Boston, however, was Immediately re-
‘arrested on a charge of fornication
‘and after listening to the evidence
‘of twelve witnesses for the common-
[wealth the justice held Boston to the
next court of quarter sessions in the
sum of $300 bail. A. J. Green appear-
ed and quifified as bondsman and
Boston was released from custody.
The hearing attracted a large
crowd of speciators and necessitated
the attendance of over a score of
witnesses. The commonwealth was
unable to prove that Boston was a
married man, and therefore the
charge of adultery could not be sus-
taned. On the second charge. how-
ever, there was a large amount of
testimony to show that Boston and
Mrs. Hopler, the prosecutors’'s wife
iwere on intimate terms. It was
shown that when her goods were re-
ceived at this place Boston superin-
tended—their removal froin the sta
Uon to the rooms in the concrete
house on South Keystone avenue. It
was also shown that Boston had told
a friend that he bad been married
two months and that he was living
at the location named. M. P Murray
testified that he rented the rooms to
Boston and the lease was offeréd and
received in evidence. It bore Bos-
ton’s name. Officers Lewis and Vo-
gel testified as to the arrest of Bos-
ton. Officer Lewis swore that the ar-
rest was made about 12:25 Monday
Fate of Dominle Sharrone Is Still In
the Hands of the Gentlemen Twelve
—No Verdiet at Two O'clock This
Afternoon.
¥
The fate of Dominic Sharrone, the
Italian charged with the murder of
Eugene Messenger at Athens in Au-
gust last, is still In the hands of the
Jury, and up to two o'clock this af-
ternoon po agreement had been
reached. The jury had been out con-
tinuously since Saturday afternoon.
They have returned to the court room
but once, at which time they asked
instructions from the judge relative
to second degree murder. This was
yesterday morning, and it was the
consensus of opinion that they in-
tended to reach a compromise ver-
dict of some character. The fallure
of the jury to agree, however, after
having been out all night and a whole
day, has given rise to the belief that
a disagreement will be the result
Should “the verdict result in
a disagreement It Is doubtful whether
Sharrone will be tried again, some
of the court opinions holding that
he has once been placed in jeopardy,
and therefore could mot be placed
in the same position a second time
