any
purpose whatsoever by the Dallas
School District.
Pursuant to the Pubiic School
Code of 1949, the Dallas School
District shall sell and otherwise
convey said premises and all
improvements erected. thereon,
according to the terms and con-
ditions below set forth, by sealed
bids.
The terms and conditions of the
sale of the aforesaid premises are
as follows:
a. All bids for purchase shall be
securely sealed and delivered to
the Secretary of the Board of
Directors of the Dallas School
District, Conyngham Avenue,
Dallas, Pennsylvania, 18612 on or
before 4:00 o‘clock P.M. (EDST)
on Wednesday, April 23rd, 1975.
b. The premises and the im-
provements erected thereon shall
be sold as a whole and not divided
or otherwise separated in any
maner whatsoever. The premises
shall be sold in their present
condition, free and clear of all
liens and encumbrances and
subject to any exceptions reser-
vations, prior conveyances, or
proceedings by eminent domain
as may appear in the line of title.
Conveyance shall be by special
warranty deed. A certified survey
of the premises shall be secured
by the successful bidder, at his
cost, and submitted to the Board
of Directors of the Dallas School
District before the tender of deed
of conveyance is made to the
successful bidder.
c. All bids shall represent the
net consideration for such sale. All
real estate transfer taxes,
assessments and other charges
shall be borne exclusively by the
successful bidder, and there shall
be no apportionment of the same
at the time of settlement.
d. The Board of School Directors
of Dallas Township reserve the
unqualified right and privilege, in
its sole discretion, to accept or
reject any bid submitted for the
purchase of said realty. The bell,
playground equipment, and all
personalty located upon the
premises are expressly excluded
from the within sale and shall be
removed by the School District
upon settlement of the sale.
e. All sealed bids shall be opened
at a special public meeting of the
Board of Directors of the Dallas
School District held on April 29th,
1975, at 8:00 o‘clock P.M. (EDST)
to be held in the library of the
Dallas School District Senior High
School. !
f. A certified check or bank
money order in the amount of
equal to five (5) percent of the bid
submitted shall accompany all
bids delivered to the Secretary of
the Board of School Directors of
the Dallas School District. The
aforesaid money shall be credited
to the consideration to be paid by
the successful bidder and retained
by the Dallas School District, as
liquidated damages, in the event
that the successful bidder fails to
comply with all of the terms and
conditions herein contained. All
monies submitted by unsuccessful
bidders shall be promptly
returned to them subsequent to
the award of the successful bid.
g. Compliance with the bid by
settlement of the sale of the
aforesaid premises shall take
place within thirty (30) days of the
acceptance of the bid by the Board
of Directors of the Dallas School
District.
