A Correction..
In a recent issue of The St ut it has
been made appear that the "acting
Burgess" has been guilty of a misde
meanor, by receiving a license lee
lower than the minimum, stipulated in
borough ordinance, relating to peddling
and hawking, within the limits of Bald
borough, and ordinance No. 38 is quoted.
The editor has erred, and It is my
desire to have such error cor 'ected, as
I know few of our citizens are familiar
with the various borough laws, and it is
certain that the writer of the above
article referred to Ib very unfamiliar
with said laws.
In the first place, ordinance No. 38
refers to the protection of telegraph
and telephone poles, and has .lothing to
say about selling on the streets at all.
I think it was intended to read ordi
nance No. 28 that being the ordinance
quoted. This ordinance does only
apply (as tho first section says,) to
house to house canvassing," and not to
street venders, as the people may think
it dues.
The ordinance that refers to street
veuders, Is ordinance No. 71 which is as
follows :
Section 1. Bo It ordained . nd enact
ed by tho Burgess and Town Council of
the borough of Itey noldsville. and It is
hereby ordained by the au .norlty oi
same; mailt, e-naii not oe lawiui tor
anv norson or persons, to aui'ar within
the limits of the borough of Roynolds-
villo, as a peddler or hawker, for the
Durpose of soiling, vending, peddling,
hawking, or exposing for sale anything
whatsoever, without tlrst having pro
cured a license from the Chief BurgeBS,
and paying therefor a sum not less
than $1.00, or more than $50.i0 per day
for such license.
Section 3. That all ordinances or
parts of ordinances, inconsis'ant here
with be and the same are hereby re'
pealed.
Now If any one, will say that ordi
nance No. 28 has any reforence to
"street selling or vending," in answer
will say, that by virtue of ordinance
No. 71, ordinanoe No. 28 Is repealed and
therefore not a law.
The same Item refers to a "petition
to the council to Instruct the Burgess."
This would bo improper, bi cauBe the
Bureess is not sub-ordina e to the
council, but rather the rever. e Is true
By ordinance No. 71 the Bu rgess has
discretionary power to saj $1.00 or
$50.00 and there is no dl ttatlon of
council, or other act, or actions, that
will change this power, only by an
ordinance enacted.
