NOTICE IN HEREBY GIVEN, i
'•That the Inspectors ami Juuges ch sen as afore

respectively belong, before nine o'clock on the morn
ing of the second foes lay in October, in each and
every year, and each of said Inspectors shall appoint

"In easa the person who shall have received the
second .highest number of votes for Inspectors shall
not. attend on the day of Election ho, the person
who shall have received the second Highest number
of votes for Jn ige at th- proceeding election shall
act as Inspector in his pl ace. And in case the person
who shall have received the highest number of votes
for Inspector shall not attend, the person elected
Ju ge shall appoint an Inspector in his place ; and
in case the person elected Judge shall not attend,then
the Inspector who received the highest number of
votes shall appoint a Judge ir his place, and if any
vacancy shall continue in the BoiM for the spice of
one hour alt-r the time tixed f u r the owning the elec
tion of the qualified voters of the township, ward or
district, for wtiicb such officer shall have been elect
ed. present at the place of election, shall elect one of
their number to hit si eh vacancy.
"In all cases where the names of a pcrsen claim
ing to vote is not to be found on the list fun; shed
by the Commissioners and Assessors, or his right to
vote whe'her found therein or not is objected "toby
any qu ilifie I citizen it shall be the duty of the In
spectors to examine such peisoris on oath as to his
qualifications and if he claims to have resided in the
Stare for one yearor more,his oath shall be sufficient
proof thereof; but he shall in ike proof by at le ist
one competent witness who shall be a qu ilified elect
or that has reside.! within the district for more than
ten days immediately pre.- cding the election, and
shall also himself swear that hie bona fide residence,
in pursuance of bis lawlul calling is within the dis
trict and that he did not move into the district for
the purpose of vuting therein.
Every person dual.tied as aforesaid, and who shall
mike due proof, if required, of his residence an!
payment of taxes as aforesaid, shall be admitted to
vote in the township, ward or district in which he
shall reside
.•If any person or persons shall make any bet or
wager upon the result of any ele-tion in this Corn
monwe&lth, or shall offer to make any such bet or
wager either by verbal pro, lainaiion thereof, or by
any written or printed advertisement challenge o
invite any person or persons to m ike such a bet or
wa-er, upon conviction thereof lie - r they shall for
feit and pay three times the amount so bet or offered
to bet.
"If any person not bylaw qualified shall fraudu
lent ly vote at any election within this Common
wealth, or being otherwise qualified shall vote out
of his proper, district, or if any person knowing the
want of such qualification shall aid or procure such
person or persons off.-nding shall on conviction be
fined not exceeding two hundred dollars and be ira
[ri'oncd fur a term not exceeding three months.
"If any person shall role a> more than one elec
tion district, or otherwise fraudulently more than
?ncc on the same day or shall fraudulently fold and
deliver to the Inspectors two tickets together with
the intention to illegally vote, or shall vote the same
or if any person shall advise or procue other so to do
he or they so offending shall on conviction, be fined
in any sum not less than fifty nor more than five
hundred dollars and lie imprisoned tor any term not
less than three nor more than twelve months.
"If any person not qualified to vote in this Com
monwealth agreeable to law (ixcepting the sons of
qualified citizens.) shall appear at any place of < lec
tion for the purposo of issuing tickets or influencing
citizens qualified to vote, he sbill on conviction for
feit and pay any sum not exceeding one hundred dol
lars tor every such offen e, and be imprisoned for any
term not exceeding three months.
"That any person except justices of the peace
who shall hold any office or iipp-int'nent of profit or
| trust und ■■v the government of the United States, or
I of this State, or of any city or incorporated district
wnether a commissioned officer or otherwise—a suo'-
ordmate officer or agent—who is or who shall be em
i ployed under the legislative, executive of judiciary
i department of this State or of the United States, or
, of any elty or incorporated di-trict and also that
every member of Congress and of the State Legisla
ture,and of the select or common council of any city,
or commissioners of any incorporated district is by
law incapable of bidding or exercising, at the same
time,the office of ai pointiaent of Judge.lnsp c tor or,
Clerk of any election within this Commonwealth and
that no Inspector. Judge or other officer of any such
election, shall be eligible to any office to be then
voted for.
"No person sh ill be permitted to vote at any
election as aforesaid, other than white freeman
of tke age of 21 years or more, who shall have re
sided in this State at least ne year, and in the
election district where he offers to vote, at least ten

rote although they shall not have paid taxes.
"No person shall b< permitted to vote whose
name is not contained in the list of taxable inhab
itants furnished by tbo Commissioners as atorosaid
, unless first he produces a receipt for the payment
within 2 years of; Srate or Couaty tax assessed
agreeably to the Constitution and give satisfactory
evidence, either on his oath or affirmation of another
that he has paid such tax or on failure to produce a
receipt shall make oath to the paymrnt thereof;
or second, if he claims a right to vote, by beiug an
elector between the age of 21 and 22 years, be shall
dispose on oath or affirmation that he has resided
in the State at least one year before his application
and make snch proof of residence in his district as
required by this Act, and that he docs verily be
lieve from the account given him that he is of the
aforesaid age, and give such other evide ce ns is
required by this Act, whereupon the n.iine of the
person so admitted to vote shall be inserted in the
alphabetical list by the Inspectors, and a note made
opposite thereto by writing the word "tax," if he
shall be admitted to vote by reason of having paid
a tax. of the word 'age' if he shall be permitted to
vote on account of his age, and neither case the
reason of such vote shall be called out to the clerks,
who shall name it in the list, of voters kept by them.
"If any person shall prevent or attempt to pre
vent nny officer of an election, or use or threaten
any violenee to any such officer, or shall interfere
with him in the execution of bis duty or shall block
up or attempt to block the window or avenue or any
window where the game may be hold en, or shall j
riotously disturb the peace of such election or shall
use or practice any intimidation, threats, force or I
violence, with design to influence unduly or overawe
any elector to prevent him from voting or to restrain
the freedom of ehoice, such person on con/iction
shall he fined in any sum not exceeding five hun
dred dollars and be imprisoned for any time not
less than one nor more than twelve months; and if
it shall be-shown to the Court where the trial of
such offense shall be had that the person so offend
ing was not a resident of the city, ward, district, or
town>hip where the offence was committed, and not
entitled to a vote therein, then on convi tion he
shall he sentenced to pay a fine of not less than one
hundred dollars and be imprisoned not less thuu
six months or more than two years.
AN ACT
Regulating the mode of voting at all elections, in
the several counties of this Commonwealth.
SECTION I Re it enacted by the Senate and
House ot Representatives of the Commonwealth of
Pennsylvania in General Assembly met, and it- is
fiereby enacted by the authority of the same, That
the qualified voters of the several counties of this
Commonwealth, at all genernl, township, borough
and special elections, are hereby, hareafter, author- j
ized and required fo vote, by tickets, printed or
written, or partly printed and partly written, sever
ally classified .as follows: One ticket shall embrace
the n.-tt tes of all judges of courts voted tor, and to
ba labelled, outside, "judiciary;" one ticket >hall
embrace the names of all tate officers voted for.
and to be labelled, ' state;" one ticket shall era
brace the names of all county officers voted for, in
cluding office of senator, member, and members of
~te?mbly. if voted for, and members of congress if 1
voted for, aC* be labelled, "county;" one ticket
shall embrace the names of all township officers vo
•ed for, and tie labelled, "township;" One ticket
shall embrace the fames Ot au borough officers vo
ted for, and be labelled, "borough ;" and each class
shall be deposited ill separate ballot-boxes.
* AND WHEREAS, B.v the act of the Congress of the
United States, entitled "An act to amend the sev
eral acts heretofore passed to provide for the en
rollingand calling out the National forces, and for
other purposes" arid approved March third, one
thousand eight hundred and sixty-five, allptrsong
who hive deserted the military tr naval service of
the United States and who have not been dir
charged, or relieved frotn the penalty, or disability
therein provided arc leemed, and taken, to have
voluntarily relinquished, and forfeited their rights
of citizenship, and their right to become citizens,
and are deprived of exercising any rights of citizens
thereof :
AND WHKREAS, Persons, not citizens of the United
State 3, ore not, under the Constitution and laws of
Pennsylvania, qualified electors of this Common
wealth :
SBCTIOS I. Be it e.nacted by the Senate and
House of Representatives ot the Commonwealth of
Pennsylvania iff General Assembly met, and it is
hereby en o-ted hv the authority of the tame, That
in all "elections hereafter to be held in this C tn
monwealth. i* jhnll he unlawful for the judge or in
sp ctors of any such election to receive billot, or
ballots, from any person or persons emhiaced in
the provisions, and subject to the disability, im
posed by said act. of Congress,approved March third,
one thousand ei"h' humlred and sixty-five, and it
shall be unlawful tor any such person to offer to
rote anv ballot, or ballots.
SECTION-2. Thit if any such judge an! inspectors
of election, or any one of thorn sh ill receive or con
sent to receive, any su h unlawful ballot, or ballots
from any such disqualified person, he, or they, an
offending shall lie guilty of a misdemeanor, are!,
upon conviction thereof, in any court of quarter
sessions of this Commonwealth, he shall, f>r each of
fense, be sentenced to pay J fine of pot less than
one hundred dollars, aud to undergo a„ imprison
ment, in the jail f the proper county, for not less
than sixty days
SEC 3. That if ry person deprived of citizen
ship, and disqualified aforesaid, shall at any elec
tion, hereafter to be held in this Commonwealth,
vote, or tender to the officers thereof, and offer 'o
vote, a ballot, or ballots, any person, so offending,
shall be deemed guilty of a misdemeanor, and on
conjiy-tion thereof, in any court of quarter sessions
of this Commonwealth, shall, fo. each ofiense, be
punished in like manner as is provi led in the [ire
ceding section of this act. in the case of officers of
election receiving such unlawfnl ballot or ballots .
SF.C. 4 That if any person shall persiiadv, or
advise, any person, or persons, deprived of citizen
ship. and disqualified ns aforesaid, to offer any bal
lot or ballots, to the officers of any election, here
after to be hel i i ■ this Commonwealth, or shall j
persuade, or advise, any such officer to receive any
ballot, or ballot, Irom any person deprived of citi
zenship, and di-qualified as aforesaid, such person,
so offending, shall he guilty of a misdemeanor, and
ujion conviction thereof, in any court of quarter ses
sions of ti.is Commonwealth, shall be punished in :
like manner as is provided in the so onu section of
this act, in thi case of officers of such election re
ceiving such unlawful ballot, or ballots

tion of said Act. every general and special election

in the forenoon and shall continue without interrup
tion or adj mrnnient until seven o'clock in the even
ing, when the polls shall be closed.
Pursu>nt to the provisions contained in the 76th
section of the Act, the Judges of the aforesaid dis
tricts respectively shall take charge of tie certifi
cate or return of the election ot their respective dis
tricts, and pristuce them at a meeting ot one fudge
from ei h district, at the Court House in thelo
rough of Tunkhnnnock, on he third day after the
day of election, being the 12th day of Octo er next,
/hen and there to do and perforin th- duties re
-suired ny law of said Judges. Also, that where a
udge by sickness or unavoidable accident is unable
to attend said meeting of Judges then the certifi
cates on return aforesaid shall takn charge of
by one of the inspectors or Clerks of election of said
district who shall do and perform the duties requir
ed of said Judge unable to attend.
Also, thai in the 31st section of aid Act. it is
enacted. tha when two or more counties shall com
pose a District for the choice of a member or mem-
I liers of the senate of this Commonwealth of the
i House of R< presentatives of the United States of
this Commonwealth, or President Judge, the Judges
of the election in each county having met as afore
said, the Clerks shall make out a fast statement of
all the votes which shall have been given •at such
election, within the county for every person voted
for, as such member or members, or President
Judge. which shall be signed by said Judges and
attested by the Clerks ; and one of the said Judges
shall take charge of said certificate and shall pro
duce the same at a meeting of one Judge trom each
county in such districts ag is or may bo appointed
by law for this purpose, which meeting shall be held
the seventh day after the election "
