W. Wilson, tho cariicntcrs and builders of
town, against Most Itov. 1'. J. ltyan, of Mill
adolphla, Archbishop, etc., congregation and
pastor of St. George's Lithuanian Catholic
church, ct. al., ended on Saturday at Potts
villo by tho jury rendering a verdict for
tho plaintiffs aftor deliberating all night.
Tho vordlct was for $1,915, with interest
from May 3rd, 1802, to OctoW t), ISM, mak
ing a total of $5,1127. 10. Tho trial was beforo
.ludirn T.vnn. nf Juniata couutv. and occluded
about ten days. Tho suit whs brought to re
cover for tho erection of the Lithuanian
Catholic church on South Jarrtln street. Tho
church claimed that tho odlflco was not con
structed in a substantial mannor and In ac
cordance with tho contract, whilo the plain
tiffs claimed that tho erection was in accord
with tho plans and specifications of r.A.
lteilly, tho architect. Tho case was arbi
trated in 1893 and the builders wore awarded
$7,250.u7.

Smoke Cunsc Alarm.
Shortly after nlno o'clock this morning tho
fire department was called to tho Ferguson
theatro building at tho corner of Main and
Oak streets. Tho alarm was caused by smoke
issuing from tho Oak street brick wall of
that portion of tho building occupied by
Wood's Business College. After making an
investigation the firemen loft tho place, sat
isfied that there was no danger, but were In
no pleasant fmmu of mind, as they say tboy
havo been given several fruitless runs to tho
building on account of tho same troublo
Tho chimney on tho Oak street sido of the
building is evidontly in a dofectivo condition
and allows tho smoko to escapo so that it
makes its way into tho halls of tho building
and through tho brick walls. Tho smoke
docs not escapo in sufficient quantities to
cause tho occupants of the building any
great inconvenience, howovcr, but it is a caso
that tho Hue committee of tho llorough
Council should investigate and causo repairs
to hu made.

In clearing tho criminal court calendar at
Tottsville on Satuiday of cases that were not
reached at tho last term of court tho follow'
ing wero announced as nol prossed: Surety,
Isaac Morgan, of Shenandoah; attempted
abortion, Andrew Hyland, who is now serv
ing time for f. and h. on complaint of tho
same prosecutrix, Ida Zerhey, of Shenandoah;
exhibiting gambling devico, I.dward Mon
aghau. Shenandoah ; falso pretenso and fop
gory, John A. Noe, late of Tottsville. Tho
prosecutor in tho latter caso was W. J
Lloyd, a Shenandoah resilient who died a
few weeks ago.

plays ever written. It mado a fortune for

played by Nat Goodwin in Now York and

They Will Soon Take Possession of Their
New Church.
Rov. Swoigart, of Ashland, preached a
powerful sormon to tho licthauy United
Kvnngelical congregation in Dougherty's hall
yostorday morning and another in tho oven.
ing, and also assisted tho pastor, Rov. I. J.
Reltz, in conducting communion after preach
ing at the latter service. Just beforo closing
tho ovening scrvico the pastorformally an
nouncod that tho trustees of tho congrcga'
tion had purchased during tho past week the
church building formerly used by tho English.
Lutheran congregation and it is expected
that tho edilice will bo ready for occupauey
in about six weeks, llo urged upon each
one in tho congregation, as well as all
friends, to give tho trustees all tho help they
can.
This is a happy approach to tho end of a
long season of turbulent experience which
tho congregation has had through an unfor
tunate split at tho head of tho old church,
It was originally precipitated by n
dispute between factions as to whoro
tho general conference should bo held
Ono faction, adherents of llishop Dubs
maintained that it should hoy held in
tho Eastern Pennsylvania District; the
adherents of Bishops Eshcr and Bowman
claimed Illinois was the proper place. Etch
faction stood by its claims and two con
ferences wero held. Tho matter was carried
into tho courts and tho Eshcrite Taction was
sustained, its conference being declared tho
legal one. This faction then called upon the op
posing congregations to come within its juris
diction, or forfeit their charters and properties
but this all tho Dubs congregations refused to
do. Some at onco made tho forfeitures, but
others! held out, tho members of tho con
gregatious claiming that they had built their
churches by individual contributions and
that thoy wero tho leal owners of tho pro
perties. One of these was tho Shenandoah
congregation. Tho matter was again carried
into tho court and tho claims of the Esherito
factious wero again sustained. It was stated
that in as much as tho congregation had placed
tho properties in the name of tho general con
ference and tho I.slientes had been declared
tho legal head or that conference they were
entitled to tho properties. Tho Shenandoah
cougregutton, llko many others in tho state,
vacated. The church, parsonage, etc., at tho
corner of I'llfcrry And Wct streets was left to
tho Eshetitos and they now hold it. The old
congregation had held it for over twenty
years and invested In it from $20,000
to S25.000. Tho property consists of
a church, two dwellings under it, on
tho West street side, and a pareonago
and dwelling for the jauilor on tho Cherry
street sido, Only a year beforo the property
was vacated about $2,000 had been spent in
imnrovemcuts. Tho feeling of the old con
gregatlou was so strong In favor of llishop
Dubs that not ono was left to stand by the
old church and they ro-orgauized as the
Bethany United Evaugollcal church.f It is
about a year binco tho ejectment took place
and during that time the congregation has
been worshipping in Dougherty's hall.
Tho church just purchased is located on
North Jardln street, between Centre nad
Lloyd streets. It is a very neat littlo edifice,
but must bo enlarged to accommodate the
new owners. It is understood tho front will
be brought flush with tho street and an add!
tion of 20 feet will bo added to the rear. It
will also be necessary to remodel tho interior
of tho edifice to somo extent, in order to af
ford room for tho Sunday school Indopoudont
of tho general assembly room. This will
probably bo provided for by a portable parti
tion. Dellnlto plans for the change have not
beon made, however, but workmen will bo
gin at oncu to mako excavations for tho addi
tion at tho rear. Tho sentiment of the
public is strougly in favor of tho congrega
tion and littlo dilliculty will be experienced
in securing help to pay for tho church and
improvements. In one day last week tho
pastor raised fl,C00 by subscriptions. Sev
eral membors of tho congregation havo al
ready subscribed sums ranging from 550 to
Woo.
