mittee resumed its Investigations Into the
police department yesterday, after a two
weeks' VHcntlon, taken to allow the mem
bers of the committee to attend the Btato
convention of the Itenublloan and Demo
cratic parties. It Is evident that matters
are rapidly reaching n climax. The be
ginning of the end apparently is In sight.
Commencing with tho criminals, the
very worst men and women In New York
city ns witnesses, Mr. GoiT, the nttomey
who has been conducting tho lnvestlen
tlon, has been steadily moving upward In
the scale of humanity. The testimony of
cx-ofllccrs nnd former policemen having
been taken just before adjournment the
prosecution took another step nearer the
throne yesterday, when Major Wllllnm
H. Kip, chief clerk at tho police head
quarters, was called as tho first witness of
the day. His testimony referred largely
to matter appearing In tho records, and
was to some extent of a routine nature.
Then came cx-I'ollce Commissioner
Charles K. MncLenn. He, thought the
power exercised by the police courts over
tho police department wnS In tho main In
jurious. Ho believed that a single head
to the department would eventually bean
Improvement. The civil service law hnd
proved of little benefit to the department,
becnuso so many of the Inspectors were
lncompetont. Ho could recall only one
lnstnnce In which n formal Investigation
was mode by the bonrd touching tho snle
of captaincies. The witness gave it out ns
Ills opinion that the present system, with
its bnd application to tho civil service
laws, offered greater opportunities for
purchasing n place on tho police force
than under the old system.

session began. The Interest In tho pro

witnesses called was Corporation Counsel
Clarke. He was nsked why he had desig
nated Mr. Wellmnn to nppcnr as special
counsel to the police board durinir the re

ficers, since Mr. Wclhnnn was nlready
dr awing n s nlnry ns nsslstnnt district at
torney. Mr. (Jlnrko sold he selected Mr.
Wellmnn because he was familiar with
criminal law, and thnt tho appointment
was neither wrong nor illegal.
"Electricity by Water Power.
New York, Oct. 2. The power and
mining department of the General Elec
tric company has just closed n contract
which mnrks a further step In the nil
vance of electrical science. This contract
is with tho Sacramento Electric Power
and Light company, nnd calls for the
transmission by electricity from a water
power at Folsom, Cnl., twenty miles dis
tant, of several thousand electrical horse
power to the city of Sacramento to supply

president of the Hank of Sedgewick City,
who, it is alleged, with others, defrauded
J. W. Hantscy, of Springfield. Ills., out of

was arrested 011 Sunday In Plymouth, N.
H., and officers have started to bring him
back. Two of thosu charged with being
accomplices of Hazzuril have been sent to
the penitentiary, but Hazzard escaped to
Canada at tho time.

Adatsch, have been condemned to four
months' imprisonment in a fortress for
lighting a duel. The duel was fought
with pistols near Derliti on April 10. Five
shots were lircd, nnd Herr Potsdorf was
wounded lu the arm.

him, the Unltel States circuit conn nt
appeals reversed in part the famous de
cision of Judge .lenkius in the case of P.
M. Arthur and others aKalust the North
ern Pacific railroad, lu which Judge Jen
kins decided that men had no right to
combine for a strike under certain condi
tions. Although the case is reversed in
part, and the cause remanded witli direc
tions to strike out certain portions nf
Judge Jenkln's opinion, the effect of the
decision Is to prevent all strikes unless
they be absolutely peaceable.
The court said that Judue Jenkins had
exceeded his powers wheu he enjoined the
employes of the receivers of the Northern
Pacific railroad company from quitting
the service of said receivers, with or with
out notice, so as to cripple tho property or
prevent tho operation of said rond. It
held, however, that the section should
stand In which the men were prohibited
"from combining nnd conspiring to quit,
with or without notice, tho service of said
receivers, witli the object and intent of
crinpling the property in their custody, or
embnrrassing the operation of said rail
road." The decision was considered by the law
yers who packed tho court room as one of
tho most important opinions delivered in
the United States iu a decado. It defines
the status before the law of labor organ
izations lu their conduct of strikes, nnd
ntllrms the powers of courts of equity to
interfere by injunction when there is
reason to believe that tho law will be vio
lated. It holds that men may withdraw

Justice Harlan, of tho supremo court
delivered the opinion. Sitting with him
were Judges Woods, Ilium, Grosseup nnd
Jenkins. Tho last named sat with diis
eyes fixed upon Harlan as the latter read

action. Judge .Jenkins appeared undis
turbed uy tho opinion.
Tho audience which listened to tho read
ing of the opinion was a most distin
