BE IT ENACTED AND ORDAINED and it is hereby enacted and or- dained by the authority of the Township of Lake, ‘County of Lu- zerne and State of Pennsylvania, as follows: SECTION 1. (a) The word “junk” as used in this ordinance, shall mean any dis- carded materials or article as is not ordinarily disposed of as rub- bish or refuse, and shall include but not be limited to, scrap metal and scrapped motor vehicles, and shall not ‘include any garbage, or other organic ‘waste, or any paper, rub- bigh, rags, or other flammable ar- ticles: or materials. (b) The word ‘junk dealer” as used in this ordinance shall mean any person, as hereinafter de- fined, who shall engage in the business of selling, buying and deal- ing in junk. (¢) The word “person” in this ordinance -shall mean any natural person, partnership, firm, or corporation. Whenever used in any clause prescribing or imposing a penalty, the term, “person” as -applied to co-partnerships or asso- ciations shall mean the partners or members thereof, and as applied to corporations, the: officers and directors thereof. (d) In this ordinance, the sing- ular shall include the plural and the masculine shall include the feminine and neuter. SECTION 2. Tt shall be unlawful for any person to establish a busi- ness as ga junk dealer upon any private or public property in the Township of Lake, Luzerne County, Pennsylvania, within a distance of 50 feet from the edge of any pub- lic road: In the event that said business is established or to be established closer to a publie high- way than 50 feet, said business shall be enclosed by an eight foot fence located 15 feet from public road right of way.i In all cases, said business not to be located nearer than 33 feet from the side lines and rear line of said business premises for the purpose of allow- ing access for fire fighting equip- ment. (a) 1t shall be unlawful after the passage of this ordinances for any person to establish a business as a junk dealer upon any private or public property in the Township of Lake within a distance of 500 feet from any building occupied as a dwelling or three hundred feet ‘from any building used or occupied for any other purpose whatever. SECTION 3. No person shall -en- gage in business as a junk dealer in the Township of Lake without first having obtained a license from the Township Secretary for whic license the fee shall be $200.0 the first year which includes an fee of $175.00, and $25.00 for each and every calendar year thereafter, such fee to be for use of the Township. Such license shall be renewed annually on or before the 1st day of January of each year. [Provided in any case where a junk dealer’s business shall be established in the Township of Lake after the 1st day of ‘July in any year, the license fee payable for such junk dealer for the remain- der of such year shall be the in- spection fee of $175.00 and one-half of the yearly renewal fee of $25.00. l SECTION 4. The license provided | for in the third section of this or- dinance shall be issued by .the Secretary after application shall have been made therefore by the person desiring to be licensed. Such license shall state the name of the ' person to whom such license is issued and the premises from which such business is to be conducted. Such license shall be posted con- spicuously upon the premises li- censed thereunder. The name of the licensed junk dealer and the number of the license under which he operates shall be placed in a conspicuous place on the outside of every wehicle used for business purposes by such dealer. ISECTION 5. SECTION 6. No license issued under this ordinance shall be trans- ferrable from , one’ person to an- other except when the ownership of a licensed premises shall change. In any case the new owner shall apply for a transfer of such license to him and shall pay a trangfer fee of Ten ($10.00) Dollars. SECTION ‘7. Every junk dealer shall provide and shall constantly keep a book, in which shall be fair- ly. written down in the English language at the time of the pur- chase of any junk, a description of every article or material pur- chased or received by him, the date and hour of such purchase or re- ceipt and person from whom such article or material was purchased or received. Such book and all junk purchased, received or handled by any junk dealer shall at all times be subject to the inspection of the police and any other official of the Township of Lake. SECTION 8. Every junk dealer, licensed under this ordinance shall keep and retain upon the licensed (48) hours after the purchase of receipt thereof, all junk received or purchased by him, and he shall not disturb or reduce the same or alter the’ original form, shape, or condition until such period of forty- eight (48) hours shall have elapsed. SECTION 9. Every junk dealer licensed under this ordinance shall constantly maintain the licensed premises in the manner prescribed by this section, as follows: (a) ‘Such premises shall at all times be maintained so as not to constitute a nuisance or a menace to the health of the community or of residents nearby or a place for the breeding of rodents and, ver- min. (b) No garbage or other organic waste and no paper, rubbish, rags, or other flammable articles or ma- terials shall be stored in such premises. : (¢) Whenever any motor vehicle as junk, all gasoline and oil shall be drained and removed therefrom and none shall be permitted to re- main upon the premises.
