Life Sentence For Murderous Soldier
Washington, Feb. 9. Private James
Ellis, Company I, North Carolina vol
unteer Infantry, having been tried and
found guilty of murder by a general
court martial, convened at Macon, da.,
was sentenced to be dishonorably dis
charged from the service of the Uni
ted States, forfeiting all pay and al
lowances, and to be confined for the
period of his natural life In the United
States penitentiary at Fort Leaven
worth, Kan.

Akron, O., Feb. 9. Mrs. 1'amphllia
Wolcott, widow of the late C. P. Wol
cott, and a sister of Edwin M. Stanton,
secretary of, war In Lincoln's cabinet.
died here yesterday, aged 72. Mrs. Wol
cott has written something upon the
personal side of her brother's character
which she refused to have published
until after her death.

The Colorado Blooknde,
Denver, Colo., Feb. 9. A snowstorm
ranging in the mountains again tied
up the Colorado railroad lines to the
west yesterday. No trains are running
on the Midland, although gangs of
shovelers are persistently at work. Two
passenger trains from the west on the
Denver and Rio Grande were stalled
between Leadvllle and Buena Vista
and two were held at Glenwood
Springs. West bound trains could not
go beyond Salina. Rio Grande officials
say the main line will be reopened in
a few hours after the storm ceases.
Trains over the Union Pacific are get
ting through, but are behind the
tchedule.

Chicago. Feb. 9. Officials nt division
army headquarters are seeking the
whereabouts of Lieutenant J. B. Ever
Itt, of the Fourth Wisconsin volunteer
Infantry. While the regiment was at
Camp Douglas, Wis., last fall Lieuten
ant Everltt acted as the commissary
officer, and handled large amounts of
money In the purchase of supplies.
Major Smith, chief commissary of the
department of the lakes, recently ad
dressed a letter to Lieutenant Eyerltt
asking for an Immediate settlement of
his accounts, which were short. Yes
terday a letter was received from Cap
tain William Agnew, at Annlston, say
ing Lieutenant Everltt had deserted
and fled.

phatically vetoes the proposition, say

Havana. Feb. 9. Governor General

gards as a temporary military admin

Bryson have started a subscription to
buy Gomez a house at ISI Vedado,
where he may spend his declining years
In peace after a stormy career.
Dispatches received from Remedies
say that most of the members of the
staff of General Gomez have proceeded
to Mrttanaas by special train, and that
the general himself left yesterday
morning for Camajuanl and I'lacetas.
His arrival here will be delayed by
these Btops along the route, but the
delay In the arrival of tho Nashville
will give him time to be present at the
Interment of Garcla's remains.
All day yesterday Havana was ex
pecting the arrival of the United
Stales gunboat Nashville with General
Callxto Garcla's body. Watchers were
posted upon high buildings, and all
eyes were turned toward Morro Castle
for the signals that would notify the
sighting of the gunboat and summon
the waiting committee, the pallbearers,
the hearse, soldiery, patriotic clubs and
city council to the wharf to receive th
remains nnd escort them to the city
hall, where the session chamber hud
been sumptuously prepared for the
lying In state. The council was unable
to meet yesterday In consequence of
the arrangements, and public business
was virtually held in abeyance in view
of the expected functions.
Last night news was received from
the United States that the Nashville
had not sailed for Havana, and the
cablegram asked how the authorities
here came to be misled. Tuesday's
papers published an alleged dispatch
from Senor Bstrada Palma to Mayor
Pfrfecfw Lacoste, saying that the Nash
ville, with Geeral Garcla's body, had
left Norfolk for Havana on Saturday
last.
Lieutenant Colonel Smith, chief com
missary of Cuba, thinks that the recent
condemnation of canned meats by the
meat survey board was Improperly
made, and as he regards the board's
action as a reflection upon him he de
sires to have the whole matter made
the subject of an Inquiry by some
higher authority. As the meat has
been sunk In the gulf stream there Is
no chance for an expert examination.
The meat survey board, however, con
sidered that the meat, though not all
actually rotten, was unfit for human
consumption and distinctly inferior.
Upon this ground the inspectors con
demned all of one lot.
Cuba's postal service will be the up
to date American system hereafter, the
postmaster general having yesterday
approved Major Rathbone's recom
mendations. Things unknown before
are to come Into vogue money orders,
a perfected registry, free delivery and
two cents postage per ounce Instead of
three cents per half ounce.
EXIT WAR INVESTIGATORS.

Washington, Feb. 9. The war Inves
tigating commission has now conv
pleted Its labors. The members of the
commission today met at their old
offices, formally attached their signa
tures to the original document and pro
ceeded In a body to the executive man
sion to Inform the president that they
had completed their mission, and then
presented their report. The commis
sion thus ceases to exist.
The report of the commission says
there were only two witnesses who real
ly testified against the beef furnished
the army In the recent war, General
Miles and Major Daly, the chief sur
geon. The comrrlisslon goes on to point
out the mass of evidence submitted to
the contrary as offsetting this testi
mony. The strictures of General Miles
are subject to a severe criticism.
The report says that the evidence be
fore the commission shows that Sec
retary Alger exercised proper diligence
and supervision, and that his subordi
nates also were efficient, experienced
and faithful. The commission is a unit
on its report, and there is no min
ority report.

champion unless the contest is allowed
to continue until one man Is unable to
respond to the call of time," said Bob
Fitzsimmons today. The remark was

Lenox Athletic club of New York is
contemplating offering for a 25 round
contest between FitzBlmmona and
Bharkey. "Where do you expect to

his reply.

break at Apia. A correspondent writes
that while Chief Justice Chambers wai
considering the claims of the rival
candidates for the kingship theMataafa
natives, who were numerically stronger,
were openly supported by the German
officials, and the entire Oerman popu
lation began to talk of Immediate war

The life of the chief Justice was
threatened by one of the chiefs. The
three consuls agreed to Issue a proc
lamation putting the chief Justice and
his residence under the protection of
the treaty power. For some reason
the German consul broke his word nnd
declined to carry out the agreement.
The British and American consuls
thereupon Issued a proclamation and
hoisted their national flam over the
residence of the chief Justice.
Dec. 1 the chief Justice declared that
Mataafa was Ineligible for election and
that Malletoa Tanus was king. The
American and British consul Immedl
ately recognised the new king. Within
an hour the consuls, the president and
the German and British captains held
a meeting. The German consul and
president declined to recognise Tanus.
and went over to Mataafa, who -was
waiting at Mullnu, the western portion
of Apia.
The correspondent confirms the story
of the battle of Apia, as previously
published, as well as the act of the
German consul In ordering the release
of a riotous German who had been
sent to prlxon by the chief Justice. The
correspondent proceeds:
"Everybody In Apia Is anxiously
awaiting news of action by the three
powers. The action of the provisional
government In deporting the Malletoa
chiefs Is claimed to be In direct viola
tion of the agreement made with the
consuls. Everything points to another
fight among the natives at no distant
time. Part of the Mataafa people are
dlssatlslled with the deportation of the
chiefs and are now talking of uniting
with the Malletoa faction."

Brown headed the relief expedition
which started with supplies for
Captain Kelley and three assistants at
the Sixty-eighth street crib of the
city water works. Mr. Brown and
his two companions. Captain Will
iam Smith and Captain Daniel Don
ovan, took turns at the rope, while
the others pushed the sled, and not
withstanding exciting experiences, ow
ing to the wide gaps and floating ice
the daring mission was temporarily
abandoned.

Washington, Feb. 9. In the execu
tive session of the. senate yesterday
Senator Hoar, chairman of the Judici
ary committee, presented the report of
that committee adverse to the nomina
tion of Hon. Hamilton G. Ewart, to be
district Judge for the Western district
of North Carolina, and he and Senator
Spooner expressed the opinion that the
charges made against Mr. Ewart were
sustained by the facts. These charges
were that he was Incompetent as a
lawyer and morally unfit to hold the
position. He was accused of defraud
ing pensioners and their widows and of
selling his public documents while a
member of the house of representa
