Wiien tha vote was counted off it was learned that liutl'master lad one majority of v.>tes over Middeiulorf. The vote being 208 and 209. Middendorf then claimed that there had been illegal votes cast and that 13 votes had been thrown aside by the Ber n'ce election board (owing, BO the board claimed to a deficiency in mark ing) which Middendorf claims should have been counted. For these reasons Mr. Middendorf is contest ing the election. Alphonsus Walsh was appointed Examiner by the court at February term. We give the order of the court to the Examiner anil the Ex aminer's Report below. Judge Sittser took the thirteen votes thrown aside by the election board, the Examiner's Report and the testi mony home with him anel will give the verdict later on. The thirteen votes will cut quite a figure in the decision of the case. If thrown aside Hullmaster will still remain the Collector. If counted Midden dorf will handle the Cherry twp. moneys. •rnE JUDOE'S OBDEU TO THE EX\MISEK. In tho Contested Election of Henry Hiffmister. And now, June 11, 1894, it is ordered that the ballot boxes of the two precincts of Cherry township be opened to obtain therefrom the regis ter list. If it appears that Frank Quiglev, No. 135. John Dempsey, No. 134, C. P, Hope. No. 143 and Edward Davey, No. 91, were not registered the ballots of such of them as were unregistereel shall be opened to as certain how they voted for collector. Patrick Walls, No. 281, having been said to bean ille-gal voter on account of lion payment of tax ; the examiner will ascertain how he voted for Col lector indepeneleut of whether his name be upon the register list or not. The examiner will aluo ascer tain if the names of Frank Sehaael, No. 40, Frank Kast, No. 128 and Frank Hunsinger, No. 238, are upon the register list. If not. then to as certain how tliev voted. Joseph W eisbrod has not been shown to be an illegal voter and no inquiry can be made as to his ballot. 13Y THE COUKT. EXAMINERS' REPORT. That in pursuance of the order hereto annexed I have examined ballots Nos. 1.35, 134, 143, 91 and ißlaml find that Frank Quigley No. 135, voted for Frank Midden dorf, John Dempsey, No. 134, voted for Fr«nk Middendorf. C. I*. Hope. No. 143, voted lor Frank Midden dor! Ed. Davey, No. 91, voted for Frank Middendorf, Patrick Walls, No. 281, voted for Frank Midden-' dorf.
