Speedy Justice Will Overtnlto All Who Violate the Lom by Aiding Those In Ilnhplllnn Against a Friendly l'orolgii Government WA3llixaTON,.Iuuo 13. Secretary Olncy Is thoroughly determined that tho United States government shall do all ln.lts power and nil tho intornationnl law requires to prevent tho violation of tho United States territory by persons who undertuko to mnko It a baso of hostile operations against Spain, with which power it is at peaco. Complaints have reached tho department of stato through tho Spanish minister that men are being recruited ou American soil, and that armed expeditions are leaving our shores for tho purpose of attacking tho Spanish forces in Cuba. Whonover the necessary ovldonco can bo procured these infractions of the law of tho United States are to bo severely punished, for the secre tary of stato will louvo no just ground for complaint that the United Statos has failed in its obligations to othor nations. Meanwhile, howovcr, It has been deemed proper to give formal warning to mis guided people of what they may cxpoot, so yesterday afternoon the following procla mation was issued from tho stato depart ment by tho president: "Whoroas, tho Island of Cuba Is now tho seat of serious civil disturbances, uo compauied by armed resistance to the authority of the established government of Spain, a power with which tho United States aro and desire to romoln on terms of peucoaud amity; and, Whereas, tho laws of tho United btntes prohibit thoir citizens, as well usullothors being within and subject to their jurisdic tion, from taking part In such disturb ances adversely to such established gov ernment by accepting or exercising com missions for warlike service against it, by enlistment, or procuring others to enlist for such servico, by fitting out armed or procuring to bo fitted out armed ships of wur for such service, by augmenting the force of any ship of war engaged m such servico and arriving In u port of tho United States, and by sotting on foot or provid ing or preparing tho means for military enterprises to bo carried ou from the United States against tho territory of such government; "Now, theroforo, in recognition of the laws aforesaid and in discharge of tho ob ligations of tho United States towards a friendly power and as a moasuro of pro cuution and to tho end that citizens of tho United States and all others within its jurisdiction may bo deterred from subject ing themselves to legal forfeitures and ponalties I, Grovcr Clovoland, president of tho United Statos of America, do hereby admonish all such citizens and other par sous to abstain from ovory vlolutlouof tho laws horelu before referred to, and do hereby warn thorn that all violations of such laws will bo rigorously prosecuted; undl do hereby enjoin upon ull olUcors of tho United States charged with tho exe cution of said laws tho utmost dlllgenco In preventing violations thereof und In bringing to trial und puuishmont any of fenders against tho sumo." Tho issuance of tho president's -proclamation guvo rlso to considerable discus sion its to whether It docs not practically umount to a recognition of tho rebels as belligerents. Such uu Interpretation of tho proclamation, howovor, is not correct, according to tho opinions of several well known public men. Senator Morgan, of Alabama, who is a recognized authority ou international law, whou asked about tho mutter, said: "No recognition of tho rights of beliger ency aro accorded by tho proclamation, but just the reverse Is tho cuso. There would huvo been no necessity for such ac tion if tho lnsurgonts woro belligerents, for then tho citizens of tho United States would hnvo tho right to sell them muni tions of wur if thoy could escape thoblook udo of the Spanish fleets. It is simply car rying out tho law on tho subjoct." Scnntor Coll, of Florida, said tho pro clamation was rather stronger than ho liked. "I am," he said, "In favor of tho Indepondenco of Cuba, for it Is u foregone conclusion that tho Island will throw, off the Spanish yoko.
