W. L. Saxer, who formerly was en-
gaged Io business in West Sayre, and
now resides at Dushore, made a busi-
nese trip fo his former home this
motniug, returning on the early train.
Dr. E B. Joachim returned from
Arizona last evening very much im-
proved in health. The journey was
taken for that object and he feels
greatly pleased with the outcome. C.
M. Myer, who was with him, has also
returned.
Isalah Potter came home from’ Pot-

snow drifts so deep that he could not |g

make sugar and so he returned in a
disconsolate humor, He thinks that
it will take. a July sun to melt the
drifts away.
Drs. Cowell and Rinebold made an
examination to determine the mental
condition of Herman P, Hedrick last
evening, and it was found that he is
suffering from a disordered brain,
and measures have been taken to send
him to the Danville Insane Asylum.
It was expected tha the Commission-
ers would remove him today,

PITTSBURG, March 20—-The Mo
nongahela, Allegheny, Ohlo, Youghie
gheny and Kiskiminetas rivers are ris
lug rapidly on account of heavy rains
throughout the western part of Peun-
sylvania. Creeks and other small
streams in this vicinity are already
swollen beyond their banks Fore
caster Peuny-Witt of the United
Stites weather bureau predicts a twen-
ty-five foot stage this afternoon. If
this is realized it will Inundate the low-
lands of Allegheny county.
Everybody located in the flood sone
are taking precautions to protect their
property. People are moving out of the
houses located in the lower part of Al
legheny. Business houses In the down-
town district of Pittaburg und Alle
gheny are moving their goods to bigh-
er floors after a majority of them bad

ORDINANCE NO. 24.
AN ORDINANCE granting to the
Sayre Electric Company, a corpora-
tion of the State of Pennsylvania, hav-
ing Its principal office in Sayre Bor-
ough, its successors or assigns, the
privilege of erecting and maintaining
poles, wires, cables, and conductors
of an Electric lighting, heating and
power system, over, under and along
the public streets, avenues, lanes, al-
leys, and public grounds within the
Borough of South Waverly, County of
Bradford ard State of Pennsylvania
Be it enacted by the Burgess and
Town Council of the Borough of
South Waverly, and it Is hereby enact
ed by the authority of the same:
Section 1. That the sald Sayre Elec- |
tric Company, its successors or as-|
signs, is hereby granted the rights
and privileges of erecting and main-
taining poles, wires, cables and con-
ductors over, under and along the
public streets, avenues, lanes, alleys
and public erounds, within the cor-
porate limits of said Borough, as they
now are or shall be hereafter extend-
ed, for the purpose of supplying light,
heat and power to sald Borough and
its inhabitants for illuminating, heat-
wg and mechanical nurposes, by
operate, use, maintain repair and ex-
tend the same over, under and along
the public sireets, avenues, lanes, al-
leys and public grounds in said Bor
ough. and for the purpose aforesaid
to make all necessary excavatious for
poles, etc, in any and all of sald
streets, avenues, lanes, alleys or pub-
lic grounds at any and all times,
under the following terms and con-
ditions.
Section 2. All poles shall be of
good sound cedar or chestnut, reason-
ably straight and prooerly shaped, and
shall be set inside the curb line at
such points as shall be designated by
the Street Committee of the Borough
Council.
Section 3. All wires used shall be
of first class ouality, properly insula-
ted, same to be properly stayed and
maintained, and where strung on
poles said poles shall be of sufficient
height and the sald wires shall be
strung at such height above
ground as directed by the Street Com-
mittee of the Borough Council.
Section 4. All poles, wires, cables,
appliances, structures and erections of
every kind used or employed in, upon
or over any of the streets, avenues,
lanes, alleys or public grounds with-
in sald Borough for the purpose of
the distribution of electricity under
this ordinance, shall al all times be
kekpt and maintained in good and
proper order and repair and in a safe,
suitable and proper condition.
Section 5. The sald Sayre Elsctrie
Company, its successors or
shall at all times hereafter pe
keep harmless the Borough of South
Waverly from any and all suits, so
tions, damages, costs, counsel
and expenses of every nature and
hereby granted.
Section 6. The sald borough shall
have during the term of this franchise,
without charge therefor, the right to
use the poles of the sald Bayre
tric Company, its successors or
signs, for police and fire alarm wires,
without hindrance or molestation,
using for the said purpose the upper
most portion of the poles,
Section 7. Shoald Phe sald Com
pany, ita successors or assigns, at
any time decide to place its wires,
cabies or appliances or any other
part thereof underground Ht shall
have the right to construct the neces
sary underground subway or conduits
in, under, on or across the
alleys, lanes, avenues and
places within the sald
sald purpose. Sald work to be done
under the direction and su
pervision
of the Borough Council and the
lanes, alleys or publle rounds or
make necessary repairs, In that Sate
the Borough shall have the right to
do sald work, and collect the cost
thereof, with all costs, expenses and
counsel fees, from the said Company,
its successors or assigns.
Section 8. This Franchise shall
terminate at the expiration of thirty-
fre years from the date of its grant-
ing.
Section 5. The sald Company,
some one duly authorized in its
half, shall within thirty days
this date file a written acceptance
this franchise with the clerk of
Borough Council and shall pay
expense of drafting and advertising
this Ordinance.
Section 10. A fallure on the Jost
of the sald Company, its sucessors
assigns, to fully comply with all’
terms and conditons of this —
chise shall render the same,
rights thereunder, vold and
ishall thereby be forfeited.
Section 11. The franchise hereby
granted shall not be considered as de
| priving the Borough of South Waverly
from granting other franchises for
furnishing Electric light, heating and
power, to other Companies.
Section 12. The sajd Sayre Electric
Company, its successors or assigns,
shall pay into the treasury of South
Waverly Borough during the month
of January, 1508, the sum of Fifty
($50.00) Dollars as a franchisp tax;
during the month of January, 1908,
the sum of Sixty ($60.00) Dollars as
a franchise tay; during the month of
January, 1910, the sum of Seventy
31) Dollars as n franchise tax: dare
Ing the month of January, 1911, the
sum of Eighty ($80.00) Dollars as a
franchise tax; doring the month of
January, 1912, the sum of Ninety
($50.00) Dollars as a franchise tax;
during the month of January, 1913,
the sum of One Hundred ($100.00 Dol-
lars as a franchise tax; and a like
sum of One Hundred ($100.00) Dollars
during the month of January of each
and every year thereafter, during the
term of this franchise, as a {franchise
tax The sald sum to be in leu of all
other local taxes.
Section 13. The Sayre Electric
Company, its successors or Jasisns,
shall, during the term of this fran-
chise, furnish Electric light tree of
charge to the Borough of South Wa-
verly for lighting the Borough lockup
side.
Section 14. This Ordinance shall
[be effective after having been ploper-
ly passed, signed, advertised. accord-
{ing to law, and accepted by the sald
Company.
The foregoing ordinance was
ed by the South Waverly Council at
a meeting held on the Fourth day of
March, 1907.
