summer crops. The writer has had
that rxniiiciife for a number of
years. Would it be saying too much
that it is only the shiftless who are
n istm iiiir the hnrhwavs. Don t
think it would ? It would pay the
man who lias only one cow in tlie
saving of all the droppings and ma
nure that would be made in a sum

ture on the road have some land,
but thev don't care if school keeps
or not might call them public
charges not poor men. Instead of
trving their hand at some new in
dtistrv or do better farming they
are loati n iron some comer or store
and are discussing hard times. Who

tuxes ! A few days at a dollar a day

The farmer barelv makes two ends
meet mid must oitv the bulk of all
the taxes. The writer knows of
farmers whose farms are overrun
with briers and brush who have
land enough to pasture their cattle,
who count their riches by the ten
thmiMimils mid who would take a
neimv from a dead man's eye am
kick him because it was not a dollar.
Now let us consider it in a legal
point of view and you will find that
cattle and hogs are trespassers on
the highway.
Along the public road you will
find chestnut, walnut and other
timber. If it belongs to the public,
cut them down, and see where you
land.or dig and quarry the limestone
and the man that does such an act
is a trespasser.
The road-master has no right even
to remove the gravel from any par
ticular road onto another. Neither
has the public the right of pasturage
upon the highway. No municipality,
or State has power to given right to
any individual to use the land appro
priated as a highway. The pastur
age which grows along the wayside
of a public road is in no sense a ne
cessity to tlie public, and there is
nothing in the character of a public
highw ay which makes it common or
gives the public a light to it. A
strong case to this point is Unit of
Cole vs. Drew, It Vt., Drew's
children in passing over the public
road to school were discommoded
and inconvenienced by the grass
making their clothing wet. lie ap
plied to the supervisor for permis
sion to cut the grass, which permis
sion was granted him, and he cut
the grass and fed it to his horses.
Cole, a proprietor adjoining the
road brought suit for the value of
the grass cut and removed, and re-
overed judgement in the court be-
uw . The Hunreme court on appeal
allirmed the judgment and held that
the owner of the soil over which a
highway is located is entitled to the
nableiueiits growing thereon, and
the entire use of the laud, except
the right which the public have to
the use of land and material there
on to repair and build the road. The
better plan would be lor all concern
ed to take care of their own cattle
and hogs. The time will surely
come when no cattle or hogs w ill be
