Arrest Made In the South Waverly Case—Hearing Tomorrow. Yesterday afternoon Thomas Mc- Maban was arraigned before Justice Carey on a charge of assault prefer- red by Michael Loftus. The arrest of McMahan is the culmination of an altercation which ocurred between the two men at South Waverly on Bunday night Loftus was knocked down near the Fulton House on Ful. ton street. His head struck the stone pavement and Le was unconscious when picked up. A report was sent out that he died later of his injuries. This, however, proved incorrect Yes- terday he appeared before Justice Carey and secured a warrant for Mc- Mahan, charging him with committing the assault.
