WASHINGTON—Legislation
introduced by Sen. Richard
Schweiker; R-Pa., that would
protect the jobs of jurors in the
the recently-terminated Water-
gate grand jury apparently is
dead for this Congress.
Sen. Schweiker introduced
the measure last July after
learning that several jurors in
the Mitchell-Stans trial and the
Watergate grand jury had lost
their jobs because of their
lengthy jury duty.
Sen. Schweiker’s bill is an
amendment to the Jury Fee Act
of 1974, a bill that passed the
Senate in October and which
has been stuck in the House
since then. Sen. Schweiker says
the chances of passage this year
before Congress adjourns ‘are
“less than 50-50" at this point.
Others are even less optimistic.
The Republican senator’s
measure would require that any
employee who returns to his job
within 15 days after completing
federal jury duty must be
returned to his job with the
same seniority, status and pay
as when he left. For purposes of
insurance and other employee
benefits, the bill says an em-
ployee’s jury time must be con-
sidered as a leave of absence.
Sen. Schweiker said he and
many other people were
“stunned” to learn that no job
protection exists for™ federal
jurors.
“We protect GIs. When they
return from wars they get their
jobs back,” Sen. Schweiker
said. “We have every bit as
much responsibility to protect
jurors who face as much and
sometimes more financial
hardship and personal in-
convenience when they serve.”
Sen. Schweiker said the bill
has wide support in Congress
and probably would have been
passed by now if the House
Judiciary Committee, which
has the bill, hadn’t gotten
bogged down in first the im-
peachment hearings and now
the Rockefeller hearings.
“It’s unfortunate that this
(bill) happened to be at the
bottom of the totem pole, below
impeachment and Rocke-
feller,” Sen. Schweiker said.
If the bill dies—and House
Judiciary Committee staffers
believe that will be the case—
the legislation could not be
passed until sometime next
year, when the new Congress
takes over.
The bill's death means that
those whe served on the Water-
gate grand jury—which ended
last week after 30° months—
could lose their jobs. Two secre-
taries on the grand jury have
already lost their jobs.
Sen. Schweiker said the only
way the bill could get through
Congress this year would be if
Watergate Judge John Sirica
made a “request” that the bill
be passed or if Watergate jurors
should find that they had lost
their jobs. That’s the only kind
of thing that could give it im-
petus,” he said.
Sen. Hugh Scott, R-Pa., is a
cosponsor of Sen. Schweiker’s
amendment.
The Jury Fee Act would also
raise from $20 to $25 the daily
federal jury pay. The jury pay
hike was prompted by a study of
the financial inequities suffered
by the Watergate jurors.
