D. 1839, entitled "An Act re lating to the elections of this com monwealth," and In and by an Act of the General Assembly of Pennsylvania, .approved the I6th day of June, A. D. Everv male citizen. 21 years of age, possessing the following qualifications shall be entitled to vote at all elections. First. He shall have been a citizen of the United Slates at least one month. Second. He shall have resided In the state one year (or, having previously been a qualified elec tor or a native born citizen of the state, he shall have removed therefrom and returned, then six months) Immediately preceding the election. Third. He shall have resided In the election dis trict where he shall offer to vote at least two mrfnths Immediately preced ing the election. Fourth. If ti years of age and upwards, he shall have paid within two years a state or county tax, which Bhall have been assessed at least two months and paid at least one month before the election. SECTION 5. Electors shall In all cases, except treason, felony, and breach or sureiy oi me peace, De privileged from arrest during their attendance on elections, and In going to and return ing therefrom. SECTION 18. For' the purpose of voting no person shall be deemed to have gained a residence by reason ot his absence, while employed In the ser vice either civil or military, of this state or of the United States, nor while engnged In the navigation ef the waters of the state or of the United States, or on the high seas, nor while a student of any Institution of learning, nor while kept In the poor house or other asylum at public expense, nor while confined In public prison. Also, that in the fourth section of the Act of Assembly, entitled, "An Act relating to elections and for other pur poses," approved April nth, 1840, It is enacted that the aforesaid 13th' section shall not be construed as ,to prevent any military officer or borough officer from,, serving as' Judge, inapeetor or cierk at any general or special election of this commonwealth.. ., . ,,, r ' ' . J : i U ' ."If any, person shall prevent or . at tempt to prevent any officer of any election under the act from ' holding such an election, or use or threaten anv violence of any such officer, or shall interrupt or improperly Interfere with him. in tbe execution of his dut'. or shall block up the window or tne avenue to the window where the same may be holding, or shall riotously dis turb the peace at such election, or shall use or practice any Intimidating threats, force or violence with design to Influence or unduly overawe any elector or to prevent him from voting, or to restrain the freedom of choice, such person on conviction shall be fined In snv sum not exceeding five hundred dollars and to be imprisoned for any time not less than one month nor more than twelve months; and If It shall, be shown the court when the trial or sucn an offense shall be had that the person so offending was not a resident of the cltv. ward, district or the township where the offense was committed and not entitled to vote therein, then on conviction, he shall he sentenced to bay a fine of not less than one hundred dol lars nor. more than one thousand dol lars and be imprisoned not less than six months nor more than two years." If any person or persons shall make any bet or wager upon the 'result ot any election within this commonwealth, or shall offer to make.nny .auoh bet or wager, either by verbs I proclamation thereto, or by any written or printed advertisement, challenge, or Invite any person or persons to make such a bet or wager, upon conviction thereof, he or thev shall forfeit and pv three times, the amount, offered to bet. ; i . If anv person shall vote at more than one election district, or otherwise fraudulently vote more than once on the same day. or shall fraudulently fold and deliver to the inspector two tickets together, with the intent Illegally to "nte. or advise and procure another so to do, he or they shall on conviction be fined In any sum not less than fifty nor more than five hundred dollars, and be Imprisoned not less than three nor more than twelve months. If any person not qualified to vote In this commonwealth agreeably to law (except the sonB of qualified citlsens) shall appear at any place of election, for the purpose of issuing tickets or Influencing cltlaens qualified to vote, he shall on conviction forfeit and pay any sum- not exceeding one hundred dollars for every such offense and bo Imprisoned for any term not exceed ing twelve months. PKCTION 1. The right of the citi zens uf the United States shall not be denied or abridged by the United States on account of race, color or previous condition of servitude. SECTION 2. That Congress shall hnve power to enforce this article by appropriate legislation. AND WHEREAS, The Congress of the United States on the 81st of March, 1874, passed an act entitled "An Act to enforce tho right of citizens ot the United States to vote In the several Stnles of tha Union and for other pur poses," the first and second sections of which are as follows: SECTION 1. BE IT ENACTED. Ac, Thnt all citizens of the United States who are or Rlinll be otherwise qualified to vote at any election by the people of any state, territory, district, city, county, parish, township, school- dis trict, municipality or other territorial subdivision, shall he entitled and al lowed to vote at all snch elections, without distinction of color, race or previous condition of servitude; any constitution, law, custom; usage or reg ulation of any slate, territory, or by or under Its authority, to the contrary notwithstanding. SECTION 2. AND IT IS FURTHER ENAOTKD, That if, by or under the Constitution or laws of any state or territory, any act is - or shall be re quired to be done as a prerequisite qualification for voting, and by consti tution and laws persons or officers are or shall be charged with the perform ance of duties in furnishing cltlzens an opportunity to perform such prerequi sites and become qualified to vote, it Bhall'lie the duty of every such person and officer to give all citizens of the United States the same and equal op portunity to perform such prerequisites ami to become qualified to vote with out distinction xt race, color or pre vious condition of servitude: and if any suclr person or officer shall refuse, or knowingly omit to give effect to this section, he shall for every such of fense forfeit and pay the sum of five hundred dollars to the person ngrleved thereby, to be recovered by an action on the case, with the full costs and such allowance for counsel fees as the court shall deem Just, and shall, also for every such offense, be deemed guilty of a misdemeanor, and shall on conviction thereof, be fined not less than five hundred dollars, or be Impris oned not lens than one month nor more than one year, or both, at the discre tion of the court. .-...
