An eleven o'clock swwlon of the Borough
Council win held last night, but it was not as
exciting m the last one. It looked at one
time, when the electric light question was
touohed upon, that the closing incidents or
the last meeting of Council would lw re
hearsed, but better Judgment prevailed.
The Councilmeu in attendance at the meeting
were Messrs. McOuire, Lally, Coakley,
lloehm, Magargle, Shoemaker, Straughn,
James, NIswender, Englert, Gable, Bremian,
lteeee and Hand.
Messrs Hoffman, Iiroxton and Jones ap
peared In behalf of themselves and Messrs.
llees, Snell and Dalrd and asked permission
to connect sewers with the borough sewer on
Stmwborry alley and the permission was
granted on condition that the partios sign an
agreement not to connect water closets
It was decided to place a double crossing at
the corner of West and Centre streets, lead
ing from tlio schoolhouse.
Mr. MeOulre stated that the creek at
the eastern end of tlio town was tilling up
with coal dirt, and also under the bridge,
causing the creek to overflow to tlio great
datnaire ot residonts in the vicinity. He
moved that tho street committee lie instructed
to clean out the creek.
Considerable discussion followed and when
called upon for an opinion Borough Solicitor
I'omcroy confirmed tho opinion expressed by
some members that the creek was on the
proporty of the P. & E. C. & I. Co. and tho
lwrough had no right to go Upon tho land
and clean out the creek. The bridge ho said,
in line with tho street was tlio public high
way and tho creek remained private property,
but if tlio water pipes undor tho bridge
formed an obstruction to tho creek they
should bo cither raised or lowered to remove
tho obstruction. Mr. Lally disagreed with
tho Solicitor and said ho bclloved that part of
tho creek under the bridgo was public prop
erty. Mr. McGuiie's motion was lost for
want of a majority.
Mr. James slated that the duplicate for
1E07 had been written and amounted to $31,
030.47. Ho also statod that Council could not
lrirally exonerate real cstato from taxes. A
motion to reconsider the exonerations for
18U3 was loft over until next meeting pend
ing furthor information as to exoneration of
real ostate.
Mr. McUuire moved that a motion made by
Mr. Gablo at a subsequent meeting to allow
Tax Collector Soanlan a rubato of $500 to
help him defray tho exponse of constable
hire and othor expenses iu collecting taxes, be
taken up for consideration, but the motion
was lost pending an opinion on the question
from tlio Solicitor as to Council's right to al
low it.
Tlio report of the fire apparatus committee
included bids ior hose and the following con
tracts wero awarded : Eureka how, 500 feet
.it 90 cents per fool ; rubber Iioso, C0U feet at
$1.00 per foot ; Keystouo hose, 500 feet at 80
cents per foot.
Mr. Lally again brought up tho olectric
light question and moved that tho motion
.nvarding the contract bo reconsidered. The
motion was lost. Mr. Lally thou stated that
since the passago of tho law of 1803 no legis
lation passed by Council had been submitted
to the Chief Burgess for his sanction, or re
jection. For this reason, ho claimed, tho
electric light contract was illegal and void.
Sulicitor Pomcroy said that, under tho law
referred to, only ordinances and resolutions
in tho nature of ordinances need bo referred
to tlio Chief Burgoss as stated, but that the
ollicial has nothing to do with contracts or
tho deliberations of Council, except so far as
they apply to ordinances, or resolutions in

An Old nml Venerable Citizen or Zlon'a

citizen of .Ion's Urovo, passed peacefully
away on his farm at that place yesterday
Mr. Singloy had oftonttmos taken prldo In hl
age, and had almost reached tho centenarian
mark. Ho had attained tho remarkable age
of 00 years and otijoyed good health until a
few weeks ago. Almost uvery citlzon
throughout the Catawissa valley was ac
quainted with the deceased. His acquaint
auces in this town will also be surprised to
learn of his death. He had. been a resident
of Zlou's Grovo for 30 years, and lived on
tho same farm all that period. He is sur
vived by the following sons: John, of
Hhibtown ; Joseph, Anthony and Jacob, of
Nuremberg ; Stephen and William, of Zlon's
drove; Benjamin, of Butler; Samuel, of
Oowan ; and Walter, of Tomhlckon. Thrco
daughters, Mrs. llenry IJumble, of King town;
Mrs Schcll, of Nuromburg; and Mrs. Mary
Dicklsou, of Hazleton, survive The funorat
will take place from tho family residence
next Monday morning at 10 o'clock. Services

lect the three cent alien tax. Ordors were
issued and posted at all tho company's col
lieries in this vicinity to-day to that eflcct.
Tlio collections ceased on Sontembor 1st.
This Is in Hue with tho step takonbythe
other corporations throughout tho state, since
Judge Acheson, of Pittsburg, doclared tho
three cent tax law unconstitutional. If his
declslou Is sustained by tho Supreme Court
the tax collected previous to tho 1st Of Sep'
tember will bo refunded to tho men from
whose wages it was deducted.
All moneys already withhold in obedience
to tho law will bo hold by tho company until
a .final determination of tho legal questions
Involved shall bo reached. Tho notice fur
ther says : "Tho law which required us, upon
notico from tho tax collector, to retain from
tlio pay of allon workmen sums sufficient to
pay tho taxes assessed against them, Is pro
nounced by our counsel to bo undoubtedly
constitutional. This tax wo will continue
to collect."

Mr. McGuiro moved that the borough ap
propriate tho amount lor the purposo of run
ning tho stream through tho Conry, Graham,
U'Noill and other lots facing on Centre street.
Messrs. James, Gable and Hand contended
that if Council should mako such an appro
priation it would mako itself a party to
diverting tho channel of tho stream and
mako itself responsible for any future
trouble. Mr. Boohni hold to tho same
opinion, and thought Council should tako no
furthor action iu tho matter.
Chairman Straughn took part in tho dis
cussion and said there was not another town
iu the stute where ono man could defy a pop
ulation of 18,000. Mi. McGuiro's motion re
ceived but four votos and was defeated.
Tho scarcity of the wator supply was again
discussed, rotultlug iu a decision that the
water committee consider tho matter and
ascortaiu the cost of two streams in tho val
ley, and also the cost of a 30 and GO million
gallon reservoir to be placed at Brandouvillo.

Obituary.
Daniel Carey, a well known saloon keopor,
died very suddenly at his home at Girard
villo last night, his death being duo to an at
tack of paralysis. Ho was woll advanced in
years, and leaves a large family all of whom
aro grown up
Mrs. James Mclntyro, aged 50 years, died
at her homo in Palo Alto yesterday after
lingering illness. Sho is suryivod by a bus
