Yesterday was a real fall day,
and overcoats were not only com-
fortable but very much in evidence,
Warmer weather, however, is pre-
dicted,
Mahlon Johnson, the contractor,
who has lived in Sayre for the past
ten years, shipped his household
goods to Binghamton today where
he will reside in the future,
Fruit growers say that the crop
for 1906 will be normal if not bet-
ter than the average. Many varie-
ties of peaches wintered well and

Last Night After Brief Illness
night of a complication of troubles

of paralysis which he had sustained
recently. Mr. Merrill resided on
Keystone avenue and his death re-
moves one of the oldest and best
known citizens of Sayre. He had
not been confined to his home
long, but within the last week had
failed rapidly.
The deceased was born in Litch
field, February 16, 1828, and was
therefore 78 years, 2 months and
25 days old. He moved to the
house in which he died on Key-
stone avenue in 1865 and had
since continued to reside there

first wife was Miss Hannah Harts.

is survived. One son, Edgar J

PAID USUAL FINE
A special officer was called
to the corner of Hayden and Lin-
coln streets last night about 11
o'clock to quiet a disturbance
which was being created by two
young men. When the officer
arrived one of the young men de-
sisted, but the other refused to
obey the minion of the law and
was placed under arrest. Later,
when arraigned before Justice Nel-
son on a charge of drunkeness and
disorderly conduct, he gave his
name as Fred Woodruff, and upon
pleading guilty was fined the usual
amount, one dollar and costs.
Friends paid the amount and he
was given his liberty.

Baptist church on Wednesday
evening next promises to be a most
interesting and entertaining event.
A large number of tickets have
been sold and the attendance will
therefore be large. Mr. Moree has
consented to give at least one read
ing in costume, while Miss Treat
has at the earnest solicitation of
her friends been induced to sing a
number which has been sung by
Mme. Blauvelt in her late opera

heard to excellent advantage in this

Engage in a Brawl Last Night
and Land in Jail
Tom McAsse of Ridgedury and
inmates of the borough bastile last |
night and this morning were ar- |
raigned on charges of drunkenness |
and disorderly conduct. Both men
were arrested by Officer William
Corner. Tom had been across the |
tracks and engaged in a fight with
a bartender, and when asked this
morning if he had been fighting
stated that the other fellow must
have been doing most of the work
Tom's face was badly battered and
he looked as if he had been given
severe treatment. He admitted
having paid over forty dollars in
fines into the village treasury at
Waverly, but that recently he had
chosen a jail sentence rather than
to pay a fine. He said, however,
that he had no recollection of hav- |
ing heretofore been arrested in|

Tom's cousin, Mike, was then
arraigned and admitted having
been drunk, so much so in fact that
it was necessary for the officer to
carry him to the lockup. He also

FOR CONMORWEALTH
Defense in Johnson Murder Case
Began Presenting Testimony
Today
This forenoon the commonwealth
in the Charles Johnson murder
case finished presenting its evi-
dence and the taking of testimony
for the defense began. It is ex-
pected that the greater part of next
week will be consumed in hearing
the evidence of the defense and the
summing. The fact that the tnal
could not possibly be finished this
week has made it necessary to
postpone the cases that were to
come up during the second week
of court. Accordingly Judge Fan
ning yesterday issued an order in-
structing the jurors for the second
week of court that their presence
will not be required until Thurs-
day, May 17, and it is quite likely
that they will thea again b=
excused until the following week.
The attendance at the trial is
small. Yesterday morning there
were only 11 persons outside the
rail. Later in the day a half dozen
women came in, but at no time has
the crowd been large. The testi.
mony thus far produced is nothing
new, and this accounts, in a large
measure, for the lack of interest on
the part of the pablic
