Traction Company for In- juries Sustained a Month Ago Ja couaty court today Paul E. Maynard, attorney for Michael Boyle began an action against the Waverly, Sayre & Athens Traction Company to recover damages in the sum of $5000 for injuries alleged to have been sustained by Mr. Boyle at the hands of the des fendant company. A month or more ago Mr. Boyle was driving across Elmer avenue at Steveason street, when his rig was struck by a trolley car, Mr, Boyle was thrown from the wagon and injured, the wagon was damaged, and the animal he was driving was so badly hurt that he had to be shot. In his complaint Mr. Boyle alleges that the trolley car was run- ning at a high rate of speed and that no warning signals were given He laid the matter before his attor- ney, and as the Traction company would not adjust the matter on Mr, Boyle's statement of claim, suit was brought today. The case will be an interesting one, and will be watched closely by the legal fraternity as several fine points of law are involved. Two years ago Mr. Boyle was in- jured by being struck by a trolley car, and at that time the company JEAN FORSITH AS DIRE Dread Malady Again Makes Its Appearance in Sayre Jean Forsyth, daughter of Grunt Forsyth, of No. 213 West Lock- hart street, is suffering from diph« theria. The girl is about fourteen years old, and she was attacked by the disease on Saturday night and Dr. C. L Stevens of Athens was called. At that time her condition was considered critical, but today she is reported as slightly better, This is the first case of the mals ady tb appear in Sayre in nearly a year. Last summer there were sev: eral cases in various parts of the borough, and in some instances death resulted. OAK GROVE PARK The Partello Stock Company will open their second week at Oak Grove Park this evening with a production of Mark Swan's clever play, entitled “The Ranchman's Daughter.” Mr. Swan wrote the “Princess of Patches,” which has pleased theatregoers here, and “The Ranchman's Daughter” is said to be a better play in every way. All the scenes are laid in England, and the story depicts a young American girl moving in English society and having the good sense to refuse a title for a good, honest American. Miss Ken- nedy, as the American girl, will, in her potrayal, add another to her long list of successes, Mr. Leland is cast for an English nobleman. The aid of the ladies on this occasion is in dispensable, and every lady friend of the fire department is earnestly requelited to attend the meeting to- _boes and Others Who Desire to Ride Free The officials of the Lehigh Vals ley are bound to break up the practice of illegal train riding, and all the special officers of the com- pany have been instructed to arrest violaters of the law on sight. De- tective Shaffer and his assistants are keeping a sharp lookout and every train that comes into the Sayre yards will be searched for the men who like to ride but who do not like to pay fare. The rule has been in vogue for some time and at various points along the line many offenders have been tak- en in custody. * TRATION CONPRY WOKS TAR SUT Judge Fanning Hands Down Decision in Which Sayre Bor- ough Is Interested Several court decisions of wide interest were handed down by Judge A. C, Fanning on Saturday afternoon. When the receiver.is in its proper place the circuit is ground- ed, but as soon as it is removed a coanection is made and in case of lightning striking the wire it is COME ‘ i — Watch Case Will Likely Be Investigated by the Grand Jury Today The case of the commonwealth versus Jacob Solomon will prob- ably come up before the grand jury today or tomorrow, Mr, Sol- omon is a member of the firm of Solomon Brothers, clothiers, on lower Desmond street, and the establishment on West LockRart street. Mr. Atkin that one Sunday several home leaving it in charge of a Polish girl named Anaie Konetch- sky. During the absence of Mr. Atkin an! his wife it is alleged that Solomon visited the house three times and that while there he took a piece of rubber tissue such as is used to stiffen the bottom of pants legs. When Mr, Atkin re- turned his gold watch which had been left in his vest which hung in the tailoring establishment was also missing. Mr. Atkin caused 2 warrant to be issued for Solomon's arrest, charging larceny, and after hearing the evidence Justice Carey held Solomon to the grand jury. The case against Mr. Solomon is purely circumstantial and its dispo- sition by the grand jury will be awaited with interest. SATURDAY NIGHT'S CONCERT Messrs. Barner's place of business on Desmond street. While the little girl was making a purchase of candy her brother saw Mr Barner's purse lying on the counter. The lad placed the purse in his pocket and went away. When Mr, Bars ner found that his purse was miss- ing he notified Chief Walsh and the latter went to the Solok home. He recovered the purse but Mr Bammer says that part of the con- tents was missing. The lad's father settled the matter before any arrests were made. KILLED AT GENEVA The dead body of a man, evi- dently a farm laborer, was found lying in front of the Geneva station at an early hour yesterday morn ing.
