practical censorship over those In his
command relative to the dlvulelnR of
the reason for any movement made or
to be made by the squadron or Indi
vidual ships of the squadron. To more
fully carry out that plan of protec
tion to government Interests, only com
manding oincers are mado aware of
such movements, and the responsibil
ity Is thus minimized.
The conjectures as to the object for
which Commodore Schley ordered tho
Minneapolis and Columbia to sea Sat
urday night are many. Protection of
the steamship Paris, assistance to tho
battleship Oregon, capture of Spanish
KUuboats and convoy for the transport
Panther, now nt Hampton Roads, are
some of them. The latter theory Is
partially discredited because the Pan
ther, with her human freight of nearly
TOO olllcers nnd marines, lies In safety
with the remaining ships of the squad
ron off Fort Monroe, and evidently In
no hurry to move. As a matter of fact
the Panther Itself has some protection,
being pretty well nrmed with eight
rapid lire guns, which could be used
effectively.
The departure of the Columbia and
Minneapolis cieated n great deal of ex
citement, but demonstrated In what
fine condition all of the vcsselH of Com
modore Schley's squadron are. From
the time the slirnal was made on the
flagship to the time the Minneapolis
went by her on her way to sea was
less than an hour, and the Columbia
followed In a few minutes.
The work of strengthening the forti
fications at Fort Monroe continued all
day yesterday with a larce working
force, as did also the work of laying
mines In the harbor. Where the old
eight and ten Inch Converted rifles
used to stand will be mounted a bat
tery of modern rapid fire guns, which
are expected to command Hampton
Roads and Chesapeake bay and make it
Impossible for a torpedo boat of the
enemy to enter. Three guns, It Is
thought, will be In fighting condition
by the end of this week.
At Wllloughby Spit, opposite Mon
roe, and which point controls the en
trance to Norfolk, Newport News and
the James and Potomac rivers, a board
of naval olllcers have made an Inspec
tion, with a view of constructing a fort
at the point to co-operate with Fort
Monroe. It Is expected that active
operations on the fort will begin this
week and be pushed to completion
without delay. The fort will be tem
porary In structure, but properly man
ned will prove a formidable defense
In case the enemy should attempt the
Invasion of the harbor.

Madrid, April 25. Spain adopts pri
vateering In fact, but not In name. The
reservation In the decree Issued means
very little, and what the cancellation
of agreements with the United States
means can well be appreciated, par
ticularly by Americans remaining be
hind In Cuba and those who own prop
erty there.
A cabinet council was held yesterday
afternoon, and afterward the following
decree was gazetted:
"Diplomatic relations are broken off
between Spain and the United States,
and, the state of war being begun be
tween the two countries, numerous
questions of International law arise,
which must be precisely defined, chlelly
because the Injustice and provocation
camo from our adversaries, and It Is
they who, by their detestable conduct,
have caused this grave conlllct."
The royal decree then says Spain
maintains her right to have recourse to
privateering, and announces that for
the present only auxiliary cruisers will
be fitted out. All treaties with the Uni
ted States are annulled, 30 days are
given to United States ships to leave
Spanish ports, and the rules Spain will
observe during the war are outlined In
five clauses, covering neutral Hags and
goods, contraband of war, what will be
considered a blockade, the right of
search and what constitutes contra
band of war, ending with saying for
eign privateers will be regarded as
pirates. Continuing the decree reads:
Wo have observed with the strictest
fidelity the principles of International
law, nnd have Bhown the most scrupu
lous respect for morality and the right
of government. There Is an opinion
that the fact that we have not adhered
to the declaration of Paris does not
exempt us from the duty of respecting
the principles therein enunciated. Tho
principle Spain unquestionably refused
to admit then was the abolition of
privateering.

First, by organizing immediately a
force of cruisers, auxiliary to the navy.
which will be composed of vessels of
our mercantile marine and with equal
distinction in the work of our navy.
Clause 1. The state of war existing
between Spain and the United States
annuls the treaty of peace and amity
of Oct. 27, 1793, and the protocol of Jan.
12, 1877, and all other agreements,
treaties or conventions In force be
tween the two countries.
Clause 2. From the publication of
these presents, 30 days Is granted to all
ships of the United States anchored In
our harbors to take their departure
free from hindrance.
Clause 3. Notwithstanding that Spain
has not adhered to the declaration of
Paris, the government, respecting the
principles of the law of nations, pro
poses to observe, and hereby orders to
be observed, the following regulations
of maritime law:
1. Neutral flags cover the enemy's
merchandise, except contraband of
war.
2. Neutral merchandise, except con
traband of war. Is not selzable under
the enemy's flag.
3. A blockade, to be obligatory, must
be effective, viz., it must be maintained
with sufficient force to prevent access
to the enemy's littoral.
4. The Spanish government, uphold
ing Its right to grant letters of marque,
will at present confine Itself to organ
izing, with the vessels of the mer
cantile marine, a force of auxiliary
cruisers, which will co-opcrata with the
navy, according to the needs of the
campaign, and will be under naval
control.
0. In order to capture the enemy's
ships and confiscate the enemy's mer
chandise and contraband of war under
whatever form, the auxiliary cruisers
will exercise the right of search on the
high seas and In the waters under the
enemy's Jurisdiction, In accordance
with International law and the regula
tions which will be published.
6. Defines what Is Included In con
traband of war, naming weapons, am
munition, equipments, engines and in
general all the appliances used In war.
7. To be regarded and Judged as
pirates, with all the rigor of the law,
are captains, masters, olllcers and two
thirds of the crew of vessels which, not
being American, shall commit acts of
war against Spain, even If provided
with letters of marque issued by the
United States.
Urgent orders have been Issued or
the movement of various Spanish men-of-war,
and vigorous action Is antici
pated. Many French ship owners and
not a few private Frenchmen have ap
plied for letters of marque agamBt the
United States.
The cabinet council yesterday after
noon discussed the conduct of the war
and the measures It Is proposed to sub
mit to the eortes. Senor Pulgcerver,
minister of finance, will submit his pro
jects tomorrow. Every occasion Is be
ing seized throughout the country for
patriotlo demonstrations, and the na
tional colors are universally worn.
It Is practically certain now that
Senor Sagasta will remain In office
until the cortes suspends Its sittings,
virtually because there are no states
men who want to assume the heavy
responsibility.
An official dispatch from Havana
says: "The Italian man-of-war Gio
vanni Bausan has entered the port
and been received with an ovation.
Three suspected steamers Bhowed
themselves at nightfall."
