sons owning real properly abutting up
on that part of Fifth street In the Bor
ough of lleynoldHvtlln, IV, which lies
between the Hon lit side of Main street,

Hid Town Council of the said Horough,
a petition of two-thirds of the owners of
property, representing net loss than

properties fronting or abutting on thai
part of Fifth street aforesaid, proposed
to be fradod, pvred, curbed, etc., re
questing that the borough, by an ordi
nance, require that part of Fifth street
as above designated to be Rinded, our bed
and paved with paving brick or other
snl table material, and that the council
assess and collect In the manner re
quired by law, two t birds of the costs
and expense of the -aid grading, curb
ing and paving, oto , from tbo owners
of real estate bounding or abutting
thereon, which said petition has been
vurltled hy tbo allldavlt of one of the
petitioners;
Now, therefore, be It ordained and
enacted by the Town Council of the
llorough of Uoynoldsvllln, I'a., and It Is
hereby ordained and enacted by author
ity of the same:
Hoc. 1. That the abovo mentioned
proposition of the property owners tie
and the same Is hereby accepted.
Boo. 2 That that part of Fifth street
which Is designated above, shall, dur
ing the present year be graded, curbed
and paved with paving brick In accord
ance with the plana and spooillcntlons
prepared and approved by the Town
Council arc hereto attached and inniln a
part of this ordinance: that two-thirds
of the costs and expenses of said grad
ing, curbing and paving are to bo col
lected from the owners of tbo real es
tate bounding or abutting thereon, hy
an equal assessment on the feet front
bounding or abutting as aforesaid, In
accordance with the provisions of the
Act of Assembly of the Commonwealth
of Pennsylvania, relating thereto and
regulating the sanio, and the remainder
of such costs shall he borne by the llor
ough of Uoynnldsvllle, i'a. O. W.
Kline Is hereby designated by the Coun
cil or tnnsald llorough to he In charge
of said work, representing the llorough
as to the faithful performance of tbo
contract on the part of the contractor,
grading, curbing and paving said part
of Ftftb street, with power on behalf of
the borough to employ a competent
engineer, when, la the judgment of the
said U. W. Kline, one Is necessary In
the matter of the Mild grading, curbing
and paving. Said O. W. Kline is also
designated by the Council to estimate
said equal assessment.
Sea. 3. The president and secretary
of Council are horeby directed to ad
vertise In one or more newspapers pub
lished In the borough of iteynoldsvillo,
and by hand bills for bids or proposals
for tbo grading, curbing and paving of
said part of Fifth street in accordance
with the provisions of this ordinance
and the plans and specifications hereto
attached. All bids to be for the com
pleted work, Including all materials
and to bo accompanied with samplcB of
tne Dries: proposca to no used by the
bidder. The Council reserves the right
to reject any or all bids.
Seo, 4. The bids to bo made shall bo
for the completed work by the square
yard, measurement to bo from the Jn
side of both curbs, bald bids shall be
sealed and be filed with the secretary
of Council not later than eight o'clock
p. m. on the ZUtb day of August, A. D.

Seo. B. The successful bidder will be
requirod to enter Into a ccntract In
writing to perform the said work and
furnish the materials therefore In ac
cordance with tho provisions of this
ordinance, and the plans and specifica
tions hereto attached. The said con
tract shall provide for the commence
ment of the work on or before the 2Hth
day of August, A. D., 11(07, and the
final completion thereof on or before
the 16th day of October, l!M)7. The
successful bidder will also be required
to file with the secretary of the Council,
within forty-eight hours after the ac
ceptance of his bid, the bond of a reli
able Trust Company, to be approved by
the Council, In the sura of One Thousand
Dollars (11,000.00), conditioned: (1) for
tho faithful performance of tho work
within the time specified and in accord
ance with the plans and specifications,
and (2) for the payment to the borough
of Reynoldsvllle, Pa., of any and all
sums which may be recovered against
it by reason or on account of any care
lessness or negligence on the part of
taid contractor or any ofhis agents,
servants or employees, together with
all foes, costs and expenses incurred by
said borough in defense of any and all
suits or actions brought against it on
account or by reason of suoh carelessness
or negligence.
Seo. 6. The successful bidder will
also be required to furnish within five
days from the date of the acceptance of
his bid, a written agreement on the
part of the manufacturer of the bricks
to be used In said paving warranting all
bricks to be used in said paving to be
equal in all respects to the samples sub
mitted to the Council and warranting
that said bricks will, if laid in accord
ance with the plans and specifications,
withstand all the ordinary and usual exi
gences of travel upon said at. for a period
of five years from the date of the comple
tion of the work. The said agreement
shall also contain a stipulation to the
effect that said manufacturer will re
place, at any time within the said
period of fife years, upon notice by the
Council, all brick which shall not with
stand the ordinary and usual travel on
said street or which may disintegrate
or break on account of heat, cold,
moisture or improper material used in
the brick, or for or by reason of poor
workmanship in the manufacturing
thereof.
Seo. 7. If the successful bidder shall
fall, neglect or refuse to sign the con
tract, file the bond and agreement men
tioned in sections five and six in this or
dinance, his bid shall be rejected and
the council hhall be at liberty to eit her
advertise for new bids or accept a hid
on file made by a person who shall com
ply with the provisions of this ordi
nance, which the Council may consider
most advantageous to the borough.
