By a ruling of the court Dr. Parker
was nol permitted to deny or in any
way_refer to the sworn statement of
| Captain Thomas J. Cardiff, commander |
| of the Scythian, that he bad burned the
| yacht at the Instance of Dr. Parker.
“Did you at any time offer to Cap-
i tain Cardiff or promise to him a sum of
| money If he burned the Scythian?” the
witness was asked,
Mr. Cardozo, counsel for the insur
ance company, objected to the question
on the ground that be had asked no
i question on Cardiff's direct examina
tion which gave a basis for such a

tack the credibility of Captain Cardiff
and objected to the question as incom-
petent. He sald it would uot be compe
! tant unless Mrs Parker, the defendant,
had been charged with knowledge of
