That tho right of way Is hereby granted to E. A. Kerrln, his heirs, successors or assigns to enter upon tho public streets, lanes, alleys and public squarca of the Borough of HeynoldHville, to erect, maintain and control poles and wires for the purpose of carrying and conducting electricity, for the period of II fly years, through said streets, lanes, alleys and public squares of the said borough of lteyn oldsville as they now exlct, or may bo hereafter changed, extended or estab lished, for tho purpose of supplying electricity to the citizens and inhabi tants of the borough of Roynoldsville, and for the lighting of the stores, offices, dwelling houses, streets, lanes, alleys, public squares and other places where electric lights may be needed and desired, and for tho supplying of electricity for motor power, or for heat to such person or persons as may desire the same. Section 2. Said poles shall bo erected on the streets, lanes, alleys and public squares at such places and on such lines as tho Street Committee of the said borough shall direct, and the poles shall bo straight and of sufficient strength to carry all wires placed there on, and shall not ho less than twenty five feet in height above the streets. Section 3. The said E. A. Ferrln, his successors or assigns, shall within ninety days after this Ordinance goes into effect, commence to erect such lines and prosecute said work with reasonable diligence until said plant Is completed. Section 4. This Ordinanc shall not go Into effect until tho said E A. Fer rln, his successors or assigns shall file the stipulation accepting the same with all Its provisions, and agreeing to be hound thereby. Said acceptance to be filed within ten days or this ordinance to he null and void. Section 5. That any ordinance or part of ordinance conflicting with this ordinnnce is horeby repealed so far as the samo effects this ordinance. WHEREAS, the Borough of Reyn oldsville at a public election held In tho aald borough on the I5tb day of September, 1888, submitted to the voters of the said borough the question of voting for public taxes for the furnishing of water and for the lighting of the streets, lanes and al leys of the said Borough of Reyn oldsville, and for the furnishing of water, etc.. and whereas, the said Borough of Reynoldsville has not s ret entered into any contract lor the urnishlng of lights for the lighting of the streets, alleys, and publio squares of the said borough, Therefore, be It ordained by the town council of the Borough of Reyn oldsville, and it is hereby ordained by authority of the same: Section 1. That the said borough hire from E. A Ferrln, his heirs, successors or assigns, Aro Lights to be of not less than 2000 candle power, to be kopt burning during each and every night during the period of this contract, to be located ut suuh point or points as the Light Committeo of the town eounoil may direot, which said lights during the continuance of this ordinance ahull be kopt and maintained by the said E. A. Ferrln, his successors or assigns, for the period of ten years from , the date at which said light is turned on. In consideration for which tho said Borough of Reynoldsvllle will pay to tho said E. A. Ferrin, his heirs or assigns, the sum of Sixty ($(10) dollars per annum for each and every Am Light so kept and maintained. Suid sum to be paid quarterly on the First days of Januury, April, July and 'October of euch and every year during the uforesald period of tun yoars. Proper deductions and allow unci's shall be made by the said E. A. Ferrln, his successors or assigns, for any light or lights thai do not burn tho required length of time. Suid deductions and allowances to be dotormlned for eauh quarter, before tho light bill is paid. The suid E. A. Ferrln, his successors or assigns, ahull eruut Huld lights within six months from this date and have the current ready to turn on within six months from this dute. The suid Borough of Reynoldsvllle will keep and maintain the nforcsuid number of tights during tho said term of ten years and for each additional light attached during the suid term, the said borough ahull not pay more than the sum herein stipulated to be paid for Aro lights during the contin uance of this contract. Section 2. The Borough of Reyn oldsville will annually hereafter levy and collect from its inhabitants a tax for the purpose of paying for said Arc lights as now provided by law. Section 3. Khniild tho said E. A. Ferrin, his successors or ensigns, fail to accept this ordinnnce and be bound by the terms and conditions thereof within sixty (t0) days from tho date hereof, or fall to cVeol and operate said Arc lights within tho time prescribed In this ordinance, then this ordinance shall become void, nnd the Borough of Reynoldsvlllo shall be released from all liability thereunder. Section 4. That, any ordinance or part of ordinance connecting with this ordinance is hereby repealed, so far as the same effects this ordinance. That said sewer shall be built as follow: Diameter of sewer pipe to be decided upon by the council; to be placed not less than three (3) feet below the surface of the present street, so that connections with tho same can bo properly mado from cellars six (K) feet In depth reckoning from level of center of street. The SewerCommlttee of the town council of the borough of Reynoldsvllle be and is hereby author ized and empowered to proceed to buy materials, employ an engineer and la borers and make all necessary contracts for the laying out, construction and completion of said sewer. Section 3. That said sewer shull be subject to all the rules, regulations and ordinances of the borough of Reynolds vllle now in force or that may be here after passed regulating such sewer, and sewer system of said borough, and no person shall be permitted to tap such sewer or connect therewith until such Iierson or owner of property has paid his or ber proportion of the costs of the construction of said sewer and complied with all the rules and regulations as aforesaid. Section 4. The costs and expenses of the same to be assessed and collected in accordance with the provisions of the Acts of Assembly of the Commonwealth of Pennsylvania relating thereto and regulating the same. Section 5. That any ordinance or part of ordinance conflicting with the provisions of this ordinance be and the same is hereby repealed so far as the same effects this ordinance.
