THE CONSTABLE FEE SYSTEM.
Judge Slmuntou Delivers an Opinion of
General Interest.
Judgo Simouton, of Ilarrisburg, has handed
ilown threo opinions in contested fee cases
that concern every committing Magistrate
nnd Constable in tho State. Tho suits were
brought by Alderman Landls and Constables
Diehl and Winters against tho Commissioners
of Dauphin County to settle questions arising
over tho feo bill passed by the Legislature iu
1603, aud which is now iu force In this State,
and all questions wero decided in favor of tho
county. Alderman I-anuis' suit was whether
for issuing a warrant for three persons ho
was entitled to chargo for three or for only
ono. Tho Court decided in favor of but one
similar decision was made iu the Diehl
case. In tho case ol ex-Constable winters
dillbrcnt questions wero Involved, Ho
claimed a feo for a recommitment after
hearing, and, iu making n trip of two miles,
charged for four, counting two miles for a
return trip. Neither of these claims was
allowed.
Judgo Simonton allows Constables.1) instead
of 10 cents n milo for traveling oxponscs in
serving jiapers, and reduces tho fee fur serving
subpoenas from 50 to 15 cents. He allows
feo for ono warrant in all criminal cases for
both the Alderman aud Constable, no matter
how many defendants, The feo for an in'
formation beforo au Alderman or Justice Is
cut from 00 to 50 cents.
Tho cases will le taken to the Supreme
