Thero was a limited time given the company to repair tho road, but tho Council didn't tear up the roid. I don't kiow why they didn't carry out the rosolu tiuu. I was not in favor of tearing up tho track. I voted against it once booauso I wanted to give tho company more time to fix up tho other part of the track, not ou tho question of right of way. I did a little more business at my hotel on tho night of August 21st on account of tho trans fer of passengers caused by tho tearing up of the track. That was the only incroase. The 21st was not fixed for tho toarlng up be cause on that day tho company would do its greatest business on becauso tho Lavcllo Fair opened on that day. I didn't go near tho toaring up of tho track. I llvo about thirty yards from ono end of the tearing up and I don't know whether there was ono or more I shifts on tho work. I didn't seo any drunken men there that night, or any under tho in fluenco of liquor. I baw some shots. I saw Mr. Briggs shoot. I got to the placo of shoot ing to adviso a little. I havo a very poor memory. About a down, or porhaps more shots were fired. I said the man was very snotty for telling poople to keep away from the oar. This man stood on thegrouud. When Briggs caiao out just beforo the shot he said, "Horo wo aro ," and then shot I was about twenty feet from Briggs when ho fired. I said before the Coroner's jury Briggs said, "Hero I am, you ," and ho tired. I can't say my memory was any uefr ter than now when before the Coronor's jury aud I don't know that it is any better now, Tho shots fired were like a bunch of shooting crackers, right after each other. I oan't say that I saw Amour grab a gun from anybody, I did swear before the Coroner Amour took gun from u man In about the centre of tho oar: mv recollection is refreshed now. I saw Amour go In the ear and saw him throw his arms up and shove the gun out of the way. Amour never mentioned anything about ihootlng to mo, or bow ho wss Bhot.
