    Fire at Dr. Train's.
The home of Dentist Truitt, on Water
street, was damaged by fire on Tuesday
morning. Tho alarm awakened our
people at 3.30 a. m. On reaching tho
scene of the Area goml deal of smoke
but little fire was discovered. The fire,
which was confined to the Intorlor walls,
was put out with tho chemical engine.
Considerable trouble was experienced
In getting to tho lire. Tho household
goods aro badly damaged. Mrs. Truitt
was away visiting her peoplo at Royn
oldsvllle. The doctor awoke almost
choked by ' the smoke and gave the
alarm by firing his revolver from a
second story window, through which ho

Man With Broken Back.
Thomas Evans, a miner, 38 years ot
ago, was brought to the DuBols hospital
Monday suffering with broken back.
The accldont occurred Thursday of last
week to mine No. 3, at Falrmount City,
where he Is employed. Evans was
caught under a fall of olay and rock and
badly crushed. He was brought here
yesterday In charge of a daughter. The
man Is In a critical condition and suffers
so much pain from his Injuries that he
has to bo kopt under the Influence of

SUPERVISORS HAVE AUTHORITY.
Can Grant Trolley Roads Franchise Over
Public Highways of Township.
In the Issue of The Star August 5,
1903, an article was published about the
supervisor ot Wlnslow township grant
ing a franchise to the Jefferson Traction
Company to build trolley line to Rath
met, Soldier and Sykcsvllle. In its
Issue of August 7th tho Punxsutawney.
Republican clipped our article and by
some mistake gave the ro(tm(rcr credit
for article. Last weok tho Brookvlllo
Dtmncrat clipped the first paragraph of
the article, evldontly from the columns
of Punxs'y Republican, as the Democrat
gave our contemporary credit, and then
asked for Information, as follows :
"Now, what we want to know Is,
where did the supervisors of Wlnslow
township get authority to grant a trol
ley road franchise to any one over tho
Sublio highways of that township. In
eed we would like to know where the
supervisors of any township got author
ity to grant any kind of a franchltte.
The legislature can grant franchises and
so can the courts In some caRos, but
when, where and how were supervisors
authorized to grant franchises. We
thought tholr duties were confined to
opening highways and keeping thorn In
repair. If supervisors havo any such
authority as the Volunteer suggests, we
would llko to know all about It. Will
the Volunteer Inform us? We think It
an Important thing and the peoplo
ought to understand It. Let us havo
full information."
As the Volunteer has not yet stated
that the supervisors of Wlnslow town
ship have granted the Jefferson Trac
tion Company, or any other company,
a franchise over the route stated above,
and the article referred to In the Ihm
oerat was clipped originally from The
Star, we feel It is our duty to give the
editor of the Democrat the Information
he Is so anxious to recolve for himself
and the people In general. Here It is :
No street passenger railway shall lie"
constructed within the limits of any
city, borough or township, without the
consent of its local authorities. Article
17, section 9, Constitution of Common
wealth. No street passenger railway shall be
constructed by any company Incorpor
ated under this act within the limits of
any city, borough or township without
the consent of the local authorities

The consent to occupy a township
road by a street railway company must
be given by the supervisors, when act
ing together In a proper manner,

Where a street railway company has
been granted a chartor for a street
railway over certain streets, but has
not received the municipal consent, It
has no standing In equity to restrain
another company subsequently char
tered from building over the same
streets where it appears the second
company has received the municipal
consent. There is nothing In the Act
of June 7, 1901, P. L. 014, to change

The above paragraph from Ponn'a
Superior Court Reports makes it very
plain that the consent of the local
authorities town council or supervisors
Is necessary before a street railway
can be constructed, even though a char
ter has been granted from the state.
If the editor of Democrat had boon
reading DuBols papers recently be
would have noticed that the DuBols
Traction Company wants a franchise to
extend Its line Into Sandy township,
but the supervisors have refused to
grant the right of way.

Indulgence I would like to make a few
remarks concerning the advertised to
be harvest home plonlo held at Wlshaw
Park lust week. It was mlsnnmed.
I want to state plainly that the
farmers had nothing to do with it
at all, and very few farmers went near
the show during the four dnys. The
farmers consider It an Insult and lo
llcve that they havo reason for feeling
Indignant about It. Had tho Bhow bet n
given a proper name tho farmers would
not havo paid any attention to It, but
to get up nich a show and call It a
harvest homo plcnlo Is too much to
swnllow'wlthout a wry face. The
statement that It wns a harvest homo
picnic must have been made to deceivo
the peoplo for the purpose of drawing a
crowd. I have been told that gambling
wns ono of tho lending features of the
plcnlo und that a sworn officer walked
through tho park one dny and winked
at tho gambling devices.

Good Singeis.
A male quurtet from the Central and
Railroad Y. M. C. A.'s of DuBols sang
on Main street In this place Saturday
evening and attracted a large crowd.
They sunt 11 ret at corner of Main and
Fourth streets and attracted such a
largo crowd that tho street was partly
blockaded and they had to movo up to
the corner of Main and Fifth streets,
whore there wore not so many peoplo
hurrying too and fro. The young mon
are fine singers. The Y. M. C. A. sec
retaries were along and they took ad
vantage of tho opportunity to advertise
tho excursion to Alameda Park August
25th. They also delivered short and to
tho point addresses. They advised tho
people of ReynoldHvlllo to support tho
Young Men's Reading Association at
this plneo.
