Dallas, of tlio I nltcd State circuit court,
before whom tho enso is pending.
Tho illlllculty between tho two organiza
tions readied n crisis on Aug. 15 last, when
General Superintendent Swclgnrd sum
nionod before him cloven omployos and
notified them that they Bhould abandon
tho brotherhood as a condition of retain
ing their places Willi tho railroad company.
Vigorous tirotests wcro mndo against this
nltornatlvo, and tho brotherhood urged tho
recelvors to withdraw It, but In answer tho
receivers, 011 Sept. 17, wrote:
"Tlin nolinv of this comnany is woll
known to bo that It will not consent that
persons In Its service shall owo alloglanco
tn nthor nrtmnlzntlons which may make
claims upon them which are Incompatible
with their duties to tholr employers, xii's
position was taken advisedly, and wo have
no Intention of departing from it."
Attorney General Ulney's letter is an
exhaustive dlsousslon of tho questions
presented, and ho reviews tho various
problems, nnu uio consisiunii buiuuuus vu
bo applied, In evory aspect. In substance
ho holds that labor unorganized Is practi
cally powerless) thatln combinations such
as this lies tlio only snieguanioi tno worK
lngman In his dealings with organized
capital, and that Ills right to belong to
such 11 union, benellclal in intent nna pur
poses, Is a legal right which ho cannot bo
deprived of.
Attorney General Olnoy s letter is in
part as follows:
"Tho petitioners are members 01 tno
Brotherhood of ltallroad Trainmen. Somo
of them haT!) boon members for seven or
eight years havo each year paid annual
duos and assessments which now amount
lo considerable sums of money nnd by
coutluulnlng their momborshlp will, In
caso of death or permanent disability, be
come entitled by themselves or their rep
resentatives to largo pecuniary payments
from tho funds of tho brothorhood. On tho
other hand, by ceasing to bo members,
they loso all benefit from tho assessments
and duos already paid and forfeit all claim
upon tho brothorhood treasury.
"Tho constitution nnd rules of tho
brotherhood and of tho subordinate lodges
nra before tho oourt as pnrtof tho petition.
No controversy or nntiigoulsm has over
arisen or oxlsted between tho Heading
railroad and tho brotherhood or any of Its
lodges, or between tho Heading railroad
nnd nny members of tho brotherhood as
such niJinbers. If, as Is claimed, tho
Heading railroad lias for somo years
adopted tho rule that It would not havo In
Its service any member of a labor organi
zation, it Is a rule which has not been uni
formly nor Invariably acted upon.
"Tlio Heading railroad being now In tho
hands of receivers, tho receivers and all tlio
omployos uf tho company nro officers or
tho court. Tho court, therefore, nnd not
tho company, Is tho employer of all tho
persons enguged In the operation of tho
road. The present policy 01 tuo court
and not the past policy of tho company-

deserving tho approbation and support of

Speaking of strlko ho says: "It Is un

a strlko Is not necessarily unlawful sluco

as operating In restraint of strikes.

relation now existing. The congregation
of tho Ilrooklyn Taliernnclo have built
during my pastorate threo churches. which
hnve been dostroyed. It Is not right that
I should call on thorn to build a fourth
church during my ministry.
"I advise that you do ono ot two things,

main In organization until you can give
certificates of membership to our people.so
