The requirements are to be similar to those enacted by the government of applicants for service with the United States. Automobile license fees -eeolected by the state highway department may be spent by that department for the maintenance of roads in the state, gc- cording to a decision which was han- ded down Monday by the supreme court in Philadelphia by Justice Pot- ter. The court by the decision, upholds the Dauphin County court which a- warded -a mandamus against Auditor General Powell and State Treasufer Young- commanding them to pay cer- tain road bills of former Highway Commissioner Bigelow of funds ve- ceived from automobile registrations and licenses. The fees received since the passage of the motor license law total more than $1,000,000. Auditor General Powell and State Treasurer Young appealed from the decision of the Dauphin County comrt attacking the constitutionality of the automobile license act. It was agreed by Attorney General John C. Bell that the legislature had a right to determine how fees receiv- | ed under the act should be spent, and ! that it was the duty of the auditor general after examining the bills and deciding upon their correctness, to is- sue a warrant upon the state tress- urer, who was simply the custodian of the money and had no further pow- ers. Livengood’s liabilities were $200,000. Options were recently secured on a plot of mineral land in Milford township, near Rockwood. There dre 1,500 acres of coal involved. A num- ber of prominent coal operators are interested in the prospective deal. Farms under option are those of George J. Hay, John M. Critchfield, Herman Hay, Walker Brothers, Alex- ander Newman, E. J. Weimer, Jacob Walter, John C. Weller and others. The farmers have been almost be- sieged by prospectors and promoters but are very wary of all such. A jury rendered a verdict to the effect that James Marino, who died a few days ago in a Johnstown | hospital, was the victim of a gunshot | wound, thus putting the matter up to the Somerset county authorities to determine the manner in which the injury was inflicted. When brought to the hospital from Acosta, Marino told the attendants he had attempted to prevent his brother-in-law from com- mitting suicide and in the struggle for the weapon the revolver was accident- ally discharged.
